


{"id":13760,"date":"2025-01-06T05:54:51","date_gmt":"2025-01-06T00:24:51","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=13760"},"modified":"2025-04-02T07:05:06","modified_gmt":"2025-04-02T01:35:06","slug":"about-charge-sheet","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/about-charge-sheet\/","title":{"rendered":"About Charge Sheet"},"content":{"rendered":"<h2><strong>About Chargesheet:<\/strong><\/h2>\n<ul>\n<li>A chargesheet is a <strong>final report<\/strong> that is <strong>filed by the investigating officer<\/strong> or police officials <strong>after the completion of the investigation in a cognizable or non-cognizable case.<\/strong><\/li>\n<li>It is also known as <strong>the Police report or the Final report<\/strong>.<\/li>\n<li>It <strong>contains all the stringent records<\/strong> right <strong>from the commencement of the investigation<\/strong> procedure of lodging an FIR <strong>to the completion of the investigation<\/strong> and the preparation of final report.<\/li>\n<li>The chargesheet has to be prepared and<strong> submitted by the police before the court proceedings can begin.<\/strong><\/li>\n<li><strong>Once the charge sheet has been submitted to a court<\/strong> of law, <strong>prosecution proceedings<\/strong> against the accused <strong>begin<\/strong>.<\/li>\n<li>This report by the investigating officer should be in the <strong>form prescribed by the state government.<\/strong>\n<ul>\n<li><strong>Contents of the chargesheet:<\/strong> A chargesheet must contain the following information<\/li>\n<li>The <strong>names of the parties.<\/strong><\/li>\n<li><strong>Nature of the information<\/strong>.<\/li>\n<li>Names of the persons who appear to be acquainted with the events.<\/li>\n<li><strong>About the offence<\/strong> that appears to have been committed <strong>and the person by whom it has been committed.<\/strong><\/li>\n<li><strong>Information regarding the arrest of the accused<\/strong>, <strong>his\/their release w<\/strong>ith or without sureties, and whether he has been forwarded into custody.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Benefits of a chargesheet:<\/strong>\n<ul>\n<li>It <strong>contains<\/strong> the <strong>statements of the accused and<\/strong> all other <strong>witnesses<\/strong>.<\/li>\n<li><strong>Marks the beginning of a criminal trial.<\/strong><\/li>\n<li><strong>Charges<\/strong> on which courts have to proceed <strong>against the accused are mentioned.<\/strong><\/li>\n<li>It is <strong>useful for the accused in obtaining bail<\/strong> as the offences are mentioned clearly.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Time limit for filing a Charge Sheet:<\/strong>\n<ul>\n<li>It is to be filed <strong>within 60 days<\/strong> from the date of arrest of the accused <strong>in cases triable by lower courts<\/strong> and <strong>90 days in cases triable by the Court of Sessions<\/strong>.<\/li>\n<li><strong>If the charge sheet is not filed<\/strong> within the prescribed time mentioned above, the <strong>accused has a right to default bail.<\/strong><\/li>\n<\/ul>\n<\/li>\n<li><strong>Is filing a chargesheet compulsory?<\/strong>\n<ul>\n<li>Filing of a chargesheet <strong>in case a cognizable offence<\/strong> is said to be committed by the accused <strong>is mandatory<\/strong> on the part of police officials, either by themselves or on the orders of the court, after filing an FIR.<\/li>\n<li>However, the same is <strong>not compulsory in cases where a non-cognizable offence<\/strong> has been committed unless the court orders an investigation.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><strong>What is a Cognizable Offence?<\/strong><\/p>\n<ul>\n<li>A <strong>Cognizable offence<\/strong> or case is defined as one which an <strong>officer in-charge<\/strong> of a police station <strong>may investigate without the order of a magistrate and effect arrest without a warrant.<\/strong><\/li>\n<li>The Police have a direct responsibility to take immediate action on the receipt of a complaint or credible information in such crimes, visit the scene of the crime, investigate the facts, apprehend the offender, and arraign him before a Court of law having jurisdiction over the matter.<\/li>\n<li><strong>Non-Cognizable crimes<\/strong> are defined as those which <strong>cannot be investigated by police without the order of a competent magistrate.<\/strong><\/li>\n<\/ul>\n<hr \/>\n<h3><strong>Q1<\/strong>: What is the First Information Report (FIR)?<\/h3>\n<p>It is a written document prepared by a Police officer based on information given by an aggrieved person or any other person either in writing or made orally about the commission of a Cognizable Offence. Investigation is started only after filing of the FIR. Anyone can file a FIR, whether it is the victim, victim\u2019s family or friends, or any witness to a crime.
