Vande Mataram is a Punishable Offence"},"content":{"rendered":"<p><span style=\"font-weight: 400;\">The Union Cabinet has approved a proposal to amend the Prevention of Insults to National Honour Act, 1971 to make any obstruction to the singing of the national song Vande Mataram a punishable offence.<\/span><\/p>\n<h2><b>Prevention of Insults to National Honour Act, 1971<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The <\/span><a href=\"https:\/\/vajiramandravi.com\/current-affairs\/national-honour-act-1971\/\" target=\"_blank\"><b>Prevention of Insults to National Honour Act, 1971<\/b><\/a> <span style=\"font-weight: 400;\">was enacted to preserve the dignity and honour of <\/span><a href=\"https:\/\/vajiramandravi.com\/current-affairs\/national-symbols-of-india\/\" target=\"_blank\"><b>National symbols of India<\/b><\/a><span style=\"font-weight: 400;\"> and to prevent acts of deliberate disrespect towards them.\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">At present, the Act <\/span><b>provides legal protection against insults directed towards: the <\/b><a href=\"https:\/\/vajiramandravi.com\/current-affairs\/national-anthem-of-india\/\" target=\"_blank\"><b>National Anthem of India<\/b><\/a><b>, namely Jana Gana Mana, the <\/b><a href=\"https:\/\/vajiramandravi.com\/current-affairs\/national-flag-of-india\/\" target=\"_blank\"><b>National Flag of India<\/b><\/a><b>, and the <\/b><a href=\"https:\/\/vajiramandravi.com\/upsc-exam\/indian-constitution\/\" target=\"_blank\"><b>Constitution of India<\/b><\/a><b>.<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The law <\/span><b>criminalises acts such as burning, mutilating, defacing, defiling, disfiguring, trampling upon, or otherwise showing disrespect <\/b><span style=\"font-weight: 400;\">towards these national symbols.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Section 3 of the Prevention of Insults to National Honour Act, 1971<\/b><span style=\"font-weight: 400;\"> provides that any person who intentionally prevents the singing of the National Anthem or causes disturbance to any assembly engaged in such singing shall be punishable with <\/span><b>imprisonment extending up to three years, or with fine, or with both.<\/b><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">The <\/span><b>proposed amendment gives Vande Mataram the same statutory protection as the national anthem Jana Gana Mana.<\/b><span style=\"font-weight: 400;\"> The proposed amendment to the Act, after Parliament&#8217;s nod, <\/span><b>will impose punishment on causing any deliberate obstruction to the singing of Vande Mataram.<\/b><\/p>\n<h2><b>Ministry of Home Affairs Directives Regarding Vande Mataram<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">In February 2026, the <\/span><a href=\"https:\/\/vajiramandravi.com\/current-affairs\/mha-guidelines-on-vande-mataram\/\" target=\"_blank\"><b>Union Ministry of Home Affairs issued detailed guidelines concerning the singing and playing of Vande Mataram<\/b> <\/a><span style=\"font-weight: 400;\">at official functions and ceremonial occasions.<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Ministry directed that <\/span><b>all six stanzas of Vande Mataram, totalling 3 minutes 10 seconds, shall be sung at official functions <\/b><span style=\"font-weight: 400;\">such as the arrival of the President, the unfurling\u00a0 of the tricolour, and governors&#8217; speeches, and other important ceremonial events conducted by government authorities.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Ministry further directed that <\/span><b>whenever both the National Song and the National Anthem are performed at the same event, Vande Mataram shall be sung or played before Jana Gana Mana.\u00a0<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The advisory also instructed that members of the assembly present during the rendition of the National Song should <\/span><b>stand in attention as a mark of respect.<\/b><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Although these directives established ceremonial norms, they did not possess statutory force. <\/span><b>There was no penal consequence prescribed for failure to comply with the advisory.<\/b><span style=\"font-weight: 400;\"> The <\/span><b>proposed amendment to the 1971 Act is intended to provide legal backing to these expectations regarding respect for the National Song.<\/b><\/p>\n<h2><b>Supreme Court\u2019s Observations on the Issue<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">In March 2026, the <\/span><a href=\"https:\/\/vajiramandravi.com\/upsc-exam\/supreme-court-of-india\/\" target=\"_blank\"><b>Supreme Court of India<\/b><\/a><span style=\"font-weight: 400;\"> refused to entertain a petition challenging the Ministry of Home Affairs advisory on the singing of Vande Mataram at official events and educational institutions.<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A bench headed by Chief Justice Surya Kant observed that the guidelines were merely advisory in nature and imposed no penal consequences for non-compliance.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">However, the proposed amendment to the Prevention of Insults to National Honour Act, 1971 may change the legal position by making intentional obstruction or insult to the National Song a punishable offence.<\/span><\/p>\n<h2><b>Vaned Mataram Historical Background\u00a0<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Vaned Mataram was <\/span><b>composed by <\/b><a href=\"https:\/\/vajiramandravi.com\/current-affairs\/bankim-chandra-chattopadhyay\/\" target=\"_blank\"><b>Bankim Chandra Chattopadhyay<\/b><\/a><span style=\"font-weight: 400;\"> and was published in his celebrated Bengali novel<\/span><b> \u201cAnandamath\u201d<\/b> <b>during the early 1880s.<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The song portrays India as a mother figure and combines patriotic devotion with spiritual and cultural imagery.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">During the Indian freedom struggle, Vande Mataram became a major slogan of anti-colonial resistance and inspired freedom fighters, revolutionaries, and nationalist movements.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It played an important role during the <\/span><a href=\"https:\/\/vajiramandravi.com\/upsc-exam\/swadeshi-movement\/\" target=\"_blank\"><b>Swadeshi Movement<\/b><\/a><span style=\"font-weight: 400;\"> and became closely associated with the spirit of sacrifice and national unity.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">In <\/span><b>1937<\/b><span style=\"font-weight: 400;\">, the <\/span><b>Indian National Congress decided that only the first two stanzas of the song would be used<\/b><span style=\"font-weight: 400;\"> at official gatherings in order <\/span><b>to address concerns regarding religious imagery in later portions.<\/b><\/li>\n<li><b>On January 24, 1950<\/b><span style=\"font-weight: 400;\">, the <\/span><a href=\"https:\/\/vajiramandravi.com\/upsc-exam\/constituent-assembly-making-of-the-indian-constitution\/\" target=\"_blank\"><b>Constituent Assembly<\/b><\/a> <span style=\"font-weight: 400;\">recognised the historic contribution of Vande Mataram in India\u2019s freedom struggle and <\/span><b>accorded it the status of the National Song of India.<\/b><\/li>\n<li><span style=\"font-weight: 400;\">The Constituent Assembly also <\/span><b>declared that Vande Mataram would be honoured equally with Jana Gana Mana in terms of national respect and cultural
