


{"id":14092,"date":"2025-09-23T09:51:32","date_gmt":"2025-09-23T04:21:32","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=14092"},"modified":"2025-09-23T14:37:30","modified_gmt":"2025-09-23T09:07:30","slug":"what-is-the-international-criminal-court-icc","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/what-is-the-international-criminal-court-icc\/","title":{"rendered":"International Criminal Court"},"content":{"rendered":"<h2><b>International Criminal Court Latest News<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Recently, the military-led West African nations of Burkina Faso, Mali and Niger announced their withdrawal from the International Criminal Court.<\/span><\/p>\n<h2><b>About International Criminal Court<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It was established by an international agreement, the <\/span><b>Rome Statute, on 17 July 1998.<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Rome Statute sets out the Court\u2019s <\/span><b>jurisdiction, structures, and functions.<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Statute <\/span><b>entered into force on 1 July 2002.<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It is the only <\/span><b>permanent international criminal tribunal.<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Mandate:<\/b><span style=\"font-weight: 400;\"> ICC <\/span><b>investigates<\/b><span style=\"font-weight: 400;\"> and, where warranted, tries individuals charged with the <\/span><b>gravest crimes<\/b><span style=\"font-weight: 400;\"> of concern to the international community: genocide, war crimes, crimes against humanity, and the crime of aggression.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Members: <\/b><span style=\"font-weight: 400;\">There are <\/span><b>125 member countries<\/b><span style=\"font-weight: 400;\">, (<\/span><b>China, India, Israel, Russia, and the United Statee <\/b><span style=\"font-weight: 400;\">are not ICC parties).<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Funding:<\/b><span style=\"font-weight: 400;\"> The Court is funded <\/span><b>by contributions from the States Parties<\/b><span style=\"font-weight: 400;\"> and by <\/span><b>voluntary contributions from Governments<\/b><span style=\"font-weight: 400;\">, international organizations, individuals, corporations, and other entities.<\/span><\/li>\n<\/ul>\n<h2><b>Composition of International Criminal Court<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Judges:<\/b><span style=\"font-weight: 400;\"> The court has <\/span><b>eighteen judges,<\/b><span style=\"font-weight: 400;\"> each from a different member country, elected to <\/span><b>non-renewable nine-year terms.<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>The Presidency:<\/b><span style=\"font-weight: 400;\"> Consists of three judges (the President and two Vice-Presidents) elected from among the judges. It represents the Court to the outside world and helps with the organization of the work of the judges.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Office of the Prosecutor<\/b><span style=\"font-weight: 400;\"> (OTP): OTP is responsible for <\/span><b>receiving referrals<\/b><span style=\"font-weight: 400;\"> and any substantiated information on crimes within the jurisdiction of the Court. OTP examines these referrals and information, conducts investigations, and conducts prosecutions before the Court.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Registry:<\/b><span style=\"font-weight: 400;\"> It provides <\/span><b>administrative and operational support<\/b><span style=\"font-weight: 400;\"> to the Chambers and the Office of the Prosecutor.<\/span><\/li>\n<\/ul>\n<h2><b>Jurisdiction of International Criminal Court<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Unlike the International Court of Justice (ICJ), which hears disputes between states, the ICC <\/span><b>handles prosecutions of individuals.<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The ICC is only competent to hear a case if:<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The country where the offence was committed is a <\/span><b>party to the Rome Statute<\/b><span style=\"font-weight: 400;\">; or<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The <\/span><b>perpetrator\u2019s country of origin<\/b><span style=\"font-weight: 400;\"> is a party to the Rome Statute.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The ICC may only exercise its jurisdiction if the national court is unable or unwilling to do so.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The ICC only has jurisdiction over offences committed after the Statute\u2019s entry into force on 1 July 2002.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><b>Source:<\/b><strong> <a href=\"https:\/\/www.thehindu.com\/news\/international\/burkina-faso-mali-and-niger-withdraw-from-international-criminal-court\/article70082296.ece\" target=\"_blank\" rel=\"nofollow noopener\">TH<\/a><\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The International Criminal Court was established by an international agreement, the Rome Statute, on 17 July 1998.
