{"id":15245,"date":"2025-01-07T06:19:54","date_gmt":"2025-01-07T00:49:54","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=15245"},"modified":"2025-04-03T09:32:13","modified_gmt":"2025-04-03T04:02:13","slug":"aft","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/aft\/","title":{"rendered":"Armed Forces Tribunal (AFT)"},"content":{"rendered":"<h2><strong>About Armed Forces Tribunal (AFT):<\/strong><\/h2>\n<ul>\n<li>AFT is a\u00a0<strong>military tribunal<\/strong>\u00a0in India\u00a0<strong>established under the Armed Forces Tribunal Act, 2007.<\/strong><\/li>\n<li>It is functioning under the\u00a0<strong>Ministry of Defence (MoD).<\/strong><\/li>\n<li>It is responsible for\u00a0<strong>resolving military-related disputes, including service matters<\/strong>\u00a0and\u00a0<strong>appeals from court-martial decisions.\u00a0<\/strong><\/li>\n<li><strong>Functions:<\/strong>\n<ul>\n<li>To provide for the\u00a0<strong>adjudication or trial of disputes<\/strong>\u00a0and complaints\u00a0<strong>with respect to<\/strong>\u00a0commission, appointments, enrolment, and\u00a0<strong>conditions of service<\/strong>\u00a0in respect of persons subject to the\u00a0<strong>Army Act, 1950; the Navy Act, 1957; and the Air Force Act, 1950.<\/strong><\/li>\n<li>To\u00a0<strong>provide for appeals<\/strong>\u00a0arising out of orders, findings, or sentences\u00a0<strong>of courts-martial<\/strong>\u00a0held under the said Acts and for matters connected therewith or incidental thereto.<\/li>\n<li>The tribunal can also dismiss the appeal if the court martial findings are found to be justified.<\/li>\n<\/ul>\n<\/li>\n<li>Thus, the tribunal has\u00a0<strong>original jurisdiction in service matters<\/strong>\u00a0and\u00a0<strong>appellate jurisdiction in court martial matters.<\/strong><\/li>\n<li><strong>Any appeal<\/strong>\u00a0by a person\u00a0<strong>against a decision given by the tribunal<\/strong>\u00a0can\u00a0<strong>only be taken up in the Supreme Court.<\/strong><\/li>\n<li><strong>Benches<\/strong>: Besides the\u00a0<strong>principal bench in New Delhi<\/strong>, AFT has regional benches at Chandigarh, Lucknow, Kolkata, Guwahati, Chennai, Kochi, Mumbai, Jabalpur, Srinagar, and Jaipur.<\/li>\n<li><strong>Composition<\/strong>:\n<ul>\n<li><strong>Each Bench c<\/strong>omprises of\u00a0<strong>a Judicial Member and an Administrative Member.<\/strong><\/li>\n<li>The\u00a0<strong>Judicial Members<\/strong>\u00a0are\u00a0<strong>retired High Court Judges<\/strong>, and\u00a0<strong>Administrative Members<\/strong>\u00a0are\u00a0<strong>retired Members of the Armed Forces<\/strong>\u00a0who have held the rank of Major General\/equivalent or above for a period of three years or more.<\/li>\n<li>Judge Advocate General (JAG), who has held the appointment for at least one year, are also entitled to be appointed as the Administrative Member.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Functioning:<\/strong>\n<ul>\n<li>The Tribunal shall transact their\u00a0<strong>proceedings as per the Armed Forces Tribunal (Procedure) rules, 2008.\u00a0<\/strong><\/li>\n<li><strong>All proceedings<\/strong>\u00a0in the Tribunal will be\u00a0<strong>in English.\u00a0<\/strong><\/li>\n<li>The Tribunal will normally\u00a0<strong>follow the procedure as is practiced in the High Courts<\/strong>\u00a0of India.\u00a0<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<hr \/>\n<h2><strong>Q1<\/strong>: What is a Tribunal?<\/h2>\n<p>A tribunal is a quasi-judicial institution that deals with the resolution of disputes pertaining to administration, taxation, environment, securities, etc. Tribunals in India are adjudicatory bodies that serve as an alternative to the traditional court system.
