Leave Petition"},"content":{"rendered":"<h2><b>Special Leave Petition Latest News<\/b><\/h2>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">The Jammu &amp; Kashmir and Ladakh High Court recently observed that dismissal of a Special Leave Petition (SLP), whether by a speaking or non-speaking order, does not lead to merger of the impugned order with the Supreme Court&#8217;s order.<\/span><\/p>\n<h2><b>About Special Leave Petition<\/b><\/h2>\n<ul>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">A SLP is a <\/span><b>request made to the Supreme Court <\/b><span style=\"font-weight: 400;\">of India <\/span><b>seeking special permission to appeal against any judgment, order, or decree from any court or tribunal (except military tribunals), <\/b><span style=\"font-weight: 400;\">even when the law does not provide a statutory right of appeal.<\/span><\/li>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">In other words, SLP is <\/span><b>not a right<\/b><span style=\"font-weight: 400;\">\u2014it&#8217;s a <\/span><b>privilege granted by the Supreme Court at its discretion.<\/b><\/li>\n<li style=\"text-align: justify;\"><b>Article 136<\/b><span style=\"font-weight: 400;\"> states that the Supreme Court may, in its discretion, grant special leave to appeal from any judgment, decree, determination, or order from any court or tribunal in India.<\/span><\/li>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">It can <\/span><b>only be exercised when a substantial question of law or gross injustice<\/b><span style=\"font-weight: 400;\"> has been committed.<\/span><\/li>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">A judgement, decree, or order need not be final for an SLP. <\/span><b>An interim or interlocutory order, decree, or judgement can also be challenged.<\/b><\/li>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">It is a <\/span><b>discretionary\/optional power <\/b><span style=\"font-weight: 400;\">of the <a href=\"https:\/\/vajiramandravi.com\/upsc-exam\/supreme-court-of-india\/\" target=\"_blank\"><strong>SC<\/strong><\/a>, and the <\/span><b>court can refuse <\/b><span style=\"font-weight: 400;\">to grant the appeal at its discretion.\u00a0<\/span><\/li>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">The<\/span><b> aggrieved party can\u2019t affirm a special leave <\/b><span style=\"font-weight: 400;\">to offer under Article 136 <\/span><b>as a right.<\/b><\/li>\n<li style=\"text-align: justify;\"><b>SLP can be filed by:<\/b>\n<ul>\n<li style=\"text-align: justify;\"><b>Any aggrieved party (<\/b><span style=\"font-weight: 400;\">individual or business)<\/span><\/li>\n<li style=\"text-align: justify;\"><b>Government bodies<\/b><\/li>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Public sector undertakings<\/span><\/li>\n<li style=\"text-align: justify;\"><b>NGOs <\/b><span style=\"font-weight: 400;\">or associations (in relevant cases)<\/span>\n<ul>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">The key requirement is that the<\/span><b> party must be aggrieved by the impugned judgment<\/b><span style=\"font-weight: 400;\"> or order.<\/span><\/li>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">An SLP can be filed for any <\/span><b>civil or criminal matter<\/b><span style=\"font-weight: 400;\">, etc.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">SLP can be<\/span><b> filed against judgments from:<\/b>\n<ul>\n<li style=\"text-align: justify;\"><b>High Courts<\/b><\/li>\n<li style=\"text-align: justify;\"><b>Tribunals (except those under armed forces)<\/b><\/li>\n<li style=\"text-align: justify;\"><b>Quasi-judicial bodies<\/b><\/li>\n<\/ul>\n<\/li>\n<li style=\"text-align: justify;\"><b>Time limit to file SLP:<\/b>\n<ul>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">It can be filed <\/span><b>against any judgment of the High Court within 90 days <\/b><span style=\"font-weight: 400;\">from the date of judgment or<\/span><\/li>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">It can be filed <\/span><b>within 60 days against the order of the High Court refusing to grant the certificate of fitness for appeal to SC.<\/b><\/li>\n<\/ul>\n<\/li>\n<li style=\"text-align: justify;\"><b>Procedure for a SLP:<\/b>\n<ul>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">A SLP <\/span><b>must contain all the facts <\/b><span style=\"font-weight: 400;\">upon which the SC is to decide, which revolve around the grounds on which an SLP can be filed.\u00a0<\/span><\/li>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">The said petition needs to be duly <\/span><b>signed by an Advocate-on-Record.<\/b><\/li>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">The petitioner must include a statement within the SLP stating that no other petition has been filed in a High Court.<\/span><\/li>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Once the petition is filed, the SC will hear the aggrieved party and depending upon the merits of the case, will allow the opposite party to state their part in a counter affidavit.<\/span><\/li>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">After the hearing, if the court deems the case fit for further hearing, it will allow the same; otherwise it will reject the appeal.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><strong>Source: <a
