\u201clocus standi\u201d means place to stand.<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">According to this doctrine, only a <\/span><b>person whose legal rights are affected can file a case.<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A stranger to the dispute is not allowed to interfere in court ingredients provided under <\/span><b>Order 7 Rule 11 of the Civil Procedure Code, 1908<\/b><span style=\"font-weight: 400;\"> are explained below:<\/span><\/p>\n<p><b>Presence of Injury<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The most basic and important requirement for Locus Standi is that the person must have suffered some kind of injury or harm.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">This injury can arise due to:<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Actions of a private individual, or<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Actions of the government or any public authority<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The injury may be:<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Actual, meaning it has already occurred, or<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Anticipatory, meaning it is likely to occur in the near future<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">However, the injury must be real, definite, and genuine, and not based on assumptions or imagination.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Courts do not allow cases where the person has not been truly affected in any meaningful way.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">In the case of <\/span><b>Shanti Kumar vs Home Insurance Co,<\/b><span style=\"font-weight: 400;\"> the court clearly stated that:<\/span>\n<ul>\n<li 400;\">Physical harm or damage<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Mental stress or emotional suffering<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Financial or economic loss<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: style=\"font-weight: 400;\">Traditionally, courts followed a strict rule, where only directly affected individuals could file a case.<\/span><\/li>\n<\/ul>\n<p><b>Causation (Cause and Effect Relationship)<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Another essential element is <\/span><b>causation,<\/b><span style=\"font-weight: 400;\"> which means there must be a <\/span><b>clear and direct connection<\/b><span style=\"font-weight: 400;\"> between the act of the defendant and the injury suffered.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">In simple terms, the person must be able to show that:<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">The harm they suffered is the result of the other party\u2019s action.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The court examines whether the injury can be directly traced back to the conduct of the defendant.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">This requirement ensures that:<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">The case is based on behind this condition is to avoid confusion and ensure that only the responsible party is brought before the court.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It also helps the court in delivering fair and accurate judgments, based on clear cause-and-effect relationships.<\/span><\/li>\n<\/ul>\n<h2><b>Landmark Judgement on Principle of Locus Standi<\/b><\/h2>\n<ul>\n<li><b>S.P. Gupta vs Union of India (1981)<\/b>\n<ul>\n<li><span style=\"font-weight: 400;\">The Supreme Court observed that many people in India are poor, exploited, and unaware of their legal rights.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Such people are often unable to approach courts for justice.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Therefore, the Court held that the rule of Locus Standi should be relaxed in such cases.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">It allowed any public-spirited person to file a petition on behalf of those whose rights are violated.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">The Court also stated that such petitions can be filed under: Article 32 (Supreme Court) and Article 226 (High Courts)<\/span><\/li>\n<li><span style=\"font-weight: 400;\">It further emphasized that the Constitution belongs to all citizens, so anyone can challenge laws that violate constitutional principles.<\/span><\/li>\n<\/ul>\n<\/li>\n<li><b>Akhil Bhartiya Soshit Karmachari Sangh vs Union of India (1980)<\/b>\n<ul>\n<li><span style=\"font-weight: 400;\">In this case, the <strong><a href=\"https:\/\/vajiramandravi.com\/upsc-exam\/supreme-court-of-india\/\" target=\"_blank\">Supreme Court<\/a><\/strong> allowed an unregistered association to file a writ petition.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">The Court held that even if an organization is not formally registered, it can still approach the court if the issue concerns public interest or common grievance.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">It recognized the importance of: <\/span><b>Public Interest Litigation (PIL), Class actions and Representative proceedings.<\/b><\/li>\n<li><span style=\"font-weight: 400;\">This decision made access to justice broader and more inclusive, especially for groups and communities.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h2><b>Principle of Locus Standi in Habeas Corpus<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Generally, Locus Standi means that only the affected person can approach the court.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">However, in cases of <\/span><b>Habeas Corpus, this rule is greatly relaxed or even not strictly applied.<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Habeas Corpus is a legal remedy used when a person is illegally detained or unlawfully kept in custody.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">In such situations, any person including a friend, relative, or even a stranger acting in good faith can file a petition on behalf of the detained person.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">This is because the detained person may be:<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Unable to approach the court<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Held in isolation (incommunicado)<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Physically or mentally incapable of seeking help<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The strict rule of Locus Standi is relaxed to ensure that no person is deprived of their liberty without legal remedy.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The main focus of the court in such cases is:<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">To check whether the detention is legal or illegal, and<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">To protect the <strong><a href=\"https:\/\/vajiramandravi.com\/upsc-exam\/fundamental-rights\/\" target=\"_blank\">fundamental right<\/a><\/strong> to personal liberty<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Even public-spirited individuals can file such petitions, especially in cases similar to Public Interest Litigation (PIL).<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">However, if the detained person is able to approach the court themselves, the court may prefer that they file the petition directly, though others can still act if needed.<\/span><\/li>\n<\/ul>\n<h2><b>Principle of Locus Standi <\/b><b>Exceptions<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Generally, the principle of Locus Standi allows only those persons to approach the court who are directly affected by a legal issue.
