


{"id":114450,"date":"2026-07-22T11:22:13","date_gmt":"2026-07-22T05:52:13","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=114450"},"modified":"2026-07-22T11:22:13","modified_gmt":"2026-07-22T05:52:13","slug":"vande-mataram-bill","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/vande-mataram-bill\/","title":{"rendered":"Vande Mataram Bill: Understanding the Proposal to Protect India&#8217;s National Song"},"content":{"rendered":"<h2><b>Vande Mataram Bill Latest News<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The <\/span><b>Prevention of Insults to National Honour (Amendment) Bill, 2026<\/b><span style=\"font-weight: 400;\">, is set to be introduced in the Rajya Sabha during the monsoon session.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Bill seeks to amend the Prevention of Insults to <\/span><b><i>National Honour Act, 1971<\/i><\/b><span style=\"font-weight: 400;\">, granting the national song, &#8216;Vande Mataram&#8217;, the same statutory protection currently reserved for the national anthem, &#8216;Jana Gana Mana&#8217;.<\/span><\/li>\n<\/ul>\n<h2><b>What Does the Bill Propose?<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Under Section 3 of the 1971 Act, <\/span><b>intentionally preventing<\/b><span style=\"font-weight: 400;\"> the singing of the national anthem, or <\/span><b>causing a disturbance<\/b><span style=\"font-weight: 400;\"> to any assembly engaged in such singing, is a <\/span><b>criminal offence<\/b><span style=\"font-weight: 400;\"> punishable with imprisonment of up to <\/span><b>three years<\/b><span style=\"font-weight: 400;\">, a fine, or both.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Bill proposes to bring the national song within the scope of this same provision, effectively criminalising disruption of its singing as well.<\/span><\/li>\n<\/ul>\n<h2><b>Current Legal Status of the National Song<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Earlier this year, the Union Ministry of Home Affairs issued guidelines on the singing and playing of the national song.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">These &#8220;orders relating to the National Song of India&#8221;:<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Specified the authorised lyrics, written by Bankim Chandra Chatterjee.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Identified occasions for mass singing, such as during the unfurling of the National Flag, cultural occasions, or ceremonial functions.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Stated that the audience must &#8220;<\/span><b>stand to attention<\/b><span style=\"font-weight: 400;\">&#8221; whenever the official version is sung or played.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Suggested that school days could begin with community singing of the national song.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h2><b>Supreme Court&#8217;s Response to the Guidelines<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Following the government&#8217;s order, a petition was filed challenging the directives, with the petitioner&#8217;s counsel questioning whether people could be &#8220;compelled to sing the song in the garb of an advisory.&#8221;\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A three-judge bench headed by the Chief Justice of India dismissed the plea as &#8220;premature&#8221; and based on a &#8220;vague apprehension of discrimination.&#8221;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Crucially, the Court noted at the time that the government&#8217;s directive was <\/span><b>advisory in nature<\/b><span style=\"font-weight: 400;\">, with <\/span><b>no penal consequences for non-compliance<\/b><span style=\"font-weight: 400;\">.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">If the new Bill is passed, however, it would introduce precisely the penal consequences that were absent when the Court made this observation.<\/span><\/li>\n<\/ul>\n<h2><b>How Courts Have Interpreted the Existing Anthem Law<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Since Section 3 of the 1971 Act currently applies only to the national anthem, past judicial interpretation offers a guide to how the amended law might work.<\/span><\/li>\n<\/ul>\n<h3><b>Salman v. State of Kerala (2014)<\/b><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Kerala High Court clarified what constitutes a &#8220;disturbance&#8221; under the Act.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It refused to quash an FIR against a petitioner accused of &#8220;making noise and hue and cry&#8221; during the singing of the national anthem.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It held that &#8220;causing obstruction or prevention&#8230; by making loud or contemptuous noise&#8221; falls within the offence defined under Section 3, warranting police investigation.<\/span><\/li>\n<\/ul>\n<h3><b>The Right to Respectful Silence: A Key Precedent<\/b><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A landmark distinction exists between <\/span><b>actively disrupting<\/b><span style=\"font-weight: 400;\"> the anthem&#8217;s singing (an offence) and <\/span><b>simply choosing not to sing<\/b><span style=\"font-weight: 400;\"> (not an offence), established in <\/span><b><i>Bijoe Emmanuel &amp; Ors v. State of Kerala (1986)<\/i><\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>The case:<\/b><span style=\"font-weight: 400;\"> Three children belonging to the <\/span><b>Jehovah&#8217;s Witnesses<\/b><span style=\"font-weight: 400;\"> Christian sect were expelled from school for refusing to sing the national anthem during morning assembly, despite standing respectfully in silence. Their refusal stemmed from religious belief that did not permit singing praises to anyone except in prayer to God.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>The ruling:<\/b><span style=\"font-weight: 400;\"> The Supreme Court ruled in favour of the students, holding that their expulsion violated:<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><b><a href=\"https:\/\/vajiramandravi.com\/current-affairs\/article-19-of-indian-constitution\/\" target=\"_blank\">Article 19<\/a>(1)(a):<\/b><span style=\"font-weight: 400;\"> Freedom of speech and expression<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><b>Article 25(1):<\/b><span style=\"font-weight: 400;\"> Freedom of religion<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Court held there is <\/span><b>no legal provision obliging anyone to sing the national anthem<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It stated: &#8220;Proper respect is shown to the National Anthem by standing up when the National Anthem is sung&#8230; It will not be right to say that disrespect is shown by not joining in the singing.&#8221;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The bench also emphasised the constitutional value of religious freedom.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It also noted that &#8220;the real test of a true democracy is the ability of even an insignificant minority to find its identity under the country&#8217;s Constitution,&#8221; and concluded with the observation: &#8220;<\/span><i><span style=\"font-weight: 400;\">Our tradition teaches tolerance; our philosophy preaches tolerance; our constitution practices tolerance; let us not dilute it.<\/span><\/i><span style=\"font-weight: 400;\">&#8220;<\/span><\/li>\n<\/ul>\n<h2><b>Conclusion<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The proposed amendment marks a significant step in elevating &#8216;Vande Mataram&#8217;
