{"id":15135,"date":"2023-09-24T01:47:33","date_gmt":"2023-09-23T20:17:33","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=15135"},"modified":"2025-04-03T08:47:51","modified_gmt":"2025-04-03T03:17:51","slug":"cofeposa","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/cofeposa\/","title":{"rendered":"Conservation of Foreign Exchange and Prevention of Smuggling Activities (COFEPOSA) Act, 1974"},"content":{"rendered":"<h2><strong>About COFEPOSA Act:<\/strong><\/h2>\n<ul>\n<li>It was passed by the Parliament on 13th December 1974, to\u00a0<strong>provide for preventive detention\u00a0<\/strong>in certain cases\u00a0<strong>for the purposes of conservation and augmentation of foreign exchange<\/strong>\u00a0<strong>and prevention of smuggling activities<\/strong> and for matters connected therewith.<\/li>\n<li><strong>Power to make orders detaining certain persons:\u00a0<\/strong>The<strong> Central Government or the State Government<\/strong> or any\u00a0<strong>joint secretary of central government<\/strong>\u00a0<strong>and secretary of state government can order<\/strong> the detention of a person (including a foreigner),<strong> in case of-<\/strong>\n<ul>\n<li><strong>Smuggling;<\/strong><\/li>\n<li>\u00a0<strong>Abetting smuggling<\/strong>;<\/li>\n<li><strong>Transport, concealing, storing<\/strong>;<\/li>\n<li><strong>Harbouring persons involved in smuggling<\/strong>;<\/li>\n<li><strong>Dealing in smuggled goods;<\/strong><\/li>\n<\/ul>\n<\/li>\n<li><strong>Any order by the State government<\/strong> is to be\u00a0<strong>forwarded to the Central government within 10 days<\/strong>.<\/li>\n<li><strong>Grounds for detention are to be communicated within 5 days to detenu<\/strong>. Delay of up to 15 days is allowed if the reason is given in writing.<\/li>\n<li>The\u00a0<strong>detaining authority requires to satisfy the courts and also the detenu that he has acted in accordance with the laws<\/strong> with due consideration.<\/li>\n<li><strong>High Courts can examine detention orders prior to execution<\/strong>. A\u00a0<strong>detention order cannot be challenged at pre execution stage on the grounds of delay in execution<\/strong>.<\/li>\n<li>The\u00a0<strong>order can be executed anywhere in India,<\/strong> similar to arrest warrants under the Code of Criminal Procedure, 1973.<\/li>\n<li><strong>Advisory Boards<\/strong>:\n<ul>\n<li><strong>Government should, within 5 weeks\u00a0<\/strong>of the<strong>\u00a0<\/strong>date of detention,\u00a0<strong>make a reference to the Advisory Board.<\/strong><\/li>\n<li><strong>Advisory Board to report within 11 weeks of the detention order<\/strong>.\u00a0<strong>If satisfied, the detention period can be extended to one year.<\/strong><\/li>\n<li><strong>If<\/strong>, in the opinion of the advisory board,\u00a0<strong>there is insufficient cause for detention, the order is revoked, and the person is released.<\/strong><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h3>Other Preventive detention Laws in India:-<\/h3>\n<ul>\n<li>National Security Act (NSA), 1980<\/li>\n<li>Unlawful Activities (Prevention) Act (UAPA) of 1967<\/li>\n<li>Prevention of Illicit Traffic in Narcotic Drugs and Psychotropic Substances (PITNDPS) Act, 1988<\/li>\n<li>Prevention of Black marketing and Maintenance of Supplies of Essential Commodities Act, 1980<\/li>\n<li>Maintenance of Internal Security Act (MISA)<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<hr \/>\n<h3>Q1) What is Preventive Detention?<\/h3>\n<p>Preventive detention refers to the detention of an individual without a trial or conviction by a court.\u00a0 The primary objective of preventive detention is not to punish an individual for a past offense but to prevent them from committing an offense in the future.
