The Bill sought to improve the functioning of Autonomous District Councils (ADCs) and provide greater financial and administrative autonomy to tribal institutions in Assam, Meghalaya, Tripura, and Mizoram.<\/span><\/p>\n<h2><b>The Constitution (125th Amendment) Bill, 2019 Features<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The Constitution (125th Amendment) Bill, 2019 was introduced to strengthen local self-governance, improve financial autonomy, and enhance democratic participation in the tribal areas covered under the Sixth Schedule of the Constitution.<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Establishment of Village and Municipal Councils:<\/b><span style=\"font-weight: 400;\"> Proposed the creation of Village Councils in rural areas and Municipal Councils in urban areas within Sixth Schedule regions.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Strengthening <\/b><a Constitution<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The <\/span><a href=\"https:\/\/vajiramandravi.com\/upsc-exam\/fifth-schedule\/\" target=\"_blank\"><b>Fifth Schedule of the Indian Constitution<\/b><\/a><span style=\"font-weight: 400;\"> contains special provisions for the administration and governance of Scheduled Areas and the welfare of Scheduled Tribes in states other than those covered under the Sixth Schedule.<\/span><\/p>\n<ul>\n<li aria-level=\"1\"><b>Constitutional Basis<\/b><\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">The Fifth Schedule is provided under <\/span><b>Article 244(1)<\/b><span style=\"font-weight: 400;\"> of the Constitution.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">It deals with the administration and control of Scheduled Areas and Scheduled Tribes in India.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Applicability<\/b>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Applies to Scheduled Areas in states other than Assam, Meghalaya, Tripura, and Mizoram, which are governed under the Sixth Schedule.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Covers tribal-dominated regions across several states such as Odisha, Jharkhand, Chhattisgarh, Madhya Pradesh, Maharashtra, Rajasthan, Andhra style=\"font-weight: 400;\">The President can increase, decrease, alter boundaries, or rescind the status of Scheduled Areas after consultation with the concerned <\/span><a href=\"https:\/\/vajiramandravi.com\/upsc-exam\/governor\/\" target=\"_blank\"><b>Governor<\/b><\/a><span style=\"font-weight: 400;\">.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Special Powers of the Governor<\/b>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">The Governor has significant powers regarding the administration of Scheduled Areas.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Can make regulations for peace and good governance in Scheduled Areas.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">May prohibit or restrict the transfer of tribal land to non-tribals.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Can regulate money-lending activities to protect tribal communities from exploitation.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Tribes Advisory Council (TAC)<\/b>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Each state having Scheduled Areas must establish a <\/span><a href=\"https:\/\/vajiramandravi.com\/current-affairs\/tribal-advisory-council-tac\/\" target=\"_blank\"><b>Tribes Advisory Council<\/b><\/a><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">The Council advises the Governor on matters related to the welfare and advancement of style=\"font-weight: 400;\">The Governor submits a report annually, or whenever required, to the President regarding the administration of Scheduled Areas.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">This enables the Union Government to monitor tribal welfare and governance.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Legislative Powers<\/b>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">The Governor may direct that a law passed by Parliament or the State Legislature shall not apply to a Scheduled Area.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">The Governor may also apply such laws with modifications or exceptions as deemed necessary.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Role of the Union Government<\/b>\n<ul>\n<li style=\"font-weight: style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">The Central Government plays an important role in protecting tribal interests and ensuring proper implementation of welfare measures.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h2><b>About Sixth Schedule of Indian Constitution<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The <\/span><a href=\"https:\/\/vajiramandravi.com\/upsc-exam\/sixth-schedule\/\" target=\"_blank\"><b>Sixth Schedule of the Indian Constitution<\/b><\/a><span style=\"font-weight: 400;\"> provides a special system of self-governance for tribal areas in certain northeastern states through Autonomous District Councils and Regional Councils, ensuring the protection of tribal culture, customs, and administrative autonomy.<\/span><\/p>\n<ul>\n<li aria-level=\"1\"><b>Constitutional Basis<\/b><\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Autonomous District Councils (ADCs)<\/b>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Each autonomous
