


{"id":110518,"date":"2026-06-30T11:13:28","date_gmt":"2026-06-30T05:43:28","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=110518"},"modified":"2026-06-30T11:13:28","modified_gmt":"2026-06-30T05:43:28","slug":"strait-of-hormuz-navigation-fees","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/strait-of-hormuz-navigation-fees\/","title":{"rendered":"Strait of Hormuz Navigation Fees: Can Iran Legally Charge Ships Under International Law?"},"content":{"rendered":"<h2><b>Strait of Hormuz Navigation Fees Latest News<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Following a framework agreement between the US and Iran on June 15, 2026, the Strait of Hormuz was reopened to global shipping and the US blockade on Iranian ships lifted.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">After the US and Israel began hostilities against Iran on February 28, 2026, Iran had used the Strait as both a chokepoint and a bargaining chip, even collecting a toll per transit to offset war damages.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It has now dropped the toll but continues to levy a navigation fee and an environmental protection charge.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">This raises a core legal question: does Iran&#8217;s action pass the test of the &#8220;<\/span><b>right of transit passage<\/b><span style=\"font-weight: 400;\">&#8221; under the <\/span><b>1982 <\/b><span style=\"font-weight: 400;\">UN Convention on the Law of the Sea (UNCLOS) and customary international law?<\/span><\/li>\n<\/ul>\n<h2><b>Why the Strait Matters<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Strait of Hormuz is one of the world&#8217;s most critical maritime chokepoints \u2014 a narrow waterway through which a large share of global oil trade passes.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Its strategic value is exactly what gives a bordering state like Iran potential leverage, and exactly why international law tries to limit such leverage.<\/span><\/li>\n<\/ul>\n<h2><b>The Legal Principle: Freedom of Navigation<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The heart of the matter lies in <\/span><b><a href=\"https:\/\/vajiramandravi.com\/current-affairs\/united-nations-convention-on-the-law-of-the-sea\/\" target=\"_blank\">UNCLOS<\/a> Articles 37 to 44<\/b><span style=\"font-weight: 400;\">, which govern &#8220;Straits used for International Navigation.&#8221;\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">These provide that all ships and aircraft enjoy a <\/span><b>&#8220;right of transit passage&#8221;<\/b><span style=\"font-weight: 400;\"> \u2014 the freedom of continuous and swift navigation and overflight through international straits.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Two phrases are key:<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Transit passage <\/span><b>&#8220;shall not be impeded.&#8221;<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><b>&#8220;There shall be no suspension&#8221;<\/b><span style=\"font-weight: 400;\"> of transit passage.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The logic is that when a large portion of global trade depends on a narrow corridor, bordering states should not be able to <\/span><b>weaponise<\/b><span style=\"font-weight: 400;\"> it.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">This principle predates UNCLOS. In the <\/span><b>Corfu Channel case (UK v. Albania, 1949)<\/b><span style=\"font-weight: 400;\">, the International Court of Justice held that ships enjoy unrestricted passage through a strait used for international navigation during peacetime, so long as transit does not threaten the coastal state&#8217;s security.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">By this standard, Iran&#8217;s navigation and environmental charges look like an attempt to turn a natural strait into a <\/span><b>managed, revenue-generating entry point<\/b><span style=\"font-weight: 400;\"> \u2014 administered by Iran with Oman&#8217;s support.<\/span><\/li>\n<\/ul>\n<h2><b>International Law&#8217;s Silence: The Loopholes Iran Can Use<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Experts believe that the law is not as airtight as it appears, and Iran has several legal openings.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Territorial waters, not high seas<\/b><span style=\"font-weight: 400;\"> &#8211; The Strait lies within the combined territorial seas of Iran and Oman. Here, full high-seas freedom of navigation does not apply. Instead, ships enjoy the &#8220;right of innocent passage.&#8221;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>The &#8220;innocent passage&#8221; caveat<\/b><span style=\"font-weight: 400;\"> &#8211; Under Article 19 of UNCLOS, innocent passage is subject to the coastal state being satisfied that passage does not prejudice its peace, good order, or security. These grounds are broad enough that Iran could invoke them to deny passage during a tense standoff.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>The flawed canal analogy<\/b><span style=\"font-weight: 400;\">. Iran might point to the Suez and Panama canals, which charge transit fees. But this analogy might not help Iran: those are artificially engineered waterways built and maintained through sovereign territory and governed by specific treaty regimes \u2014 unlike Hormuz, a natural strait governed by UNCLOS.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The &#8220;<\/span><b>persistent objector<\/b><span style=\"font-weight: 400;\">&#8221; argument.\u00a0 Iran signed UNCLOS but never ratified it.<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">On signing, Iran declared it does not regard the transit-passage regime as customary international law \u2014 viewing it instead as a quid pro quo bargain only for treaty parties.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Under the &#8220;persistent objector&#8221; doctrine, a state is exempt from an emerging rule of customary international law if it has clearly, consistently and persistently objected to that rule while it was still forming.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Iran&#8217;s domestic law.<\/b><span style=\"font-weight: 400;\"> In 1993, Iran enacted the &#8220;Law of Marine Areas of the Islamic Republic of Iran in the Persian Gulf and Oman Sea,&#8221; which lets it suspend the passage of foreign ships and requires prior authorisation for warships and vessels carrying harmful substances (for environmental protection).\u00a0<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Since this latter category can include commercial oil tankers, the inclusion of a navigation and environmental fee in the agreement actually reinforces Iran&#8217;s persistent-objector position.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">This claim gains some acceptance under the <\/span><b><i>doctrine of comity of nations<\/i><\/b><span style=\"font-weight: 400;\"> \u2014 where states voluntarily recognise and respect each other&#8217;s laws and customs.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h2><b>The Bigger Picture: An Economic Weapon<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The distinctive feature of the conflict has been its rapid oscillation between <\/span><b>military confrontation and economic warfare<\/b><span style=\"font-weight: 400;\">, blurring the line between the two.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Though stretched militarily and economically, Iran demonstrated that it can impose global costs by making ordinary commerce uncertain.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The smoothness of transit through Hormuz depends partly on Israel&#8217;s military moves in Lebanon.
