The guidelines prohibit new projects within 1 km of the border and require security clearances for projects proposed up to 50 km from sensitive borders.<\/span><\/p>\n<h2><b>MHA Guidelines for Renewable Energy Projects Near Borders Background<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The Ministry of New and Renewable Energy (MNRE) had received increasing queries about setting up renewable energy projects near border areas because of their possible national security implications. The MHA framed the guidelines after consultations with stakeholders to create a uniform and transparent approval process while also maintaining ease of doing business.<\/span><\/p>\n<h2><b>Key Guidelines for Renewable Energy Projects Near Borders<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The MHA guidelines for renewable energy projects near border areas divide border areas into different security zones and prescribe specific restrictions, clearances and security requirements according to the distance from the border.<\/span><\/p>\n<h3><b>Zonal Restrictions<\/b><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Within 1 km<\/b><span style=\"font-weight: 400;\">: Areas along the <a href=\"https:\/\/vajiramandravi.com\/current-affairs\/line-of-control-loc\/\" target=\"_blank\"><strong>Line of Control<\/strong><\/a> (LoC), Line of Actual Control (LAC) and International Border are treated as restricted areas, where no new project activity is permitted.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>1-50 km<\/b><span style=\"font-weight: 400;\">: Solar, wind and hybrid projects require security clearance from the MHA, which will assess proposals on a case-by-case basis.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>1-20 km<\/b><span style=\"font-weight: 400;\">: Projects also require a No Objection Certificate (NOC) from the Ministry of Defence (MoD).<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Clearance timeline<\/b><span style=\"font-weight: 400;\">: The MHA will endeavour to decide proposals within 60 days.<\/span><\/li>\n<\/ul>\n<h3><b>Application Process<\/b><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Developers cannot apply directly to the <\/span><b>Ministry of Home Affairs (MHA)<\/b><span style=\"font-weight: 400;\"> or <\/span><b>Ministry of Defence (MoD)<\/b><span style=\"font-weight: 400;\"> for clearance.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Applications must be submitted to the <\/span><b>Ministry of New and Renewable Energy (MNRE)<\/b><span style=\"font-weight: 400;\"> after obtaining in-principle approval for land allotment from the State government.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The <\/span><b>MNRE<\/b><span style=\"font-weight: 400;\"> will forward the proposal to the <\/span><b>MHA<\/b><span style=\"font-weight: 400;\"> for security clearance and the <\/span><b>MoD<\/b><span style=\"font-weight: 400;\"> for a <\/span><b>No Objection Certificate (NOC)<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The <\/span><b>MNRE<\/b><span style=\"font-weight: 400;\"> will convey the final decision to the developer after receiving the required clearances.<\/span><\/li>\n<\/ul>\n<h3><b>Foreign Participation<\/b><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Engineers, employees, staff and labour from Pakistan, Bangladesh and China cannot be engaged for project implementation without MHA permission.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Project developers cannot transfer project land to a foreign company without prior approval of the Central government and security clearance from the MHA.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Where foreign investment is involved, a separate application is required under the <a href=\"https:\/\/vajiramandravi.com\/upsc-exam\/foreign-direct-investment-fdi\/\" target=\"_blank\"><strong>Foreign Direct Investment<\/strong><\/a> (FDI) Policy through the Department for Promotion of Industry and Internal Trade (DPIIT).<\/span><\/li>\n<\/ul>\n<h3><b>Security Requirements<\/b><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Developers must install comprehensive security infrastructure, including anti-drone systems, at their own cost.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">These systems may be operated by the Central Industrial Security Force (CISF) or State police.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Employees and construction workers must undergo prior verification before entering project areas.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Foreign nationals entering project sites must be monitored.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Project staff must follow instructions issued by the local police and the <a href=\"https:\/\/vajiramandravi.com\/upsc-exam\/border-security-force-bsf-is-responsible-for-guarding-on-borders-of-which-countries\/\" target=\"_blank\"><strong>Border Security Force<\/strong><\/a> (BSF).<\/span><\/li>\n<\/ul>\n<h3><b>Project Design and Roads<\/b><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Project layouts should avoid long stretches of construction running parallel to the international border.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Roads within projects should be sufficiently wide and designed so that they can be used by armed forces and border security personnel during emergencies.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Projects should also have a dedicated police post for monitoring construction activities.<\/span><\/li>\n<\/ul>\n<h3><b>Accommodation and Height Restrictions<\/b><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Hotels, housing and other facilities likely to attract large crowds are discouraged in sensitive areas.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Accommodation and hotels must be located at least 5 km from the border, while cafeterias should remain within the plant premises.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Height limits apply to administrative buildings, control rooms, staff housing and other civil infrastructure, but not to core infrastructure such as wind turbines.<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">1-8 km: Maximum height of 3 metres.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">8-20 km: Maximum height of 5 metres.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">20-50 km: Maximum height of 15 metres.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h3><b>Existing Projects<\/b><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Projects that had already received MHA security clearance before the guidelines were issued do not need to apply again.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Similarly, projects that had already obtained an MoD NOC are not
