Those who have\u00a0attained legal adulthood, possess\u00a0full mental capacity, and are not legally prohibited from transferring property\u00a0are considered &#8220;competent, competent, and eligible individuals&#8221;\u00a0under the law.<\/li>\n<li>Delivery of Possession: The Act\u00a0requires that property transfers include possession delivery. It means the\u00a0transferor must give the transferee physical possession of the property. This requirement is essential for the validity of the transfer\u00a0and\u00a0must be met for the transfer to be legally recognised.<\/li>\n<li>Registration of Document: The Act\u00a0requires that the transfer of property\u00a0be documented and registered with the appropriate authorities. It ensures that\u00a0the\u00a0transfer is legally binding and that the rights of both parties are protected.<\/li>\n<li>Performance of Contract:\u00a0Under the Act, the\u00a0transferor is legally obligated to meet all sales agreement terms. It includes passing over custody of the items, paying any payments due, and providing any required paperwork. A\u00a0breach of contract will result in possible legal action if this is not done.\u00a0<\/li>\n<li>The rule against perpetuity: Property must be transferred during the lifetime of an individual, as the\u00a0perpetuity rule cannot be\u00a0followed. A property\u00a0cannot be transferred to an unborn child, and it is necessary to consider that\u00a0while transferring\u00a0the interest of the property,\u00a0the person should be above the age of 18 years<\/li>\n<li>For property transfer, the property should be \u2018transferrable\u2019.\u00a0Some properties,\u00a0like the right to sue, the right to future maintenance, stipends to the air force\/navy\/political prisoners\/civil pensioners, and the chance of an heir-apparent to succeed to an estate,\u00a0are not transferrable.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<hr \/>\n<h3>Q1) What are Immovable properties?<\/h3>\n<p>Immovable property is anything attached to the land, such as plants or trees.
