justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Permanent Court of Arbitration (<\/span><b>PCA<\/b><span style=\"font-weight: 400;\">), The Hague, has ruled that the 1960 Indus Waters Treaty (IWT) between India and Pakistan <\/span><b>remains <\/b><span style=\"font-weight: 400;\">\u201c<\/span><b>fully in force<\/b><span style=\"font-weight: 400;\">\u201d and that India must continue observing its obligations under the treaty.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">India, however, has categorically <\/span><b>rejected the ruling<\/b><span style=\"font-weight: 400;\">, maintaining that the Court of Arbitration itself was constituted in violation of the IWT and therefore has no jurisdiction over India.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The dispute marks <\/span><b>a significant escalation<\/b><span style=\"font-weight: 400;\"> in the long-standing India\u2013Pakistan contest over transboundary water governance, hydroelectric projects and the interpretation of the IWT.<\/span><\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><b>Indus Waters Treaty &#8211; A Brief Framework<\/b><\/h2>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The IWT, brokered by the <\/span><b><a href=\"https:\/\/vajiramandravi.com\/current-affairs\/world-bank\/\" target=\"_blank\">World Bank<\/a> in 1960<\/b><span style=\"font-weight: 400;\">, allocates the six Indus-system rivers between the two countries:<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><b>Eastern rivers <\/b><span style=\"font-weight: 400;\">\u2014 Ravi, Beas and Sutlej: primarily allocated to India.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><b>Western rivers <\/b><span style=\"font-weight: 400;\">\u2014 Indus, Jhelum and Chenab: primarily allocated to Pakistan, while India retains specified rights for domestic use, irrigation and run-of-the-river hydropower projects.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The treaty also establishes mechanisms for resolving disputes, including a Permanent Indus Commission, Neutral Expert and Court of Arbitration, depending upon the nature of the dispute.<\/span><\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><b>What Has the Hague Court Ruled?<\/b><\/h2>\n<ul>\n<li><span style=\"font-weight: 400;\">The Court issued <\/span><b>two decisions<\/b><span style=\"font-weight: 400;\"> on August 31, 2026.<\/span><\/li>\n<li aria-level=\"1\"><b>Status of the Treaty:<\/b>\n<ul>\n<li><span style=\"font-weight: 400;\">India announced on April 23, 2025, following the <\/span><a href=\"https:\/\/vajiramandravi.com\/upsc-exam\/pahalgam-terror-attack-2025\/\" target=\"_blank\"><b>Pahalgam terror attack<\/b><\/a><span style=\"font-weight: 400;\"><a href=\"https:\/\/vajiramandravi.com\/upsc-exam\/pahalgam-terror-attack-2025\/\" target=\"_blank\">,<\/a> that the IWT would remain in \u201cabeyance\u201d until Pakistan \u201ccredibly and irrevocably\u201d ended its support for cross-border terrorism.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">The Court held that &#8211;<\/span>\n<ul>\n<li><span style=\"font-weight: 400;\">The IWT does not provide for unilateral suspension or termination by either party.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">\u201cAbeyance\u201d cannot be used to suspend the treaty&#8217;s operation.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">The treaty remains binding unless India and Pakistan jointly modify or terminate it through a subsequent treaty.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">India&#8217;s cited grounds\u2014including terrorism, sovereignty, material breach, demographic and technological changes, climate change and armed conflict\u2014<\/span><b>did not legally justify<\/b><span style=\"font-weight: 400;\"> suspension or termination.<\/span><\/li>\n<\/ul>\n<\/li>\n<li><span style=\"font-weight: 400;\">Consequently, the Court held that India remains bound by treaty obligations concerning its hydroelectric projects on the Western Rivers and the treaty&#8217;s dispute-settlement mechanisms.<\/span><\/li>\n<\/ul>\n<\/li>\n<li aria-level=\"1\"><b>Ratle Hydroelectric Project:<\/b><\/li>\n<\/ul>\n<ul style=\"text-align: justify;\">\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">The Court also imposed interim measures concerning the Ratle Hydro-Electric Plant (<\/span><b>RHEP<\/b><span style=\"font-weight: 400;\">) on the Chenab.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">India has been directed to temporarily refrain from concreting the dam wall and power-intake structure above specified levels and to report changes to the construction schedule.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">These restrictions are to continue until 90 days after the Neutral Expert&#8217;s final decision, expected around July 2027.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><b>Why Does India Reject the Court?