


{"id":16682,"date":"2023-11-05T12:25:03","date_gmt":"2023-11-05T06:55:03","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=16682"},"modified":"2025-04-04T22:35:22","modified_gmt":"2025-04-04T17:05:22","slug":"dv-act","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/dv-act\/","title":{"rendered":"Protection of Women from Domestic Violence Act, 2005 (DV Act)"},"content":{"rendered":"<h2>About Protection of Women from Domestic Violence Act 2005 (DV Act)<\/h2>\n<ul>\n<li>The\u00a0DV Act was enacted by Parliament on September 13, 2005, and\u00a0extends to the whole of India.<\/li>\n<li>It is basically meant to\u00a0provide protection to\u00a0a wife or female live-in partner\u00a0from violence at the\u00a0hands of the\u00a0husband, or a male live-in-partner,\u00a0or his relatives.\u00a0<\/li>\n<li>Domestic violence under the Act\u00a0includes actual abuse or the threat of abuse, whether\u00a0physical, sexual, verbal, emotional, or economic.<\/li>\n<li>Harassment by way of dowry demands is also covered under the definition of domestic violence.<\/li>\n<li>Who is covered under the Act?\n<ul>\n<li>The Act covers\u00a0all women who may be\u00a0mother, sister, wife, widow, or partners living in a shared household.<\/li>\n<li>The\u00a0relationship may be in the nature of marriage or adoption.<\/li>\n<li>In addition,\u00a0relationships with family members living together as a joint family are\u00a0also included.\u00a0<\/li>\n<\/ul>\n<\/li>\n<li>Who can file a complaint?\n<ul>\n<li>Any woman\u00a0who alleges\u00a0to have\u00a0been subjected to any act of\u00a0domestic violence by the offender or any person may file a complaint on her behalf.<\/li>\n<li>A\u00a0child is also entitled\u00a0to relief under the\u00a0DV Act.\u00a0The\u00a0mother of such a child\u00a0can make an application on behalf of her minor child (whether male or female).\u00a0<\/li>\n<li>In cases where the mother makes\u00a0an\u00a0application to the court\u00a0for herself, the\u00a0children can also\u00a0be added as co-applicants.<\/li>\n<li>However,\u00a0no female relative\u00a0of the husband or the male partner\u00a0can file a complaint against the wife or the female partner.<\/li>\n<\/ul>\n<\/li>\n<li>Against whom can a complaint be filed?\n<ul>\n<li>Any adult male member\u00a0who has been in a\u00a0domestic relationship with the\u00a0woman<\/li>\n<li>Relatives of the husband or the male partner (Includes\u00a0both male and female\u00a0relatives of the male partner)<\/li>\n<\/ul>\n<\/li>\n<li>Remedies available: Under the law, women can apply for reliefs such as\n<ul>\n<li>Protection Order<\/li>\n<li>Residence Order for residing at Matrimonial House<\/li>\n<li>Monetary Orders, which include maintenance for herself and her children<\/li>\n<li>Temporary custody\u00a0of\u00a0children<\/li>\n<li>Compensation order for the damages caused to her<\/li>\n<\/ul>\n<\/li>\n<li>It is\u00a0only when the relief\u00a0granted\u00a0by the\u00a0courts\u00a0is breached that\u00a0criminal action is taken against the respondent.<\/li>\n<li>Protection Officers:\n<ul>\n<li>Under the DV Act, Protection Officers have been\u00a0appointed by the Government\u00a0to help\u00a0the aggrieved\u00a0woman in filing the case.<\/li>\n<li>They are to be\u00a0attached to the Magistrates of\u00a0the courts\u00a0for the area notified for each protection officer.<\/li>\n<li>The Protection Officer\u00a0facilitates the women to approach the court by\u00a0providing legal aid and get appropriate relief from the courts concerned.\u00a0<\/li>\n<li>Further,\u00a0they\u00a0execute the orders of the Court\u00a0wherever necessary\u00a0with the help of the police.<\/li>\n<li>Options\u00a0are also\u00a0available\u00a0to the\u00a0aggrieved person\u00a0to file the petition before the\u00a0Judicial Magistrate Court,\u00a0or\u00a0with the\u00a0service provider, or\u00a0at a nearby police station.<\/li>\n<\/ul>\n<\/li>\n<li>Service Providers:\n<ul>\n<li>Under the DV Act, Service Providers are\u00a0members of notified Non Governmental Organizations.\u00a0<\/li>\n<li>They\u00a0co-ordinate\u00a0with all the\u00a0stakeholders to get justice and relief\u00a0for the victims\u00a0of domestic violence.<\/li>\n<li>They\u00a0help the aggrieved women in filing the Domestic Incident Report,\u00a0provide accommodation in the short-stay homes along with their children,\u00a0counsel them, and\u00a0help the aggrieved get medical treatment if necessary.\u00a0<\/li>\n<li>They also\u00a0impart them with vocational training to help them secure employment and sustainable income.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<hr \/>\n<h3>Q1) What is a Non Governmental Organization (NGO)?<\/h3>\n<p>An NGO is a group that functions independently of any government. It is usually non-profit.
