


{"id":102589,"date":"2026-05-09T11:16:43","date_gmt":"2026-05-09T05:46:43","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=102589"},"modified":"2026-05-09T11:16:43","modified_gmt":"2026-05-09T05:46:43","slug":"ec-appointment-process-debate","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/ec-appointment-process-debate\/","title":{"rendered":"EC Appointment Process Debate"},"content":{"rendered":"<h2><b>EC Appointment Process Latest News<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Supreme Court of India has criticised Parliament\u2019s long delay in enacting a law governing appointments to the Election Commission of India, describing it as a \u201c<\/span><b>tyranny of the elected<\/b><span style=\"font-weight: 400;\">.\u201d\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The SC bench was hearing petitions challenging the Chief Election Commissioner and Other Election Commissioners Act, 2023.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The law replaced the Chief Justice of India with a Union Cabinet minister in the selection panel for appointing Election Commissioners.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The issue gained further attention when Leader of Opposition formally dissented during the appointment process of current Chief Election Commissioner Gyanesh Kumar, urging the government to wait for the Court\u2019s decision on the legality of the new system.<\/span><\/li>\n<\/ul>\n<h2><b>How Election Commissioners Are Appointed<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Article 324(2)<\/b><span style=\"font-weight: 400;\"> of the Constitution states that the appointment of Election Commissioners should be made according to a law enacted by Parliament.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Although the <\/span><b>Election Commission (Conditions of Service of Election Commissioners and Transaction of Business) Act, 1991<\/b><span style=\"font-weight: 400;\"> regulated salaries, tenure, and functioning of the Commission, it did not prescribe any appointment procedure.<\/span><\/li>\n<\/ul>\n<h3><b>Executive-Controlled Appointment Process<\/b><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">In the absence of a parliamentary law, appointments remained effectively under the control of the executive. Traditionally:<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">the Union Law Ministry prepared a panel of names,\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">the Prime Minister recommended candidates, and\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">the President formally made the appointments.\u00a0<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Most Election Commissioners were senior bureaucrats, and the senior-most Election Commissioner usually became the Chief Election Commissioner (CEC).<\/span><\/li>\n<\/ul>\n<h3><b>Challenge Before the Supreme Court<\/b><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">In <\/span><b><i>Anoop Baranwal v. Union of India (2022),<\/i><\/b><span style=\"font-weight: 400;\"> petitioners argued that the existing system gave excessive control to the government of the day, threatening the independence of the <strong><a href=\"https:\/\/vajiramandravi.com\/current-affairs\/election-commission-of-india-eci\/\" target=\"_blank\">Election Commission of India<\/a><\/strong>.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">During the hearings, former IAS officer Arun Goel was appointed as Election Commissioner in a process reportedly completed within a single day.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The apex court expressed surprise over the speed of the appointment and questioned Parliament\u2019s prolonged silence on establishing a transparent appointment mechanism.<\/span><\/li>\n<\/ul>\n<h2><b>Supreme Court\u2019s 2023 Anoop Baranwal Ruling<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">In this case, the Supreme Court of India established an <\/span><b>interim procedure<\/b><span style=\"font-weight: 400;\"> for appointing the Chief Election Commissioner (CEC) and Election Commissioners (ECs) until Parliament enacted a dedicated law.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Court directed that appointments should be made by the President on the advice of a three-member committee comprising:<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">the Prime Minister,\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">the Leader of Opposition in the Lok Sabha (or leader of the largest opposition party), and\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">the <strong><a href=\"https:\/\/vajiramandravi.com\/current-affairs\/chief-justice-of-india\/\" target=\"_blank\">Chief Justice of India (CJI)<\/a><\/strong>.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The judgment also broadened the understanding of voting rights, holding that the <\/span><b>right to vote flows from the Constitution<\/b><span style=\"font-weight: 400;\"> and that casting a vote forms part of freedom of expression under <strong><a href=\"https:\/\/vajiramandravi.com\/current-affairs\/article-19-of-indian-constitution\/\" target=\"_blank\">Article 19(1)(a).<\/a><\/strong><\/span><\/li>\n<\/ul>\n<h3><b>Ensuring Independence of the Election Commission<\/b><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The ruling emphasised that free and fair elections require an independent Election Commission of India insulated from executive influence.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Court referred to Constituent Assembly debates and Dr. B. R. Ambedkar\u2019s warning that election authorities should not come \u201cunder the thumb of the executive.\u201d<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Court described the Election Commission as a \u201cguardian of democracy\u201d and stressed that those supervising elections must function impartially, independently, and honestly.<\/span><\/li>\n<\/ul>\n<h3><b>Call for Institutional Reforms<\/b><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Supreme Court urged Parliament to strengthen the Election Commission institutionally and financially by:<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">creating an independent secretariat, and\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">charging its expenditure to the Consolidated Fund of India.\u00a0<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Court warned that financial dependence on the executive could indirectly compromise the Commission\u2019s independence.<\/span><\/li>\n<\/ul>\n<h2><b>What the 2023 Law on Election Commission Appointments Provides<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Following the Anoop Baranwal v. Union of India judgment, Parliament enacted the Chief Election Commissioner and Other Election Commissioners Act, 2023.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The law <\/span><b>replaced the Chief Justice of India <\/b><span style=\"font-weight: 400;\">in the selection committee with a Union Cabinet minister nominated by the Prime Minister.<\/span><\/li>\n<\/ul>\n<h3><b>Executive Dominance in the Panel<\/b><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Under the new arrangement, the three-member selection committee consists of:<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">the Prime Minister,\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">a Union Cabinet minister nominated by the PM, and\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">the Leader of Opposition.\u00a0<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">This effectively gives the executive representation in two out of three seats.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Further, under Section 7(2), the Act ensures that an appointment \u201cshall not be invalid merely by reason of any vacancy in or any defect in the constitution of the Selection Committee.\u201d<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Act creates a <\/span><b>two-stage appointment process<\/b><span style=\"font-weight: 400;\">:<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">a search committee headed by the Law Minister prepares a panel of names, and\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">the selection committee makes the final choice.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">However, the <\/span><span style=\"font-weight: 400;\">law allows the selection committee to choose \u201cany other person\u201d meeting eligibility conditions<\/span><span style=\"font-weight: 400;\">, even outside the search committee\u2019s shortlist.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Critics argue this grants broad discretion and reduces the significance of the formal search process.<\/span><\/li>\n<\/ul>\n<h3><b>Legal Challenge to the 2023 Law<\/b><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The law was challenged in 2024 by petitioners including Association for Democratic Reforms (ADR).\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The petitions argue that the law restores executive dominance over appointments
