It is also known as <\/span><b>claim preclusion.\u00a0<\/b><\/li>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">The principle of res judicata <\/span><b>applies when a litigant attempts to file a subsequent lawsuit on the same matter after having received a judgment<\/b><span style=\"font-weight: 400;\"> in a previous case involving the same parties.<\/span><\/li>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">It means that the<\/span><b> issue before the court has already been decided by another court,<\/b><span style=\"font-weight: 400;\"> between the same parties, and the <\/span><b>courts do not allow a petition to be filed<\/b><span style=\"font-weight: 400;\"> in the same court or in another court.\u00a0<\/span><\/li>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Therefore, the<\/span><b> court will dismiss the case<\/b><span style=\"font-weight: 400;\"> before it as being useless.<\/span><\/li>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Res Judicata as a concept is <\/span><b>applicable both in Civil as well as Criminal legal system.<\/b><\/li>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Res judicata under Indian law has been embodied under <\/span><b>Section 11 of the CPC (Code of Civil Procedure), 1908.\u00a0<\/b><\/li>\n<\/ul>\n<\/li>\n<li style=\"text-align: justify;\"><b>Constructive Res Judicata is an extension<\/b><span style=\"font-weight: 400;\"> of the principle of Res Judicata.\u00a0<\/span><\/li>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">It <\/span><b>applies to matters <\/b><span style=\"font-weight: 400;\">that <\/span><b>could have been raised in a previous suit but were not.\u00a0<\/b><\/li>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">This doctrine <\/span><b>prevents a party from bringing a second suit on issues arising from the same set of facts,<\/b> <b>provided the party had a fair opportunity to raise the new issue in the first suit.\u00a0<\/b><\/li>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">The principle finds its origin in Order II Rule 2 read with<\/span><b> Section 11 of the CPC, <\/b><span style=\"font-weight: 400;\">specifically <\/span><b>Explanation IV of Section 11.\u00a0<\/b><\/li>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Explanation IV provides that &#8220;any matter which might or ought to have been made ground of defence or attack in a former suit shall be deemed to have been a matter directly and substantially in issue in such suit&#8221;.\u00a0<\/span><\/li>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Certain <\/span><b>conditions must be met <\/b><span style=\"font-weight: 400;\">to invoke the principle of constructive res judicata:<\/span>\n<ul>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Firstly, the <\/span><b>parties <\/b><span style=\"font-weight: 400;\">involved in both proceedings <\/span><b>must be the same.\u00a0<\/b><\/li>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Secondly, the<\/span><b> subject matter<\/b><span style=\"font-weight: 400;\"> of the subsequent proceeding should be <\/span><b>identical to that of the earlier proceeding<\/b><span style=\"font-weight: 400;\">.\u00a0<\/span><\/li>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Thirdly, the <\/span><b>issue raised<\/b><span style=\"font-weight: 400;\"> in the subsequent proceeding should have been directly and <\/span><b>substantially in issue in the earlier proceeding.\u00a0<\/b><\/li>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Lastly, the <\/span><b>earlier proceeding<\/b><span style=\"font-weight: 400;\"> must have<\/span><b> resulted in a final decision<\/b><span style=\"font-weight: 400;\"> on the merits.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">This doctrine aims to promote judicial efficiency and fairness by <\/span><b>ensuring that all relevant issues are addressed at the appropriate time<\/b><span style=\"font-weight: 400;\">, thereby <\/span><b>avoiding repetitive litigation<\/b><span style=\"font-weight: 400;\"> over the same matters. <\/span><\/li>\n<\/ul>\n<p><b>News<\/b><strong>: <a href=\"https:\/\/www.livelaw.in\/know-the-law\/livelaw-explainer-key-principles-of-constructive-res-judicata-538379\" target=\"_blank\" rel=\"nofollow noopener\">LL<\/a><\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Doctrine of Constructive Res Judicata prevents a party from bringing a second suit on issues arising from the same set of facts, provided the party had a fair opportunity to raise the new issue in the first suit.
