{"id":16157,"date":"2023-10-22T07:16:34","date_gmt":"2023-10-22T01:46:34","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=16157"},"modified":"2025-04-03T22:43:56","modified_gmt":"2025-04-03T17:13:56","slug":"designation-of-senior-advocates","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/designation-of-senior-advocates\/","title":{"rendered":"Guidelines for Designation of Senior Advocates by the Supreme Court of India, 2023"},"content":{"rendered":"<h2>Who is a Senior Advocate?<\/h2>\n<ul>\n<li>Under Section 16 of the\u00a0Advocates Act 1961,\u00a0two classes of advocates are classified:\u00a0Senior Advocate and Junior or those who are not designated as seniors.<\/li>\n<li>The senior advocates play the role of\u00a0legal experts in India\u00a0who have significant knowledge in the field of law.<\/li>\n<li>They are\u00a0associated with many prominent cases as they are good contributors to the principle of the Rule of Law.<\/li>\n<li>Special Provisions:\n<ul>\n<li>A senior advocate\u00a0shall not appear without an advocate on record in the SC or\u00a0without an advocate in any\u00a0other court.<\/li>\n<li>A senior advocate\u00a0shall not accept instructions to draft pleadings or affidavits,\u00a0advice on evidence, or to do any drafting work of an analogous kind in any Court or Tribunal or\u00a0before any person or other authority.<\/li>\n<li>A senior advocate\u00a0shall not accept directly from a client any brief or instructions\u00a0to appear in any Court\u00a0or Tribunal or before any person\u00a0or other authority in India.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h2>Guidelines for Designation of Senior Advocates by the Supreme Court of India, 2023<\/h2>\n<ul>\n<li>The candidates need to be\u00a0at least ten years&#8217; standing as an Advocate or ten years&#8217; combined standing as an Advocate and as a District and Sessions Judge or as a Judicial Member of any Tribunal in India to be designated as Senior Advocates at the SC.<\/li>\n<li>They\u00a0must practice mainly in the Supreme Court,\u00a0but advocates with domain expertise in\u00a0practising before specialised tribunals\u00a0may be\u00a0given concession.<\/li>\n<li>The age limit\u00a0for applying for the designation of senior advocate is now 45 years, unless the age limit is relaxed.<\/li>\n<li>The age limit can be relaxed by the Committee for Designation of Senior Advocates\u00a0or if the name\u00a0has been recommended by the Chief Justice of India\u00a0or a SC judge.<\/li>\n<li>Criteria:\n<ul>\n<li>The new guidelines have a\u00a0revised point system for evaluating candidates.<\/li>\n<li>The new criteria\u00a0include the number of years of practice and the body of work.<\/li>\n<\/ul>\n<\/li>\n<li>Number of years of practice:\u00a0Applicants will get a\u00a0maximum of 20 points,\u00a010 points for 10 years of practice, and\u00a01 point each for\u00a0every\u00a0additional year of practice.<\/li>\n<li>Judgements reported and unreported; pro bono work; domain expertise (such as constitutional:\u00a050 points<\/li>\n<li>Publication of academic articles, experience of\u00a0teaching assignments in the field of law,\u00a0guest lectures delivered in law schools and professional institutions connected with law:\u00a05 points<\/li>\n<li>Test of personality\u00a0and suitability based on the interview: 25 points<\/li>\n<li>Selection:\n<ul>\n<li>The selection for the designation of senior advocates will be\u00a0done by the Committee for Designation of Senior Advocates. The Committee is\u00a0headed by CJI as the Chairperson.<\/li>\n<li>The\u00a0applications will be invited once a year, and the\u00a0committee will meet twice a year.<\/li>\n<li>It will\u00a0also have a permanent secretariat, whose members will be selected by the CJI and the committee.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<hr \/>\n<h3>Q1) What is the Rule of Law?<\/h3>\n<p>In general, the rule of law implies that the creation of laws, their enforcement, and the relationships among legal rules are themselves legally regulated, so that no one\u2014including the most highly placed official\u2014is above the law.
