


{"id":12696,"date":"2023-07-01T04:11:31","date_gmt":"2023-06-30T22:41:31","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=12696"},"modified":"2025-04-01T20:56:50","modified_gmt":"2025-04-01T15:26:50","slug":"what-is-the-ordinance-making-power-of-the-president","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/what-is-the-ordinance-making-power-of-the-president\/","title":{"rendered":"What is the Ordinance making power of the President?"},"content":{"rendered":"<h2><strong>About Ordinance making power of the President:<\/strong><\/h2>\n<p>&nbsp;<\/p>\n<ul>\n<li><strong>Article 123 <\/strong>of the Indian Constitution <strong>grants the President<\/strong> of India <strong>certain Lawmaking powers, i.e. to Promulgate Ordinances when either of the two Houses of the Parliament is not in session,<\/strong> which makes it impossible for a single House to pass and enact a law.<\/li>\n<li>These Ordinances <strong>have the same effect as an Act of Parliament<\/strong>.<\/li>\n<li>Ordinances <strong>may relate to any subject that the Parliament has the power to make law<\/strong>, and would be <strong>having the same limitations<\/strong>.<\/li>\n<li>The Ordinances <strong>may have a retrospective effect and may modify or repeal any act<\/strong> of Parliament or other ordinances. It may be <strong>used to amend a tax law, but it can never amend the Constitution.<\/strong><\/li>\n<li>The President <strong>may withdraw an ordinance at any time<\/strong>. However, he <strong>exercises his power with the consent of the Council of Ministers headed by the President<\/strong>.<\/li>\n<li>F<strong>ollowing limitations exist on the Ordinance making power,<\/strong>\n<ul>\n<li><strong>Legislature is not in session<\/strong>:\u00a0 The President can <strong>only promulgate<\/strong> an Ordinance <strong>when either of the two Houses of Parliament is not in session<\/strong>.<\/li>\n<li><strong>Immediate action is required<\/strong>: The President cannot promulgate an Ordinance <strong>unless he is satisfied that there are circumstances that require taking \u2018immediate action\u2019.<\/strong><\/li>\n<li><strong>Parliament should approve<\/strong>: Ordinances <strong>must be approved by Parliament within six weeks of reassembling<\/strong> or they shall cease to operate.
