Under the proposed framework, routine breaches of licence conditions would be dealt with through <\/span><b>civil penalties<\/b><span style=\"font-weight: 400;\">, while serious offences such as unlicensed petroleum activities, fraud, pilferage, damage to petroleum facilities and threats to public safety would continue to attract criminal penalties.<\/span><\/p>\n<h2><b>Draft Petroleum Amendment Bill 2026 Key Highlights<\/b><\/h2>\n<p><b>Draft Petroleum Amendment Bill 2026<\/b><span style=\"font-weight: 400;\"> proposes a graded penalty framework under the <\/span><b>Petroleum Act, 1934<\/b><span style=\"font-weight: 400;\">, separating routine licence violations from serious offences involving safety, infrastructure and unlicensed petroleum activities.<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Decriminalisation of Minor Violations:<\/b><span style=\"font-weight: 400;\"> Routine breaches of licence terms and conditions would move from <\/span><b>criminal liability to civil adjudication<\/b><span style=\"font-weight: 400;\">. An authorised adjudicating officer would handle such cases following the <\/span><b>principles of <a href=\"https:\/\/vajiramandravi.com\/current-affairs\/principle-of-natural-justice\/\" target=\"_blank\">natural justice<\/a><\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Civil Penalties for Licence Breaches:<\/b><span style=\"font-weight: 400;\"> A penalty of up to <\/span><b>\u20b92.5 crore for the first breach<\/b><span style=\"font-weight: 400;\"> and up to <\/span><b>\u20b95 crore for subsequent breaches<\/b><span style=\"font-weight: 400;\"> is proposed. The authority may also direct corrective action or recommend <\/span><b>suspension or revocation of the licence<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Penalties for Unlicensed Activities:<\/b><span style=\"font-weight: 400;\"> Carrying out petroleum activities without the required licence may attract <\/span><b>imprisonment up to 3 years or a fine up to \u20b925 crore, or both<\/b><span style=\"font-weight: 400;\">. Continuing violations may attract an additional fine of up to <\/span><b>\u20b910 lakh per day<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Fraudulent Licensing:<\/b><span style=\"font-weight: 400;\"> Obtaining a petroleum licence through <\/span><b>fraud, dishonesty, misrepresentation or impersonation<\/b><span style=\"font-weight: 400;\"> would be treated as a specific criminal offence, with imprisonment of up to <\/span><b>5 years<\/b><span style=\"font-weight: 400;\">, or fine, or both.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Infrastructure Damage, Pilferage and Safety Risks:<\/b><span style=\"font-weight: 400;\"> Serious offences involving <\/span><b>pilferage, damage to petroleum facilities or threats to public safety<\/b><span style=\"font-weight: 400;\"> may attract up to <\/span><b>5 years\u2019 imprisonment or \u20b915 crore fine<\/b><span style=\"font-weight: 400;\"> for a first offence and up to <\/span><b>7 years\u2019 imprisonment or \u20b925 crore fine<\/b><span style=\"font-weight: 400;\"> for subsequent offences.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Protection of Critical Petroleum Infrastructure:<\/b><span style=\"font-weight: 400;\"> The Central Government may designate certain petroleum facilities or areas as <\/span><b>critical petroleum infrastructure<\/b><span style=\"font-weight: 400;\">.
