


{"id":15393,"date":"2023-09-30T04:42:45","date_gmt":"2023-09-29T23:12:45","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=15393"},"modified":"2025-04-03T10:30:08","modified_gmt":"2025-04-03T05:00:08","slug":"pocso","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/pocso\/","title":{"rendered":"What is the Protection of Children from Sexual Offences (Pocso) Act?"},"content":{"rendered":"<h2><strong>About Protection of Children from Sexual Offences (Pocso) Act:<\/strong><\/h2>\n<ul>\n<li>It is the\u00a0<strong>first comprehensive law<\/strong> in India de<strong>aling specifically with the sexual abuse of children<\/strong>, enacted in 2012.<\/li>\n<li>It is\u00a0<strong>administered by the Ministry of Women and Child Development (MoWCD<\/strong>).<\/li>\n<li><strong>Objective<\/strong>: The Act was designed\u00a0<strong>to protect children aged less than 18 from sexual assault, sexual harassment, and pornography offences<\/strong> and provide for the establishment of Special Courts for the trial of such offences and related matters and incidents.<\/li>\n<li><strong>Salient Features:<\/strong>\n<ul>\n<li><strong>Gender-neutral law:<\/strong> The POCSO Act establishes a gender-neutral tone for the legal framework available to child sexual abuse victims by\u00a0<strong>defining a child as \u201cany person\u201d under the age of 18.<\/strong><\/li>\n<li>It\u00a0<strong>defines various types of sexual abuse<\/strong>, such as penetrative and non-penetrative assault, as well as sexual harassment and pornography.<\/li>\n<li>It\u00a0<strong>considers a sexual assault to be aggravated in certain circumstances<\/strong>, such as\u00a0<strong>when the abused child is mentally ill or when the abuse is committed by someone in a position of trust<\/strong> or authority over the child, such as a family member, etc.<\/li>\n<li><strong>People who traffic children for sexual purposes are also punishable\u00a0<\/strong>under the provisions relating to abetment in the Act.\u00a0<\/li>\n<li><strong>The attempt to commit an offence under the Act has been made liable for punishment<\/strong> for upto half the punishment prescribed for the commission of the offence.<\/li>\n<li><strong>No time limit for reporting abuse:\u00a0<\/strong>A victim can report an offence at any time, even a number of years after the abuse has been committed.<\/li>\n<li><strong>Mandatory reporting:\u00a0<\/strong>The Act also makes it the l<strong>egal duty of a person aware of the offence to report sexual abuse. In case s\/he fails to do so, the person can be punished<\/strong> with six months imprisonment or a fine.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Safeguards to victims:\u00a0<\/strong>The Act incorporates child-friendly procedures for reporting, recording of evidence, investigation and trial of offences.
