style=\"text-align: justify;\"><b>Religious Activities &#8211; Explicit Bar on Proselytisation<\/b><\/h2>\n<ul>\n<li><span style=\"font-weight: 400;\">One of the most significant amendments concerns activities.<\/span><\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><b>Expansion of \u201cKey Functionary\u201d Definition<\/b><\/h2>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The amended rules broaden the scope of key functionaries beyond office-bearers and directors to include:\u00a0<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Trustees, Partners, Members of governing bodies, Directors of companies,<\/span><\/li>\n<li style=\"font-weight: 400;\" 400;\">Any person exercising control or management over the organisation.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">This <\/span><b>widens accountability <\/b><span style=\"font-weight: 400;\">and scrutiny over individuals managing foreign-funded entities.<\/span><\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><b>Stricter Conditions<\/b><\/h2>\n<ul>\n<li><b>Restrictions on foreign nationals:<\/b>\n<ul>\n<li><span style=\"font-weight: 400;\">Associations having foreign nationals (other than Persons of Indian Origin) as key functionaries will ordinarily not be eligible for:<\/span>\n<ul>\n<li><span style=\"font-weight: 400;\">FCRA registration<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Prior permission for foreign contributions<\/span><\/li>\n<\/ul>\n<\/li>\n<li><span style=\"font-weight: 400;\">However, the Central Government may grant exemptions through specific instalments will be released only after &#8211;<\/span>\n<ul>\n<li><span style=\"font-weight: 400;\">75% of the previous instalment has been utilised, and<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Utilisation is verified through field inquiry.<\/span><\/li>\n<\/ul>\n<\/li>\n<li><b>Revised penalty framework: <\/b><span style=\"font-weight: 400;\">The Home Ministry has also strengthened compounding penalties for FCRA violations for &#8211;<\/span>\n<ul>\n<li><b>Administrative expenses: <\/b><span style=\"font-weight: 400;\">If administrative expenditure exceeds the prescribed 20% ceiling, penalty of \u20b91 lakh or 5% of the excess amount, whichever is higher, will be imposed.<\/span><\/li>\n<li><b>Speculative investments: <\/b><span style=\"font-weight: 400;\">For investing foreign contributions in speculative ventures:<\/span>\n<ul>\n<li><b>Penalty<\/b><span style=\"font-weight: 400;\">: \u20b91 lakh or 30% of the invested amount, whichever is higher.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Recovery of 100% of returns earned from such investments.<\/span><\/li>\n<\/ul>\n<\/li>\n<li><b>Diversion of funds:<\/b>\n<ul>\n<li><span style=\"font-weight: 400;\">For using foreign contributions for purposes other than approved objectives, penalty of \u20b91 lakh or 30% of the misused amount, whichever is higher.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Any violation under the revised framework attracts a minimum penalty of \u20b91
