In the absence of any such law, it <strong>continues to be governed by British Parliamentary conventions<\/strong>.<\/li>\n<\/ul>\n<\/li>\n<li><strong>What is breach of privilege?\u00a0<\/strong><\/li>\n<li>A breach of privilege is a <strong>violation of any of the privileges of MPs\/Parliament.<\/strong><\/li>\n<li>Among other things, <strong>any action &#8216;casting reflections&#8217; on MPs, parliament or its committees<\/strong>; could be considered breach of privilege.<\/li>\n<li>This may <strong>include publishing of news items, editorials or statements made in newspaper\/magazine\/TV interviews or in public speeches<\/strong>.\u00a0<\/li>\n<\/ul>\n<h3>About Committee of Privileges:<\/h3>\n<ul>\n<li>This committee <strong>consists of 15 members in Lok Sabha<\/strong> ( <strong>10 in case of Rajya Sabha<\/strong>) <strong>nominated by the Speaker<\/strong> (<strong>Chairman in case of Rajya Sabh<\/strong>a).<\/li>\n<li><strong>In the Rajya Sabha, the deputy chairperson heads <\/strong>the committee of privileges.<\/li>\n<li><strong>Powers and Functions:<\/strong>\n<ul>\n<li>The committee <strong>examines every question involving a breach of privilege of the House or of the members <\/strong>or of any Committee thereof <strong>referred to it by<\/strong> the House or by <strong>the Speaker\/Chairman<\/strong>.\u00a0<\/li>\n<li>It also <strong>determines with reference to the facts of each case whether a breach of privilege is involved<\/strong> and makes suitable recommendations in its report.<\/li>\n<li>It also <strong>states the procedure to be followed by the House<\/strong> in giving effect to its recommendations.<\/li>\n<li>When a question of privilege is referred to the Committee by the House, the <strong>report of the Committee is presented to the House by the Chairman<\/strong> or, in his absence, by any member of the Committee.<\/li>\n<li>Where a question of privilege is referred to the Committee by the Speaker, the <strong>report of the Committee is presented to the Speaker who may pass final orders <\/strong>thereon or direct that it be laid on the Table of the House.<\/li>\n<li>The <strong>Speaker\/Chairman may refer to the Committee any petition<\/strong> regarding the disqualification of a member o<strong>n the ground of defection for making a preliminary inquiry <\/strong>and submitting a report to him.<\/li>\n<li>The <strong>procedure to be followed by the Committee in these cases <\/strong>is so far as may be the <strong>same as in applicable to questions of breach of privilege.<\/strong><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<hr \/>\n<h3>Q1)\u00a0Are parliamentary privileges defined under the Indian Constitution?<\/h3>\n<p>According to the Constitution, the powers, privileges and immunities of Parliament and MP&#8217;s are to be defined by Parliament.\u00a0 No law has so far been enacted in this respect.
