


{"id":16498,"date":"2023-10-31T06:06:20","date_gmt":"2023-10-31T00:36:20","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=16498"},"modified":"2025-04-04T19:48:51","modified_gmt":"2025-04-04T14:18:51","slug":"ipc","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/ipc\/","title":{"rendered":"What is Section 295A of the Indian Penal Code (IPC)?"},"content":{"rendered":"<h2>About Section 295A of IPC<\/h2>\n<ul>\n<li>The object of Section 295-A is to\u00a0punish deliberate and malicious acts intended to outrage\u00a0the\u00a0religious feelings of any class\u00a0by insulating its religion or religious beliefs.<\/li>\n<li>This section\u00a0only punishes an aggravated form of insult to religion\u00a0when it is perpetrated\u00a0with the deliberate and malicious intention of outraging the religious feelings of a class.<\/li>\n<li>Ingredients of Section 295-A:\n<ul>\n<li>The\u00a0accused must insult or attempt to insult the religion\u00a0or religious\u00a0beliefs of any class of citizens of India.<\/li>\n<li>The\u00a0said insult must be made with a deliberate and malicious intention of outraging the religious feelings of the said class of citizens.<\/li>\n<li>The said insult must be\u00a0by words, either spoken or written, by signs, or by visible representation, or otherwise.<\/li>\n<li>Section 295A IPC is a\u00a0cognisable, non-bailable, and non-compoundable offence,\u00a0and\u00a0police can register an FIR anywhere in the country\u00a0at the instance of purportedly aggrieved complainants.<\/li>\n<\/ul>\n<\/li>\n<li>What has the Supreme Court ruled?\n<ul>\n<li>In 1957, a Constitution Bench of the Supreme Court\u00a0upheld the constitutionality of the said section in \u2018Ramji Lal Modi v. State of U.P.\u2019\u00a0<\/li>\n<li>The Court\u00a0held that Section\u00a0295A IPC\u00a0does not penalize any and every act\u00a0of insult to or attempt to insult any religion or the religious beliefs of a class of citizens.\u00a0<\/li>\n<li>The Court cautioned that only those acts of insults or attempts to so insult can be penalized under this provision\u00a0which is perpetrated with the deliberate and malicious intention of outraging the religious feelings of that class.<\/li>\n<li>The Court further clarified that the provision would only\u00a0apply to such\u00a0aggravated\u00a0forms of insult to religion\u00a0that are\u00a0calculated to disrupt the public order.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<hr \/>\n<h3>Q1) What is a non-compoundable offence?<\/h3>\n<p>Compoundable offences are minor crimes where the victim can agree to drop charges through compromise.
