These laws empower the police to maintain public order, prevent violence, disperse unlawful assemblies and take preventive action. However, these powers must be exercised lawfully, proportionately and with respect for fundamental rights.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The central challenge is to balance the <\/span><b>right to peaceful protest with public order, individual liberty and the rule of law<\/b><span style=\"font-weight: 400;\">. While the state can regulate demonstrations to prevent violence and disruption, restrictions should not unnecessarily interfere with citizens&#8217; democratic rights.<\/span><\/p>\n<h2><b>Constitutional Provisions Related to the Right to Protest<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">The Indian Constitution protects citizens&#8217; right to peaceful protest while allowing reasonable restrictions to maintain public order and protect national security.<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b><a href=\"https:\/\/vajiramandravi.com\/current-affairs\/article-19-of-indian-constitution\/\" target=\"_blank\">Article 19<\/a>(1)(a): Freedom of Speech and Expression \u2013<\/b><span style=\"font-weight: 400;\"> Guarantees citizens the right to express opinions, criticise government policies and raise public concerns peacefully.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Article 19(1)(b): Right to Assemble Peacefully \u2013 <\/b><span style=\"font-weight: 400;\">Grants citizens the right to assemble peacefully and without arms, subject to reasonable restrictions.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Article 19(2): Restrictions on Freedom of Speech \u2013 <\/b><span style=\"font-weight: 400;\">Allows the state to impose reasonable restrictions on freedom of speech and expression on specified grounds, including public order, security of the state and sovereignty and integrity of India.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Article 19(3): Restrictions on Peaceful Assembly \u2013 <\/b><span style=\"font-weight: 400;\">Permits reasonable restrictions on the right to assemble peacefully in the interests of India&#8217;s sovereignty and integrity and public order.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Article 21: Right to Life and Personal Liberty \u2013 <\/b><span style=\"font-weight: 400;\">Protects individuals against unlawful deprivation of life and personal liberty. Police action, including detention and the use of force, must comply with applicable law and constitutional safeguards.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Article 22: Protection Against Arbitrary Arrest and Detention \u2013<\/b><span style=\"font-weight: 400;\"> Provides safeguards for arrested persons, including the right to be informed of the grounds of arrest, consult a lawyer and be produced before a magistrate within 24 hours, excluding necessary journey time, subject to constitutional exceptions.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Article 32: Right to Constitutional Remedies \u2013<\/b><span style=\"font-weight: 400;\"> Allows individuals to approach the <strong><a href=\"https:\/\/vajiramandravi.com\/upsc-exam\/supreme-court-of-india\/\" target=\"_blank\">Supreme Court<\/a><\/strong> to enforce fundamental rights, including when police action violates constitutional protections.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Article 226: Power of High Courts to Issue Writs \u2013 <\/b><span style=\"font-weight: 400;\">Empowers High Courts to issue writs for the enforcement of <strong><a href=\"https:\/\/vajiramandravi.com\/current-affairs\/fundamental-rights-of-indian-constitution\/\" target=\"_blank\">fundamental rights<\/a><\/strong> and for other legal purposes, including addressing unlawful detention or arbitrary restrictions on protests.<\/span><\/li>\n<\/ul>\n<h2><b>Extraordinary Police Powers During Protests<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">In situations involving serious threats to public order or <strong><a href=\"https:\/\/vajiramandravi.com\/upsc-exam\/national-security-strategy\/\" target=\"_blank\">national security<\/a><\/strong>, authorities may invoke additional preventive laws. with statutory and constitutional safeguards may be examined by courts.<\/span><\/li>\n<\/ul>\n<h2><b>Challenges in Regulating Protests in India<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Despite the existing legal framework, regulating protests remains challenging because authorities must protect public safety without undermining democratic participation.<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Balancing liberty and public order: <\/b><span style=\"font-weight: 400;\">Excessive restrictions can discourage legitimate dissent, while inadequate policing can allow violence and damage to property.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Possibility of arbitrary action: <\/b><span style=\"font-weight: 400;\">Broad prohibitory orders and preventive arrests may affect peaceful protesters if not supported by specific and lawful grounds.<\/span><\/li>\n<li style=\"font-weight:
