{"id":11435,"date":"2023-05-25T11:18:55","date_gmt":"2023-05-25T05:48:55","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=11435"},"modified":"2025-03-30T02:35:13","modified_gmt":"2025-03-29T21:05:13","slug":"government-of-national-capital-territory-of-delhi-amendment-ordinance-2023","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/government-of-national-capital-territory-of-delhi-amendment-ordinance-2023\/","title":{"rendered":"Government of National Capital Territory of Delhi (Amendment) Ordinance, 2023"},"content":{"rendered":"<h2><strong>Why in News?<\/strong><\/h2>\n<ul>\n<li>The <strong>Supreme Court recently ruled that the Delhi Govt will have legislative<\/strong> and <strong>executive control over administrative services<\/strong> in the <strong>National Capital Territory of Delhi (NCTD)<\/strong> except with regard to public order, police and land.<\/li>\n<li>Now, the <strong>Centre has brought the ordinance which nullifies the SC order<\/strong>.<\/li>\n<\/ul>\n<h3>About Government of National Capital Territory of Delhi (Amendment) Ordinance, 2023:<\/h3>\n<ul>\n<li>The ordinance <strong>seeks to establish<\/strong> for the first time the <strong>National Capital Civil Service Authority (NCCSA).<\/strong><\/li>\n<li><strong>NCCSA Composition<\/strong>: It\u00a0 will be <strong>headed by the Chief Minister of Delhi<\/strong>, with the Chief Secretary and Principal Home Secretary of Delhi being the other two members.<\/li>\n<li><strong>Functions of NCCSA<\/strong>:\n<ul>\n<li>It will <strong>make recommendations to the Lieutenant Governor (LG)<\/strong> <strong>regarding transfer, posting, vigilance and other incidental matters<\/strong> <strong>of all Group \u2018A\u2019 officers<\/strong> and <strong>officers of DANICS<\/strong> serving in the Government of <strong>NCTD.<\/strong><\/li>\n<li>All matters required to be decided by the NCCSA shall be <strong>decided by majority of votes of the members<\/strong> present and voting.<\/li>\n<li>This means, that in effect, the <strong>decision of the elected chief minister<\/strong> of Delhi <strong>can be overruled by the two senior bureaucrats.<\/strong><\/li>\n<\/ul>\n<\/li>\n<li><strong>Role of\u00a0 LG:<\/strong>\n<ul>\n<li>The ordinance stated that the <strong>LG will pass orders to give effect to the recommendations passed by the NCCSA.<\/strong><\/li>\n<li>However, <strong>LG can ask for the relevant material with regard to officers<\/strong> belonging to All India Services and DANICS serving the Delhi government.<\/li>\n<li><strong>In case the LG differs with the recommendation<\/strong> made, <strong>he\/she may return the recommendation to the Authority for reconsideration<\/strong> by the Authority.
