On 5 September 2026, 128 High Contracting Parties to the <\/span><b>Convention on Certain Conventional Weapons (CCW)<\/b><span style=\"font-weight: 400;\"> agreed in Geneva on a non-binding text on LAWS, marking an important step towards developing common international rules. However, countries remain divided over the extent of human control required and whether a legally binding treaty is necessary.<\/span><\/p>\n<h2><b>What are Lethal Autonomous Weapons Systems (LAWS)?<\/b><\/h2>\n<p><b>Lethal Autonomous Weapons Systems (LAWS)<\/b><span style=\"font-weight: 400;\"> are weapons that can <\/span><b>identify, select and attack targets on their own, without requiring a human to approve every individual attack. <\/b><span style=\"font-weight: 400;\">They use technologies such as AI, sensors, robotics and real-time data processing to make or assist targeting decisions. They are also commonly referred to as <\/span><b>autonomous weapons systems (AWS)<\/b><span style=\"font-weight: 400;\"> or <\/span><b>killer robots<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<h2><b>Why are Lethal Autonomous Weapons Systems (LAWS) a Concern?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The concern with Lethal Autonomous Weapons Systems (LAWS) arises because weapons that can independently identify and attack targets may make it harder to ensure human judgement and compliance with the rules of war.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Under <\/span><b>International Humanitarian Law (IHL),<\/b><span style=\"font-weight: 400;\"> the use of weapons during armed conflict must protect civilians and limit unnecessary harm. In particular:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Distinction: <\/b><span style=\"font-weight: 400;\">Weapons must distinguish between civilians and combatants and target only legitimate military objectives.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Proportionality: <\/b><span style=\"font-weight: 400;\">Civilian harm must not be excessive in relation to the expected military advantage.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Precaution: <\/b><span style=\"font-weight: 400;\">Parties must take reasonable steps to minimise civilian harm during an attack.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">The difficulty with Lethal Autonomous Weapons Systems (LAWS) is that applying these principles often requires context-specific human judgement. Battlefield conditions can change rapidly, making it difficult for an autonomous system to correctly identify a target or assess the likely civilian consequences of an attack. This creates wider concerns:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Human control: <\/b><span style=\"font-weight: 400;\">Excessive autonomy could reduce meaningful human control over decisions involving lethal force.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Accountability: <\/b><span style=\"font-weight: 400;\">When Lethal Autonomous Weapons Systems (LAWS) cause unlawful harm, determining responsibility among States, commanders and operators can become difficult.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Unpredictability:<\/b><span style=\"font-weight: 400;\"> Errors in algorithms, sensors or data, as well as changing battlefield conditions, may lead to unintended attacks.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Escalation: <\/b><span style=\"font-weight: 400;\">The speed of autonomous systems could accelerate military responses and increase the risk of unintended escalation.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Thus, the central concern surrounding Lethal Autonomous Weapons Systems (LAWS) is whether they can operate with sufficient human control, reliability and predictability to comply with IHL.<\/span><\/p>\n<h2><b>International Efforts to Regulate Lethal Autonomous Weapons Systems\u00a0<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">International efforts to regulate Lethal Autonomous Weapons Systems (LAWS) have mainly taken place under the<\/span><b> Convention on Certain Conventional Weapons (CCW)<\/b><span style=\"font-weight: 400;\">, where countries are examining how emerging autonomous weapons can be governed while ensuring compliance with International Humanitarian Law.<\/span><\/p>\n<h3><b>Convention on Certain Conventional Weapons (CCW)<\/b><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Convention on Certain Conventional Weapons (CCW) was adopted in 1980 and came into force in 1983.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It aims to prohibit or restrict certain conventional weapons that cause unnecessary suffering or harm civilians indiscriminately.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The CCW has a framework-plus-protocols structure. This means that the main convention provides the broad framework, while separate protocols deal with particular types of weapons.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">The issue of Lethal Autonomous Weapons Systems (LAWS) is being discussed through the <\/span><b>Group of Governmental Experts (GGE) on LAWS<\/b><span style=\"font-weight: 400;\">. The GGE brings countries together to examine the legal, military, technological and ethical issues raised by autonomous weapons.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In 2026, the GGE met twice\u00a0 from 2-6 March and 31 August-4 September. Its work was then taken forward for consideration at the Seventh CCW Review Conference in November 2026.<\/span><\/p>\n<h4><b>2026 Geneva Consensus<\/b><\/h4>\n<p><span style=\"font-weight: 400;\">The discussions produced an important development on 5 September 2026, when 128 High Contracting Parties agreed in Geneva on a common descriptive framework for LAWS.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In simple terms, countries were able to agree on a common way of describing and discussing LAWS. This is significant because countries have been negotiating the issue for several years.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">However, the agreement does not mean that countries have agreed on how LAWS should ultimately be regulated.<\/span><\/p>\n<p><b>Important questions remain unresolved, including:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Should some types of LAWS be completely prohibited?<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">How much human control should be required over lethal decisions?<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Should countries negotiate a legally binding treaty?<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">What restrictions should apply to the use of autonomous weapons?<\/span><\/li>\n<\/ul>\n<p><b>The 2026 text is non-binding. <\/b><span style=\"font-weight: 400;\">The next major decision will therefore come at the CCW Review Conference in November 2026, where countries will consider whether and how to move towards further negotiations.<\/span><\/p>\n<h2><b>India\u2019s Position on Lethal Autonomous Weapons Systems (LAWS)<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">India supports a balanced approach to Lethal Autonomous Weapons Systems (LAWS), focusing on International Humanitarian Law while avoiding unnecessary restrictions on emerging technologies.<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Prohibition:<\/b><span style=\"font-weight: 400;\"> Ban autonomous weapons that cannot comply with International Humanitarian Law.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Regulation:<\/b><span style=\"font-weight: 400;\"> Regulate other autonomous weapons to ensure compliance with International Humanitarian Law.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Human control:<\/b><span style=\"font-weight: 400;\"> Ensure human judgement over lethal decisions.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Accountability:<\/b><span style=\"font-weight: 400;\"> Keep responsibility with humans, not machines.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Dual-use technology:<\/b><span style=\"font-weight: 400;\"> Avoid restricting peaceful uses of <a href=\"https:\/\/vajiramandravi.com\/upsc-exam\/artificial-intelligence\/\" target=\"_blank\"><strong>Artificial Intelligence<\/strong><\/a> and robotics.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">In 2026, India maintained a cautious position on a new legally binding treaty, favouring further work through existing international law and guidelines.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Lethal Autonomous Weapons Systems (LAWS) use AI to select and attack targets.
