The direction came in <\/span><b>Anurag Srivastava v. Union of India &amp; Ors.<\/b><span style=\"font-weight: 400;\">, a Public Interest Litigation seeking nationwide mandatory reporting of cancer cases.<\/span><\/p>\n<h2><b>Background<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The <\/span><a href=\"https:\/\/vajiramandravi.com\/upsc-exam\/public-interest-litigation\/\" target=\"_blank\"><span style=\"font-weight: 400;\"><strong>Public Interest Litigation<\/strong><\/span><\/a><span style=\"font-weight: 400;\"> (PIL) was filed by Dr. Anurag Srivastava, seeking directions to the Union Ministry of Health and Family Welfare and the States\/UTs to ensure uniform and mandatory reporting of cancer cases.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The petitioner invoked <\/span><a href=\"https:\/\/vajiramandravi.com\/current-affairs\/article-14-of-indian-constitution\/\" target=\"_blank\"><b>Articles 14<\/b><\/a><b> and <\/b><a href=\"https:\/\/vajiramandravi.com\/current-affairs\/article-21-of-indian-constitution\/\" target=\"_blank\"><b>Article 21<\/b><\/a><span style=\"font-weight: 400;\">, arguing that continued non-notification could result in unequal treatment of similarly situated citizens and <\/span><b>undermine the right to health and a life with dignity.<\/b><\/p>\n<h2><b>Key Highlights of the Supreme Court\u2019s Direction<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">During the proceedings, the Court was informed that <\/span><b>17 of the 36 States and UTs had already notified cancer as a notifiable disease<\/b><span style=\"font-weight: 400;\">, following recommendations of a Parliamentary Standing Committee.\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Court therefore<\/span><b> directed the remaining 19 States and UTs to consider the Committee\u2019s recommendations and take appropriate decisions.<\/b>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">The concerned States and UTs were also <\/span><b>directed to file compliance affidavits on the steps taken.<\/b><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Bench also <\/span><b>questioned the Centre on why mandatory guidelines could not be issued for all States and UTs<\/b><span style=\"font-weight: 400;\">, emphasising the need for a uniform policy.\u00a0<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">The Centre responded that <\/span><b>health is a State subject<\/b><span style=\"font-weight: 400;\">, <\/span><span style=\"font-weight: 400;\">highlighting the need for <\/span><b>Centre-State coordination<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h2><b>What Does Declaring Cancer a \u2018Notifiable Disease\u2019 Mean?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">A<\/span><b> notifiable disease<\/b><span style=\"font-weight: 400;\"> is a disease whose diagnosed cases must be reported by doctors, hospitals or laboratories to designated public-health authorities.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The purpose of declaring a disease notifiable is to create a legally required reporting system so that health authorities receive timely and systematic information about diagnosed cases. This helps to:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Monitor the disease burden and trends across regions and populations.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Detect emerging patterns or outbreaks early, where relevant.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Plan healthcare resources such as personnel, medicines and facilities.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Design and target public-health interventions based on reliable data.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Evaluate the effectiveness of health programmes and policies.\u00a0<\/span><\/li>\n<\/ul>\n<p><b><i>For cancer, notification is primarily aimed at systematic surveillance, reliable data collection, early detection and evidence-based cancer-control planning.<\/i><\/b><\/p>\n<h2><b>Notifiable Diseases in India<\/b><\/h2>\n<p><b>India does not have a single uniform national list of notifiable diseases<\/b><span style=\"font-weight: 400;\">. Since public health is primarily a State subject, notification requirements can vary across States and UTs.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The <\/span><a href=\"https:\/\/vajiramandravi.com\/current-affairs\/epidemic-diseases-act\/\" target=\"_blank\"><b>Epidemic Diseases Act, 1897<\/b><\/a><span style=\"font-weight: 400;\"> provides a broad legal framework for dealing with epidemic diseases, while the <\/span><b>Integrated Disease Surveillance Programme (IDSP)<\/b><span style=\"font-weight: 400;\"> supports national surveillance of epidemic-prone diseases.<\/span><\/p>\n<p><b>Commonly notified diseases include<\/b> <strong><a href=\"https:\/\/vajiramandravi.com\/current-affairs\/tuberculosis-tb\/\" target=\"_blank\">tuberculosis<\/a><\/strong><span style=\"font-weight: 400;\">, cholera, malaria, dengue, measles, diphtheria, polio, rabies, typhoid and Japanese encephalitis.<\/span><\/p>\n<h2><b>Cancer Notification and the Existing Registry System<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">India already has the <\/span><b>National Cancer Registry Programme (NCRP) <\/b><span style=\"font-weight: 400;\">under the Indian Council of Medical Research (ICMR), which collects cancer data through Population-Based Cancer Registries (PBCRs) and Hospital-Based Cancer Registries (HBCRs).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Mandatory notification could complement the NCRP by improving the coverage, timeliness and consistency of cancer data.
