Recently, the HC recorded Solicitor General Tushar Mehta&#8217;s assurance that due process of law will be followed for eviction.<\/span><\/li>\n<\/ul>\n<h2><b>History of the Delhi Gymkhana Club<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Delhi Gymkhana Club has a <\/span><b>colonial legacy<\/b><span style=\"font-weight: 400;\"> spanning over a century. It was founded in <\/span><b>July 1913<\/b><span style=\"font-weight: 400;\"> \u2014 shortly after the <\/span><span style=\"font-weight: 400;\">British Indian government decided to shift the capital from Kolkata to Delhi in 1911<\/span><span style=\"font-weight: 400;\">.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The land was leased by the government to the Imperial Delhi Gymkhana Club in February 1928 and the buildings were constructed in the 1930s.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The club was designed by <\/span><b>architect Robert T Russell<\/b><span style=\"font-weight: 400;\"> \u2014 who also designed Connaught Place and the Commander-in-Chief&#8217;s residence (later known as Teen Murti, the residence of PM Jawaharlal Nehru).<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Crucially, the <\/span><b>lease was perpetual<\/b><span style=\"font-weight: 400;\"> \u2014 meaning no fixed time frame was attached to it, though other conditions applied.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Originally meant exclusively for British officials, the club was renamed Delhi Gymkhana Club after Independence and became a gathering space for members of the Indian bureaucracy, judiciary, and armed forces.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It is located at 2, Safdarjung Road, New Delhi \u2014 immediately next to the Prime Minister&#8217;s residence on Lok Kalyan Marg.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Since 2022, the club has been run by a <\/span><b>government-appointed general committee<\/b><span style=\"font-weight: 400;\"> on the orders of the National Company Law Tribunal (NCLT).<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">This was after the Corporate Affairs Ministry approached the NCLT alleging the club was being run in violation of norms and mishandled.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">The club is a registered company under the Companies Act, 1956.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h2><b>How is Land Administered in Delhi<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">After 1947, the Union government administers land in Delhi through the <\/span><b>Land and Development Office<\/b><span style=\"font-weight: 400;\"> (L&amp;DO) \u2014 under the Ministry of Housing and Urban Affairs.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">L&amp;DO allots land for residential colonies, institutions, clubs, political parties, etc., and administers leases. Leases can be either:<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Fixed period leases \u2014 such as 99-year leases.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Perpetual leases \u2014 with no fixed end date but subject to conditions.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The lessee pays a fixed ground rent, which can be periodically revised as per lease conditions.<\/span><\/li>\n<\/ul>\n<h3><b>Leasehold vs Freehold<\/b><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Over the years, L&amp;DO has converted many residential properties from leasehold to freehold \u2014 granting owners full property rights.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">As per a CAG report (2021), out of approximately 60,000 properties on L&amp;DO land, around 35,000 had been converted from leasehold to freehold by 2021.<\/span><\/li>\n<\/ul>\n<h2><b>The Current Controversy \u2014 Eviction Notice<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The L&amp;DO&#8217;s letter cited <\/span><b>Clause 4<\/b><span style=\"font-weight: 400;\"> of the Lease Deed \u2014 which allows the government to &#8220;re-enter&#8221; the land for a &#8220;public purpose&#8221;.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The government stated that the 27.3-acre plot is critically required for &#8220;strengthening and securing Defence infrastructure and other vital public security purposes&#8221; \u2014 describing the location as a highly sensitive and strategic area of Delhi.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The L&amp;DO formally declared the lease determined (terminated) and ordered re-entry of the premises with immediate effect \u2014 through the authority of the President of India.<\/span><\/li>\n<\/ul>\n<h3><b>The Larger Plan<\/b><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Significantly, the club&#8217;s land is adjacent to the Prime Minister&#8217;s residence on Lok Kalyan Marg.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The L&amp;DO letter also refers to &#8220;resumption of adjoining government lands&#8221;
