Act\u00a0<strong>is a legal framework<\/strong> introduced in India\u00a0<strong>to safeguard the personal data of individuals<\/strong> and\u00a0<strong>ensure that their data is shared only with their consent.\u00a0<\/strong><\/li>\n<li>It r<strong>egulates the processing of digital personal data\u00a0<\/strong>and outlines various provisions to protect individuals\u2019 privacy in the digital age.<\/li>\n<li><strong>Applicability:<\/strong>\n<ul>\n<li>It\u00a0<strong>applies to the processing of digital personal data within the territory of Indi<\/strong>a\u00a0<strong>collected online or collected offline\u00a0<\/strong>and later digitized.<\/li>\n<li>It is\u00a0<strong>also applicable to processing digital personal data outside the territory of India, if it involves providing goods<\/strong> or services t<strong>o the data principals within<\/strong> the territory of\u00a0<strong>India<\/strong>.\u00a0<\/li>\n<\/ul>\n<\/li>\n<li><strong>Evolution<\/strong>:\n<ul>\n<li>The c<strong>onceptual basis of the DPDP Act is the report of the Expert Committee\u00a0<\/strong>set up under the\u00a0<strong>chairmanship of Justice BN Srikrishna<\/strong>, which led to the introduction of the\u00a0<strong>Personal Data Protection Act in 2019.\u00a0<\/strong><\/li>\n<li><strong>After several iterations and consultations, the Digital Personal Data Protection Act, 2023, was introduced<\/strong> and subsequently passed by both the Lok Sabha and the Rajya Sabha.\u00a0<\/li>\n<\/ul>\n<\/li>\n<li><strong>Key Stakeholders:<\/strong>\n<ul>\n<li><strong>Data Principal (DP): \u2013 the data owner.<\/strong>\n<ul>\n<li>DP could be\u00a0<strong>individuals or entities whose data is to be protected.<\/strong><\/li>\n<li>The DP\u00a0<strong>has to give written consent to generate and process the data\u00a0<\/strong>indicating the specific purpose of its use.<\/li>\n<li>DP\u00a0<strong>can withdraw the consent at any time<\/strong> or can restrict its use.\u00a0<\/li>\n<\/ul>\n<\/li>\n<li><strong>Data Fiduciary\u2013 A data collecting, storing, and sharing entity.<\/strong><\/li>\n<li>A data fiduciary\u00a0<strong>also acts as a \u201cConsent Manager\u201d<\/strong> who<strong> enables a DP to give, manage,\u00a0<\/strong>review, and withdraw\u00a0<strong>consent through an accessible,\u00a0<\/strong>transparent, a<strong>nd interoperable platform.<\/strong><\/li>\n<li>The\u00a0<strong>Central Government may notify any Data Fiduciary or class of Data Fiduciaries as Significant Data Fiduciaries<\/strong>, on the basis of an assessment of relevant factors when they turn out to be systemically significant.\u00a0<\/li>\n<li><strong>Data Processor\u2013an entity processing the data on behalf of a data fiduciary<\/strong>.\u00a0<strong>Both Data fiduciary and data processor could also be the same\u00a0<\/strong>in certain small entities.\u00a0<\/li>\n<li><strong>Data Protection Officer (DPO)<\/strong>:\u00a0 \u2013\u00a0<strong>could be any individual appointed as DPO by a Data Fiduciary<\/strong> under the provisions of this Act.\u00a0<\/li>\n<\/ul>\n<\/li>\n<li><strong>Other Provisions:<\/strong>\n<ul>\n<li><strong>Citizen\u2019s Rights:<\/strong> Under data principal rights, individuals also have the\u00a0<strong>right to information, right to correction and erasure, right to grievance redressal, and right to nominate\u00a0<\/strong>any other person to exercise these rights in the event of the individual\u2019s death or incapacity.<\/li>\n<li><strong>Establishment of a Data Protection Board of India (DPBI):\u00a0<\/strong>\n<ul>\n<li>It will function as an\u00a0<strong>impartial adjudicatory body responsible for resolving privacy-related grievances and disputes<\/strong> between relevant parties.<\/li>\n<li>As an\u00a0<strong>independent regulator<\/strong>, it will\u00a0<strong>possess the authority to ascertain instances of non-compliance with the Act\u2019s<\/strong> provisions\u00a0<strong>and impose penalties<\/strong> accordingly.\u00a0<\/li>\n<li><strong>The appointment of the chief executive and board members\u00a0<\/strong>of the Data Protection Board will be carried out\u00a0<strong>by the central government.<\/strong><\/li>\n<li><strong>An appeal against any order\u00a0<\/strong>of the DPBI shall\u00a0<strong>lie with the High Court.<\/strong> The\u00a0<strong>High Court could take up any breach Suo moto.<\/strong>\u00a0<\/li>\n<li><strong>No civil court shall have the jurisdiction to entertain any suit\u00a0<\/strong>or take any action in respect of any matter\u00a0<strong>under the provisions of this Act\u00a0<\/strong>and\u00a0<strong>no injunction shall be granted by any court\u00a0<\/strong>or other authority i<strong>n respect of any action taken under the provisions of this Act.\u00a0\u00a0<\/strong><\/li>\n<\/ul>\n<\/li>\n<li><strong>Penalty for infringement:\u00a0<\/strong><\/li>\n<li>The Act\u00a0<strong>does not impose criminal penalties<\/strong> for non-compliance.<\/li>\n<li><strong>The financial penalty could range from as high as Rs. 250 crores to a data fiduciary\u00a0<\/strong>or data processor\u00a0<strong>to as low as Rs.10000 to a data principal<\/strong> (the owner of data).<\/li>\n<li><strong>Conflict with existing laws:\u00a0<\/strong><\/li>\n<li><strong>T<\/strong>he provisions of the DPDP Act will be i<strong>n addition to and not supersede any other law currently in effect.\u00a0<\/strong><\/li>\n<li><strong>However, in case of any conflict\u00a0<\/strong>between a provision of this Act and a provision of any other law currently in effect,\u00a0<strong>the provision of this Act shall take precedence to the extent of such conflict.<\/strong><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<hr \/>\n<h3>Q1) What is an adjudicatory body?<\/h3>\n<p>An adjudicatory body is an organization, tribunal, or panel established to make legal judgments, decisions, or rulings on specific matters or disputes. These bodies are typically responsible for resolving disputes, interpreting and applying laws and regulations, and ensuring fair and impartial decision-making in various areas of law and governance.
