It gives the Commission the power of <\/span><b>superintendence, direction and control<\/b><span style=\"font-weight: 400;\"> over the preparation of electoral rolls and the conduct of elections to Parliament, State Legislatures, and the offices of the President and Vice-President.<\/span><\/p>\n<h2><b>What is Article 324?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Article 324 is part of <\/span><b>Part XV of the Constitution<\/b><span style=\"font-weight: 400;\">, which deals with elections. It provides the constitutional basis for the Election Commission and defines its broad powers and responsibilities.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Article gives the Election Commission authority over the electoral process, while also making its powers subject to laws made by Parliament and State Legislatures.<\/span><\/p>\n<h2><b>Article 324 of the Constitution Key Provisions<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The key provisions of Article 324 of Indian Constitution have been discussed below.<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Article 324(1):<\/b><span style=\"font-weight: 400;\"> Vests the <\/span><b>superintendence, direction and control<\/b><span style=\"font-weight: 400;\"> of the preparation of electoral rolls and the conduct of elections to Parliament, State Legislatures, and the offices of the President and Vice-President in the Election Commission.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Article 324(2):<\/b><span style=\"font-weight: 400;\"> Provides that the Election Commission shall consist of the <\/span><b><a href=\"https:\/\/vajiramandravi.com\/current-affairs\/chief-election-commissioner\/\" target=\"_blank\">Chief Election Commissioner<\/a> (CEC)<\/b><span style=\"font-weight: 400;\"> and such number of other Election Commissioners as the President may determine. The President appoints them, subject to laws made by Parliament.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Article 324(3):<\/b><span style=\"font-weight: 400;\"> Provides that the <\/span><b>Chief Election Commissioner shall act as the Chairman<\/b><span style=\"font-weight: 400;\"> of the Election Commission when other Election Commissioners are appointed.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Article 324(4):<\/b><span style=\"font-weight: 400;\"> Enables the President to appoint <\/span><b>Regional Commissioners<\/b><span style=\"font-weight: 400;\">, after consulting the Election Commission, to assist it in performing its functions during specified general and biennial elections.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Article 324(5):<\/b><span style=\"font-weight: 400;\"> Provides for the <\/span><b>tenure and conditions of service<\/b><span style=\"font-weight: 400;\"> of Election Commissioners and Regional Commissioners. The CEC can be removed only in the same manner and on the same grounds as a <\/span><b><a href=\"https:\/\/vajiramandravi.com\/upsc-exam\/supreme-court-of-india\/\" target=\"_blank\">Supreme Court<\/a> Judge<\/b><span style=\"font-weight: 400;\">, while other Election Commissioners and Regional Commissioners can be removed only on the recommendation of the CEC.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Article 324(6):<\/b><span style=\"font-weight: 400;\"> Requires the <\/span><b>President or Governor of a State<\/b><span style=\"font-weight: 400;\"> to provide necessary staff to the Election Commission or Regional Commissioners when requested by the Commission.<\/span><\/li>\n<\/ul>\n<h2><b>Powers and Functions of Election Commission of India<\/b><\/h2>\n<p><b>Election Commission of India (ECI)<\/b><span style=\"font-weight: 400;\"> is the constitutional authority responsible for supervising and administering elections in India.<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Superintendence of Elections:<\/b><span style=\"font-weight: 400;\"> Exercises overall <\/span><b>superintendence, direction and control<\/b><span style=\"font-weight: 400;\"> over the preparation of electoral rolls and the conduct of elections.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Conduct of Elections:<\/b><span style=\"font-weight: 400;\"> Conducts elections to the <\/span><b><a href=\"https:\/\/vajiramandravi.com\/current-affairs\/lok-sabha\/\" target=\"_blank\">Lok Sabha<\/a>, <a href=\"https:\/\/vajiramandravi.com\/current-affairs\/rajya-sabha\/\" target=\"_blank\">Rajya Sabha<\/a>, <a href=\"https:\/\/vajiramandravi.com\/current-affairs\/state-legislature\/\" target=\"_blank\">State Legislative Assemblies<\/a>, and the offices of the President and Vice-President<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Political Parties and Symbols:<\/b><span style=\"font-weight: 400;\"> Registers political parties, grants recognition to eligible parties and <\/span><b>allots election symbols<\/b><span style=\"font-weight: 400;\"> under the applicable laws and rules.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Model Code of Conduct:<\/b><span style=\"font-weight: 400;\"> Enforces the <\/span><a href=\"https:\/\/vajiramandravi.com\/upsc-exam\/model-code-of-conduct\/\" target=\"_blank\"><b>Model Code of Conduct<\/b><\/a><span style=\"font-weight: 400;\"> during elections and monitors compliance by political parties and candidates.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Election Expenditure:<\/b><span style=\"font-weight: 400;\"> Monitors election expenditure by candidates and takes action for violations of prescribed expenditure-related requirements.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Advisory and Quasi-Judicial Functions:<\/b><span style=\"font-weight: 400;\"> Advises the <\/span><b>President and Governors<\/b><span style=\"font-weight: 400;\"> on disqualification of Members of Parliament and State Legislatures and performs certain functions relating to electoral disputes and corrupt practices.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Electoral Management:<\/b><span style=\"font-weight: 400;\"> Supervises the entire electoral process, including <\/span><b>nominations, polling, counting, appointment of observers and election personnel, and use of EVMs and VVPATs<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<\/ul>\n<h2><b>Tenure and Removal of Election Commissioners<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The tenure and removal of Election Commissioners are governed by <\/span><b>Article 324 and the <a href=\"https:\/\/vajiramandravi.com\/current-affairs\/chief-election-commissioner-and-other-election-commissioners-act-2023\/\" target=\"_blank\">Chief Election Commissioner and Other Election Commissioners Act, 2023<\/a><\/b><span style=\"font-weight: 400;\">, with the term prescribed as <\/span><b>six years or until attaining 65 years of age, whichever is earlier<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Tenure:<\/b><span style=\"font-weight: 400;\"> The Chief Election Commissioner (CEC) and other Election Commissioners (ECs) hold office for <\/span><b>six years or until 65 years of age<\/b><span style=\"font-weight: 400;\">, whichever is earlier.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>No Reappointment:<\/b><span style=\"font-weight: 400;\"> The CEC and ECs are <\/span><b>not eligible for reappointment<\/b><span style=\"font-weight: 400;\"> to the same office after completing their term.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Chief Election Commissioner:<\/b><span style=\"font-weight: 400;\"> The CEC can be removed only in the <\/span><b>same manner and on the same grounds as a Judge of the Supreme Court<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Removal of Other Election Commissioners:<\/b><span style=\"font-weight: 400;\"> An Election Commissioner other than the CEC can be removed <\/span><b>only on the recommendation of of Service Conditions:<\/b><span style=\"font-weight: 400;\"> The conditions of service of the CEC and ECs are protected against changes that are <\/span><b>disadvantageous to them after
