{"id":14489,"date":"2023-09-10T05:23:39","date_gmt":"2023-09-09T23:53:39","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=14489"},"modified":"2025-04-02T20:59:01","modified_gmt":"2025-04-02T15:29:01","slug":"wto-dispute-settlement-system","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/wto-dispute-settlement-system\/","title":{"rendered":"WTO Dispute Settlement System"},"content":{"rendered":"<h2><strong>What is World Trade Organization (WTO)?<\/strong><\/h2>\n<ul>\n<li>WTO is an\u00a0<strong>international organization<\/strong> that\u00a0<strong>promotes and regulates global trade among nations.<\/strong><\/li>\n<li>The WTO was\u00a0<strong>established on January 1, 1995\u00a0<\/strong>by\u00a0<strong>replacing the General Agreement on Tariffs and Trade (GATT).<\/strong><\/li>\n<li><strong>Objective<\/strong>: Its main objective is to\u00a0<strong>promote free and fair trade\u00a0<\/strong>by\u00a0<strong>eliminating barriers to trade,\u00a0<\/strong>such as tariffs and quotas, and by\u00a0<strong>ensuring that trade disputes are resolved\u00a0<\/strong>through a transparent and predictable process.<\/li>\n<li><strong>Functions:\u00a0<\/strong>The WTO is responsible for:\n<ul>\n<li><strong>setting the rules of international trade;<\/strong><\/li>\n<li><strong>negotiating and implementing trade agreements;<\/strong><\/li>\n<li>providing a\u00a0<strong>forum for trade negotiations<\/strong>;<\/li>\n<li><strong>monitoring national trade policies;<\/strong><\/li>\n<\/ul>\n<\/li>\n<li>The WTO also works closely with other international organizations, such as the World Bank and the International Monetary Fund, to promote global economic development and reduce poverty.<\/li>\n<li>It is\u00a0<strong>headquartered in Geneva, Switzerland,<\/strong> and\u00a0<strong>operates on a consensus-based decision-making process.<\/strong><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h3>About WTO Dispute Settlement Mechanism:<\/h3>\n<ul>\n<li>The\u00a0<strong>Dispute Settlement Understanding (DSU)<\/strong> is the\u00a0<strong>main WTO agreement on settling disputes.<\/strong><\/li>\n<li>The<strong> General Council of WTO convenes as the Dispute Settlement Body (DSB)<\/strong> to deal with disputes between WTO members.<\/li>\n<li><strong>The DSB has authority to:<\/strong>\n<ul>\n<li><strong>establish dispute settlement panels;<\/strong><\/li>\n<li><strong>refer matters to arbitration, adopt panel, Appellate Body and arbitration report<\/strong>s;<\/li>\n<li><strong>maintain surveillance over the implementation of recommendation<\/strong>s and rulings contained in such reports;<\/li>\n<li><strong>authorize suspension of concessions in the event of non-compliance\u00a0<\/strong>with those recommendations and rulings;<\/li>\n<\/ul>\n<\/li>\n<li><strong>Process<\/strong>:\n<ul>\n<li><strong>Ideally disputes are resolved through negotiations.<\/strong><\/li>\n<li><strong>If this is not possible, WTO Members can request the establishment of a panel<\/strong> to settle the dispute.\u00a0<\/li>\n<li>The\u00a0<strong>panel will issue a report<\/strong>, which\u00a0<strong>can subsequently be appealed before the WTO&#8217;s Appellate Body\u00a0<\/strong>on questions of law.<\/li>\n<\/ul>\n<\/li>\n<li><strong>The Appellate Body:<\/strong>\n<ul>\n<li>Appeals are handled by the\u00a0<strong>permanent seven-member Appellate Body<\/strong> which is\u00a0<strong>set up by the DSB\u00a0<\/strong>and broadly represents the range of WTO membership.o \u00a0\u00a0It\u00a0<strong>hears appeals from reports issued by panel<\/strong>s in disputes brought by WTO members.<\/li>\n<li>The Appellate Body\u00a0<strong>can uphold, modify or reverse the legal findings<\/strong> and conclusions of a panel.<\/li>\n<li><strong>If a WTO member does not comply with recommendations<\/strong> from dispute settlement,\u00a0<strong>than trade compensation or sanctions<\/strong>, for example in the form of increases in customs duties,<strong> may follow.<\/strong><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<hr \/>\n<h3>Q1) What is G20?<\/h3>\n<p>The Group of Twenty, commonly referred to as the G20, is an international forum of major economies that brings together 19 individual countries and the European Union.
