


{"id":10846,"date":"2023-05-14T07:07:29","date_gmt":"2023-05-14T01:37:29","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=10846"},"modified":"2025-03-29T23:01:44","modified_gmt":"2025-03-29T17:31:44","slug":"how-is-the-director-of-the-central-bureau-of-investigation-cbi-appointed","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/how-is-the-director-of-the-central-bureau-of-investigation-cbi-appointed\/","title":{"rendered":"How is the Director of the Central Bureau of Investigation (CBI) appointed?"},"content":{"rendered":"<h2><strong>Appointment of the CBI Director:<\/strong><\/h2>\n<ul>\n<li>The CBI director is appointed <strong>according to<\/strong> provisions under the <strong>Delhi Special Police Establishment Act (1946)<\/strong> <strong>and amendments<\/strong> therein brought <strong>by the Lokpal and Lokayuktas Act, 2013.<\/strong><\/li>\n<li>The appointment is <strong>made by the Centre on recommendation<\/strong> by a <strong>three-member Appointment Committee.<\/strong><\/li>\n<li>The appointment committee <strong>comprises the Prime Minister as the chairperson<\/strong>, the <strong>leader of the opposition (LoP) in the Lok Sabha<\/strong> and the <strong>Chief Justice of India, or a Supreme Court judge<\/strong> nominated by him.<\/li>\n<li><strong>If there is no recognised LoP<\/strong>, then <strong>the leader of the single largest party<\/strong> is included in the committee.<\/li>\n<li>The <strong>Central Vigilance Commission Act<\/strong> 2003 <strong>fixed the tenure<\/strong> of the CBI director <strong>at 2 years.<\/strong><\/li>\n<li><strong>Supreme Court Directions:<\/strong>\n<ul>\n<li>The apex court, in a 2019 order, mandated that <strong>no officer with less than six months&#8217; tenure remaining<\/strong> <strong>can be considered for the post of CBI chief<\/strong>.<\/li>\n<li>The court also ruled that the <strong>director is to remain in office for &#8216;not less than 2 years&#8217;<\/strong> and can be transferred only with the consent of the appointing committee.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h3>About Central Bureau of Investigation (CBI):<\/h3>\n<ul>\n<li>It is the <strong>premier investigative agency of India.<\/strong><\/li>\n<li>The agency was <strong>established in 1963<\/strong> by the Indian government as a result of the <strong>recommendation of the Santhanam Committee<\/strong>.<\/li>\n<li>CBI is <strong>not a statutory body<\/strong>.
