in its Charter.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The label has recently been used by China and Russia to attack Japan&#8217;s plans to raise defence spending.<\/span><\/li>\n<\/ul>\n<h2><b>About Enemy State Clause\u00a0<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">World War II (1939\u201345) was fought between the <\/span><b>Allied Powers<\/b><span style=\"font-weight: 400;\"> (Great Britain, the Soviet Union, the United States) and the <\/span><b>Axis Powers<\/b><span style=\"font-weight: 400;\"> (Germany, Italy, Japan).\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Japan was the <\/span><b>last Axis power<\/b><span style=\"font-weight: 400;\"> to surrender, in September 1945.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The UN Charter, drafted toward the war&#8217;s end and in force from October 24, 1945, contains numerous references to &#8220;enemy states.&#8221;\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Allies \u2014 who drafted the Charter and later took permanent UN Security Council (UNSC) seats \u2014 designed it <\/span><b>as a mechanism to counter<\/b><span style=\"font-weight: 400;\"> any re-emergence of militarism or fascism in the defeated Axis powers, without needing UNSC approval each time.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">In other words, the UN Charter&#8217;s &#8220;enemy state&#8221; clauses (Articles 53, 77, 107) let Allied powers take military or preventive action against defeated WWII Axis nations without needing prior UNSC authorization.<\/span><\/li>\n<\/ul>\n<h3><b>Where it Appears<\/b><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The term features in <\/span><b>three Articles<\/b><span style=\"font-weight: 400;\">: 53, 77, and 107.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Article 53:<\/b><span style=\"font-weight: 400;\"> Permits enforcement action against an &#8220;enemy state&#8221; through regional arrangements without prior Security Council authorisation \u2014 an exception to the normal rule requiring UNSC approval for such action.\u00a0<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Paragraph 2 defines enemy state as any state that was an enemy of a Charter signatory during World War II.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Article 107:<\/b><span style=\"font-weight: 400;\"> States that nothing in the Charter invalidates or blocks action taken against a WWII enemy state by the governments responsible for such action as a result of that war.\u00a0<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">In effect, it gives the Allied Powers a legal right to act against defeated Axis states without UNSC approval.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Article 77(1)(b):<\/b><span style=\"font-weight: 400;\"> Concerns the <\/span><b>&#8220;trusteeship system&#8221;<\/b><span style=\"font-weight: 400;\"> applied to territories detached from enemy states after WWII.\u00a0<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Under the Charter, the UN was to establish an international trusteeship system (Article 75) for <\/span><b>&#8220;trust territories&#8221;<\/b><span style=\"font-weight: 400;\"> \u2014 places whose peoples had not yet attained full self-government (Article 73).\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">There were <\/span><b>11 such territories<\/b><span style=\"font-weight: 400;\">, across Africa and the Pacific Islands.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h2><b>Why Japan Wants It Removed<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The UNGA recognised the clauses as <\/span><b>obsolete in 1995<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A resolution in 2005 called for <\/span><b>deleting<\/b><span style=\"font-weight: 400;\"> enemy state references from the Charter.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Japan\u2019s call to remove this cluse is being framed within a wider appeal for <\/span><b>UN and UNSC reform<\/b><span style=\"font-weight: 400;\">, which she called &#8220;a matter of utmost importance.<\/span><\/li>\n<\/ul>\n<h3><b>The Geopolitical Backdrop<\/b><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Japanese PM\u2019s remarks come amid <\/span><b>rising hostility with China and Russia<\/b><span style=\"font-weight: 400;\">, both exerting economic and military pressure on Japan.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>With China<\/b><span style=\"font-weight: 400;\">: China has restricted access to rare earth magnets needed by Japanese manufacturers.<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Chinese fighter aircraft and warships have conducted military drills near the Japanese coast.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>With Russia<\/b><span style=\"font-weight: 400;\">: Russia has conducted military exercises near Japan and criticised Japan&#8217;s plans to raise defence spending.<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">In August 2026, Russian President visited the disputed southern Kuril Islands.
