


{"id":124105,"date":"2026-09-12T11:58:58","date_gmt":"2026-09-12T06:28:58","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=124105"},"modified":"2026-09-12T11:58:58","modified_gmt":"2026-09-12T06:28:58","slug":"international-criminal-court","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/international-criminal-court\/","title":{"rendered":"International Criminal Court &#8211; Withdrawals &#038; Challenges to Global Justice"},"content":{"rendered":"<h2 style=\"text-align: justify;\"><strong>International Criminal Court Latest News<\/strong><\/h2>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The International Criminal Court (ICC) is facing growing institutional and political pressure as five countries- Venezuela, Chad, Burkina Faso, Mali and Niger- have announced plans to withdraw from the court within the past year.\u00a0<\/span><\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><strong>International Criminal Court: Background<\/strong><\/h2>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The ICC was established under the <\/span><b>Rome Statute<\/b><span style=\"font-weight: 400;\">, which came into force in <\/span><b>2002<\/b><span style=\"font-weight: 400;\">.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Headquartered in <\/span><b>The Hague, Netherlands<\/b><span style=\"font-weight: 400;\">, it is a court of last resort for prosecuting individuals accused of the most serious international crimes.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Its jurisdiction covers four core crimes: Genocide, Crimes against humanity, War crimes, &amp; Crime of aggression.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The principle of <\/span><b>complementarity<\/b><span style=\"font-weight: 400;\"> is central to the ICC. The court generally intervenes when national authorities are <\/span><b>unable or unwilling to genuinely investigate or prosecute<\/b><span style=\"font-weight: 400;\"> serious crimes.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Unlike a domestic criminal court, the <\/span><b>ICC does not have its own police force<\/b><span style=\"font-weight: 400;\">. Its ability to investigate, arrest and prosecute suspects therefore depends significantly on cooperation from states.<\/span><\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><strong>Current Crisis Facing the ICC<\/strong><\/h2>\n<ul>\n<li><b>Growing U.S. Pressure<\/b>\n<ul>\n<li><span style=\"font-weight: 400;\">The United States has significantly increased pressure on the ICC. In July 2026, U.S. Secretary of State <\/span><b>Marco Rubio<\/b><span style=\"font-weight: 400;\"> announced what he described as a campaign to dismantle the threat posed by the court to U.S. sovereignty.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">The U.S. administration has also sanctioned ICC personnel and organisations associated with the court. The measures followed ICC actions involving arrest warrants against senior Israeli officials concerning the Gaza conflict and investigations involving U.S. personnel in Afghanistan.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Washington has also encouraged ICC member states that benefit from U.S. security arrangements to reconsider their membership.<\/span><\/li>\n<\/ul>\n<\/li>\n<li><b>Countries Announcing Withdrawal<\/b>\n<ul>\n<li><span style=\"font-weight: 400;\">The recent withdrawals have involved countries with different political circumstances.<\/span><\/li>\n<li><b>Chad specifically cited U.S. pressure<\/b><span style=\"font-weight: 400;\"> in announcing its decision to withdraw.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\">According to its Foreign Minister, a U.S. official had expressed concerns regarding the ICC and requested that Chad reconsider its membership shortly before the withdrawal announcement.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Burkina Faso, Mali and Niger, all governed by military juntas, have instead accused the ICC of <\/span><b>selective justice and neo-colonialism<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Venezuela has similarly criticised what it described as the instrumentalization of the court against national sovereignty and self-determination.\u00a0<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><strong>News Summary<\/strong><\/h2>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The ICC&#8217;s present challenges are not limited to the United States. Some governments have long criticised the institution for disproportionately focusing on African conflicts.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Burundi became the first country to leave the ICC in 2017<\/b><span style=\"font-weight: 400;\">, after the court opened an investigation into the country. South Africa and Gambia also announced withdrawals that year but subsequently reversed their decisions.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The recent departures, however, raise a broader concern: whether states are prepared to bear political and diplomatic costs to preserve an international system of accountability.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The ICC&#8217;s jurisdiction also does <\/span><b>not automatically end when a country withdraws<\/b><span style=\"font-weight: 400;\">. Withdrawal from the Rome Statute is not retroactive. Consequently, the court can continue investigating crimes committed while a country was a member or otherwise within the court&#8217;s jurisdiction.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">This principle is particularly relevant to the <\/span><b>Philippines<\/b><span style=\"font-weight: 400;\">. Although the country withdrew from the ICC in 2019, the court&#8217;s investigation into alleged crimes associated with f<\/span><b>ormer President Rodrigo Duterte<\/b><span style=\"font-weight: 400;\">&#8216;s anti-drug campaign continued.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Duterte is currently in ICC detention in the Netherlands and faces charges of crimes against humanity.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Similarly, the ICC&#8217;s investigation into alleged crimes by Venezuelan security forces under former President <\/span><b>Nicol\u00e1s Maduro<\/b><span style=\"font-weight: 400;\"> will continue despite Venezuela&#8217;s announced withdrawal.\u00a0<\/span><\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><strong>New Members and Continuing Relevance<\/strong><\/h2>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Despite the withdrawals, the ICC continues to attract countries seeking international accountability.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Ukraine joined the ICC in 2025<\/b><span style=\"font-weight: 400;\">, having previously accepted the court&#8217;s jurisdiction over crimes committed on its territory following the outbreak of hostilities with Russia in 2014.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Ukraine has presented ICC membership as part of its effort to ensure accountability for serious international crimes.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">This demonstrates the contradictory pressures facing the ICC: while some governments are moving away from the institution, others view it as an important mechanism for addressing grave violations of international law.<\/span><\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><strong>Significance and Challenges<\/strong><\/h2>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The ICC represents an important development in <\/span><b>international criminal law<\/b><span style=\"font-weight: 400;\">, particularly the principle that individuals, including political and military leaders, can potentially be held accountable for international crimes.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">However, its effectiveness is constrained by:<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Dependence on state cooperation for arrests and evidence<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Non-universal membership<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Political opposition from powerful states\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Allegations of selective enforcement<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Limited independent enforcement capacity\u00a0<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The present crisis therefore highlights a fundamental tension between <\/span><b>state sovereignty and international accountability<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><strong>Way Forward<\/strong><\/h2>\n<ul>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Strengthening the ICC requires greater consistency in the application of international criminal law, stronger cooperation among member states and greater transparency in institutional decision-making.<\/span><\/li>\n<li style=\"font-weight: 400;