<\/b><\/h2>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">India has <\/span><b>never participated<\/b><span style=\"font-weight: 400;\"> in the Court of Arbitration proceedings and disputes its very constitution.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">New Delhi argues that &#8211;<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">The Court was established by the World Bank in breach of the IWT.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Pakistan&#8217;s invocation of the Court created<\/span><b> parallel proceedings <\/b><span style=\"font-weight: 400;\">on issues that were already before the Neutral Expert.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">The treaty does not permit simultaneous dispute-resolution mechanisms for the same questions.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">The Court therefore <\/span><b>lacks jurisdiction<\/b><span style=\"font-weight: 400;\"> to rule upon India&#8217;s sovereign decisions.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">India has consequently described the Court&#8217;s pronouncements as \u201cnull and void\u201d and reiterated that its decision to keep the IWT in abeyance remains operative.<\/span><\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><b>The Ratle-Kishenganga Dispute<\/b><\/h2>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Pakistan has challenged<\/b><span style=\"font-weight: 400;\"> design features of India&#8217;s Ratle and Kishenganga hydroelectric projects, arguing that they violate the IWT&#8217;s restrictions on India&#8217;s use of the Western Rivers.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">These disputes involve highly technical issues such as reservoir storage\/pondage, dam design and operational parameters.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A Neutral Expert, appointed through the World Bank mechanism at India&#8217;s request, was separately examining technical questions.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">India argues that this mechanism is the treaty-consistent route, whereas the Court of Arbitration represents an impermissible parallel process.<\/span><\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><b>Strategic and Geopolitical Significance<\/b><\/h2>\n<ul>\n<li><b>Water as a strategic instrument:<\/b>\n<ul>\n<li><span style=\"font-weight: 400;\">Pakistan is <\/span><b>heavily dependent <\/b><span style=\"font-weight: 400;\">on the Indus river system; the rivers covered by the treaty support a substantial share of its agriculture and water security.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Consequently, any alteration in India&#8217;s approach to the treaty has significant implications for Pakistan&#8217;s food security, irrigation and economy.<\/span><\/li>\n<\/ul>\n<\/li>\n<li><b>India&#8217;s security argument:<\/b>\n<ul>\n<li><span style=\"font-weight: 400;\">India&#8217;s position reflects the linkage it has drawn between cross-border terrorism and bilateral agreements, particularly after the Pahalgam attack.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\">New Delhi has repeatedly argued that \u201c<\/span><b>blood and water cannot flow together<\/b><span style=\"font-weight: 400;\">\u201d and has maintained that the treaty requires reconsideration because circumstances have changed substantially since the 1950s.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><b>International Legal Challenge<\/b><\/h2>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The episode highlights a larger question of treaty law versus unilateral sovereign action.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">While the PCA has interpreted the IWT according to its legal provisions, India disputes the tribunal&#8217;s jurisdiction itself.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Thus, the immediate issue is <\/span><b>not merely water allocation<\/b><span style=\"font-weight: 400;\"> but also the legitimacy and applicability of the dispute-settlement mechanism.<\/span><\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><b>What Lies Ahead?<\/b><\/h2>\n<ul>\n<li><span style=\"font-weight: 400;\">The ruling is unlikely to immediately resolve the dispute because India does not recognise the tribunal&#8217;s jurisdiction.\u00a0<\/span>\n<ul>\n<li><span style=\"font-weight: 400;\">The central contest is therefore likely to continue through &#8211;<\/span><\/li>\n<li><span style=\"font-weight: 400;\">India&#8217;s continued implementation of its \u201cabeyance\u201d position;<\/span><\/li>\n<\/ul>\n<\/li>\n<li aria-level=\"2\"><b>Pakistan&#8217;s efforts to internationalise the issue;<\/b><\/li>\n<\/ul>\n<ul style=\"text-align: justify;\">\n<li style=\"list-style-type: none;\">\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Parallel proceedings involving the Neutral Expert;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Disputes over Indian hydroelectric projects on the Western
