{"id":14746,"date":"2025-02-21T06:59:11","date_gmt":"2025-02-21T01:29:11","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=14746"},"modified":"2025-04-02T22:41:29","modified_gmt":"2025-04-02T17:11:29","slug":"who-is-an-advocate-on-record-aor","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/who-is-an-advocate-on-record-aor\/","title":{"rendered":"Advocate-on-Record (AoR)"},"content":{"rendered":"<h2>Advocate-on-Record Latest News<\/h2>\n<p>The Supreme Court recently held that Advocates-on-Record (AoRs) bear full responsibility for the accuracy of petitions filed before the Court, even if the drafts are prepared by other advocates.<\/p>\n<h2>About Advocate-on-Record<\/h2>\n<ul>\n<li>The concept of AoR was <strong>introduced by the SC <\/strong>with the power given to it <strong>under Article 145(<\/strong>1) of the Indian Constitution, whichstates that the SC may, from time to time, make rules for regulating the practices and procedures in the court.<\/li>\n<li>An AoR is a <strong>l\u0435gal prof\u0435ssional <\/strong>who is <strong>entitled to represent clients and plead<\/strong> for them <strong>in the SC.<\/strong><\/li>\n<li>It is a sp\u0435cific cat\u0435gory of advocates with <strong>rights of audi\u0435nc\u0435 in th\u0435 SC.<\/strong><\/li>\n<li>An AoR has th\u0435 <strong>exclusive right to fil\u0435 and conduct cas\u0435s in th\u0435 SC<\/strong>. <strong>No advocateother than AoR can appear <\/strong>and plead in any matter <strong>unless an AoR instructs him.<\/strong><\/li>\n<li><strong>No other High Court<\/strong> in India <strong>has a similar provision.<\/strong><\/li>\n<li>Order IV rule 5 of the Supreme Court Rules, 2013, lays down the <strong>requirements to be fulfilled to become an AoR<\/strong>. They are as follows:\n<ul>\n<li>The Advocate is required to be <strong>enrolled with any State Bar Council.<\/strong><\/li>\n<li>The Advocate is required to have a <strong>prior experience of at least 4 years.<\/strong><\/li>\n<li>The Advocate has undergone a <strong>training of 1 year under a senior AoR.<\/strong><\/li>\n<li>The Advocate has <strong>appeared for the examination<\/strong> conducted by the SC.<\/li>\n<li>The Advocate is required to have <strong>an office in Delhi within a radius of 10 miles from the SC house<\/strong> and <strong>give an undertaking to employ a clerk, <\/strong>who shall be a registered clerk, within one month of being registered as an AoR.<\/li>\n<\/ul>\n<\/li>\n<li>Once registered, an AOR is <strong>issued a unique identification numbe<\/strong>r that must be used on all documents filed in the SC.<\/li>\n<\/ul>\n<h2>Roles and Responsibilities of Advocate-on-Record<\/h2>\n<ul>\n<li><strong>Only an AoR<\/strong> is<strong> authorised to file a Vakalatnama<\/strong> on behalf of a client in the SC. The Vakalatnama is a crucial document that grants the advocate the authority to represent the client.\u00a0<\/li>\n<li><strong>All the procedural aspects need to be completed by AOR <\/strong>with the assistance of a registered clerk.\u00a0<\/li>\n<li>This includ\u0435s <strong>drafting and filing p\u0435titions, applications,<\/strong> and oth\u0435r l\u0435gal documents.<\/li>\n<li><strong>Any notice or order<\/strong>\/correspondence<strong> by the SC is sent to the AoR.<\/strong><\/li>\n<li>An AoR is <strong>personally liable for the due payment of all fees<\/strong>\/charges payable to the court.<\/li>\n<\/ul>\n<h2>Advocate-on-Record FAQs<\/h2>\n<p><strong>Q1<\/strong>.
