


{"id":11712,"date":"2023-06-03T11:08:30","date_gmt":"2023-06-03T05:38:30","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=11712"},"modified":"2025-03-30T05:00:49","modified_gmt":"2025-03-29T23:30:49","slug":"what-is-sedition-law","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/what-is-sedition-law\/","title":{"rendered":"What is Sedition Law?"},"content":{"rendered":"<h2><strong>About Sedition Law:<\/strong><\/h2>\n<ul>\n<li><strong>Section 124A of the Indian Penal Code (IPC)<\/strong> deals with sedition.<\/li>\n<li><strong>History of Sedition Law:<\/strong>\n<ul>\n<li><strong>Section 124A<\/strong> was <strong>drafted by Thomas Babington Macaulay<\/strong> and included in the <strong>IPC in 1870.<\/strong><\/li>\n<li>The section was first included <strong>to address the growth of Wahabi activity<\/strong> between 1863 and 1870. The <strong>colonial authorities faced a difficulty<\/strong> as a result of these actions.<\/li>\n<li><strong>Indian nationalist leaders were involved in some of the most well-known sedition cases <\/strong>of the late 19th and early 20th centuries.<\/li>\n<li>The <strong>earliest of these was Jogendra Chandra Bose&#8217;s trial in 1891<\/strong>. He served as the newspaper Bangobasi&#8217;s editor. <strong>He published a piece denouncing the Age of Consent Bill <\/strong>for endangering the faith and its coercive treatment of Native Americans.<\/li>\n<li><strong>In 1897, Bal Gangadhar Tilak&#8217;s articles in Kesari were the subject of legal action<\/strong>.<\/li>\n<li>The <strong>other well-known case included Mahatma Gandhi&#8217;s 1922 sedition trial<\/strong>. Sedition, according to Gandhi, is &#8220;the prince among the political sections of the IPC meant to destroy the freedom of the citizen.&#8221;<\/li>\n<li><strong>Post-Independence:<\/strong>\n<ul>\n<li><strong>After independence, the term \u201csedition\u201d was removed from the Constitution in 1948<\/strong>, after debate in the Constituent Assembly.\u00a0<\/li>\n<li><strong>Jawaharlal Nehru proposed the first amendment to the Constitution in 1951, which limited freedom under Article 19 (1)<\/strong> (a) and gave the state the authority to impose \u201creasonable restrictions\u201d on the right to free expression.<\/li>\n<li><strong>Indira Gandhi\u2019s government made section 124A a criminal offense for the first time in Indian history.<\/strong> The new Code of Criminal Procedure, 1973, which came into effect in 1974 and repealed the 1898 Colonial-Era Code of Criminal Procedure, <strong>made sedition a knowable crime.<\/strong><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<li><strong>What does Section 124 A states?<\/strong>\n<ul>\n<li><strong>It states, &#8220;Whoever, words, either spoken or written, or by signs, or by visible representation, or otherwise, brings or attempts<\/strong> t<strong>o bring into hatred or contempt<\/strong> , or excites or attempts to excite disaffection towards the Government established by law in India s<strong>hall be punished with imprisonment for life, to which fine may be added, , or with imprisonment<\/strong> which may extend to three years, which fine may be added, or with fine.&#8221;<\/li>\n<li>In simple words, this means <strong>anyone who attempts to create hatred, contempt, or disaffection towards the government can be punished<\/strong> under the sedition law.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Punishment<\/strong>:\n<ul>\n<li>Sedition is a <strong>non-bailable offence<\/strong>.<\/li>\n<li>Punishment under the law <strong>varies from imprisonment up to three years to a life term and fine.<\/strong><\/li>\n<li>A person <strong>charged under this law can&#8217;t apply for a government job<\/strong>.
