<\/b><span style=\"font-weight: 400;\">It can be applied only<\/span><b> after an area has been declared \u201cdisturbed\u201d <\/b><span style=\"font-weight: 400;\">under<\/span><b> section 2<\/b><span style=\"font-weight: 400;\"> of the Act.<\/span><\/li>\n<li style=\"text-align: justify;\"><b>Declaration of Disturbed Areas:<\/b>\n<ul>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Defined under<\/span><b> Section 3<\/b><span style=\"font-weight: 400;\"> of the Act, a \u201c<\/span><b>disturbed area\u201d is<\/b><span style=\"font-weight: 400;\"> where the <\/span><b>use of armed forces is deemed necessary to support civil authorities in maintaining law and order.<\/b><\/li>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">An area can be declared disturbed<\/span><b> due to conflicts or disputes<\/b><span style=\"font-weight: 400;\"> between various religious, racial, linguistic, regional, or caste-based communities.<\/span><\/li>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">The <\/span><b>central government, Governor of the state, or the administrator of the Union Territory can declare<\/b><span style=\"font-weight: 400;\"> the <\/span><b>whole or part of a state or union territory<\/b><span style=\"font-weight: 400;\"> as a disturbed area.<\/span><\/li>\n<li style=\"text-align: justify;\"><b>Once declared<\/b><span style=\"font-weight: 400;\">, the region is<\/span><b> maintained as disturbed for at least three months <\/b><span style=\"font-weight: 400;\">under The Disturbed Areas (Special Courts) Act, 1976.<\/span><\/li>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">The<\/span><b> scope and duration of AFSPA can vary<\/b><span style=\"font-weight: 400;\"> depending on the region\u2019s security situation.\u00a0<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"text-align: justify;\"><b>The \u2018special powers\u2019 of armed forces under AFSPA are:\u00a0<\/b>\n<ul>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">They have the authority to <\/span><b>prohibit a gathering of five or more persons<\/b><span style=\"font-weight: 400;\"> in an area, can <\/span><b>use force even to cause death or even open fire after giving due warning,<\/b><span style=\"font-weight: 400;\"> if they feel a person is in contravention of the law.\u00a0<\/span><\/li>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">If reasonable suspicion exists, the army can also<\/span><b> arrest a person without a warrant, enter or search a premises without a warrant,<\/b><span style=\"font-weight: 400;\"> and b<\/span><b>an the possession of firearms.<\/b><\/li>\n<li style=\"text-align: justify;\"><b>Any person arrested <\/b><span style=\"font-weight: 400;\">or taken into custody <\/span><b>may be handed over to the <\/b><span style=\"font-weight: 400;\">officer in charge of the <\/span><b>nearest police station <\/b><span style=\"font-weight: 400;\">along with a report detailing the circumstances that led to the arrest.<\/span><\/li>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">These armed forces are <\/span><b>immune from prosecution unless the Union Government provides sanction <\/b><span style=\"font-weight: 400;\">to the prosecuting agencies.<\/span><\/li>\n<li style=\"text-align: justify;\"><b>Where is AFSPA in force now?<\/b><span style=\"font-weight: 400;\"> Currently, AFSPA is active in <\/span><b>Assam, Manipur, Nagaland, Arunachal Pradesh, and the UT of J&amp;K.<\/b><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><b>Source<\/b><span style=\"font-weight: 400;\">: <\/span><a href=\"https:\/\/www.newsonair.gov.in\/afspa-extended-in-three-assam-districts-until-march-2026\/\" target=\"_blank\" rel=\"nofollow noopener\"><span style=\"font-weight: 400;\">NOA<\/span><\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Armed Forces (Special Powers) Act (AFSPA), 1958 is a law enacted by the Parliament in 1958 which gives the armed forces special powers and immunity to maintain public order in \u201cdisturbed areas\u201d.
