It is an important constitutional provision for strengthening <\/span><b>cooperative federalism.<\/b><\/p>\n<h2><b>Key Provisions of Article 263 of the Indian Constitution<\/b><\/h2>\n<p><b>Article 263<\/b><span style=\"font-weight: 400;\"> is placed in<\/span><b> Part XI of the Constitution<\/b><span style=\"font-weight: 400;\">, under the heading <\/span><b>\u201cCo-ordination between States.\u201d <\/b><span style=\"font-weight: 400;\">It <\/span><b>empowers the President to establish an Inter-State Council<\/b><span style=\"font-weight: 400;\"> when it appears that its establishment would serve the public interest.<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The President may establish an Inter-State Council by order and define its duties, organisation and procedure.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Council may deal with disputes between States, subjects of common interest and coordination of policy and action.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The <\/span><b>establishment of the Council under Article 263 is not mandatory<\/b><span style=\"font-weight: 400;\">, as the Article states that the President may establish such a Council when public interest would be served.<\/span><\/li>\n<\/ul>\n<h2><b>Establishment of the Inter-State Council under Article 263 of the Indian Constitution<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Although Article 263 was part of the Constitution from its commencement, the <\/span><b>Inter-State Council was established in 1990 following the recommendation of the Sarkaria Commission <\/b><span style=\"font-weight: 400;\">on Centre-State Relations. The Union Government established the Council under <\/span><b>Article 263<\/b><span style=\"font-weight: 400;\"> through a Presidential Order.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The Sarkaria Commission had recommended a permanent Inter-Governmental Council under Article 263 to provide an institutional mechanism for Centre-State consultation and cooperation.<\/span><\/p>\n<h2><b>Composition of the Inter-State Council under Article 263 of the Indian Constitution<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The Inter-State Council brings together representatives of the Union and the States, with the <strong><a href=\"https:\/\/vajiramandravi.com\/upsc-exam\/prime-minister\/\" target=\"_blank\">Prime Minister<\/a><\/strong> as its Chairperson.<\/span><\/p>\n<p><b>Its composition includes:<\/b><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Prime Minister as Chairperson.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Chief Ministers of all States.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Chief Ministers of Union Territories having Legislative Assemblies.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Administrators of other Union Territories.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\"><strong><a href=\"https:\/\/vajiramandravi.com\/current-affairs\/cabinet-ministers-of-india\/\" target=\"_blank\">Union Cabinet Ministers<\/a><\/strong> nominated by the Prime Minister, including the Union Home Minister.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Other Union Ministers may also be nominated when necessary.<\/span><\/li>\n<\/ul>\n<h2><b>Functions of the Inter-State Council under Article 263 of the Indian Constitution<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The Inter-State Council is primarily a consultative and recommendatory mechanism for intergovernmental cooperation.Article 263 gives the Inter-State Council three broad functions:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Advising on inter-State disputes<\/b><span style=\"font-weight: 400;\">: It can inquire into disputes between States and advise on their resolution.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Discussing common interests:<\/b><span style=\"font-weight: 400;\"> It can investigate and discuss issues affecting two or more States, or both the Union and States.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Recommending coordinated action:<\/b><span style=\"font-weight: 400;\"> It can make recommendations to improve coordination of policies and actions between the Union and States.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">It is not a judicial tribunal for adjudicating disputes between States.<\/span><\/p>\n<h2><b>Significance of Article 263<\/b><\/h2>\n<p><b>Article 263<\/b><span style=\"font-weight: 400;\"> is significant because it provides a constitutional mechanism for managing relations and coordination within India\u2019s federal system.<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Provides a constitutional basis for intergovernmental coordination<\/b><span style=\"font-weight: 400;\"> between the Union and States.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Promotes cooperative federalism<\/b><span style=\"font-weight: 400;\"> by encouraging dialogue and consensus rather than relying only on unilateral action.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Facilitates coordinated policy-makin<\/b><span style=\"font-weight: 400;\">g on issues involving shared responsibilities and common interests.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Strengthens the federal structure<\/b><span style=\"font-weight: 400;\"> by providing an institutional link between the Union and the States.<\/span><\/li>\n<\/ul>\n<h2><b>Limitations of the Inter-State Council<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Despite its role as a forum for intergovernmental consultation and cooperation, the Inter-State Council faces certain institutional limitations.\u00a0<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Consultative and recommendatory nature: <\/b><span style=\"font-weight: 400;\">The Council facilitates consultation and makes recommendations, but Article 263 does not give its recommendations binding force.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>No adjudicatory power:<\/b><span style=\"font-weight: 400;\"> The Council can inquire into and advise upon disputes between States, but it is not a judicial forum for settling such disputes.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Infrequent meetings:<\/b><span style=\"font-weight: 400;\"> The Centre-State Relations Commission observed that the Council meets rarely and has therefore not been able to realise its full potential.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Limited role in conflict resolution:<\/b><span style=\"font-weight: 400;\"> Its role is primarily to promote dialogue, coordination and cooperation rather than provide a final mechanism for resolving inter-State conflicts.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Dependence on intergovernmental cooperation:<\/b><span style=\"font-weight: 400;\"> The effectiveness of the Council depends on the willingness of the Union and State Governments to participate meaningfully and act upon its recommendations.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Thus, the Inter-State Council provides an institutional platform for cooperative federalism, but its effectiveness depends on regular meetings, meaningful consultation and follow-up on its
