


{"id":16768,"date":"2023-11-07T11:27:54","date_gmt":"2023-11-07T05:57:54","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=16768"},"modified":"2025-04-04T23:06:14","modified_gmt":"2025-04-04T17:36:14","slug":"crpc","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/crpc\/","title":{"rendered":"What is Section 437A of the Code of Criminal Procedure (CrPC)?"},"content":{"rendered":"<h2>About Section 437A of the Code of Criminal Procedure (CrPC)<\/h2>\n<ul>\n<li>Section 437A of the CrPC\u00a0requires a person who has been acquitted\u00a0to furnish a bail bond and sureties,\u00a0to be able to be released from custody.<\/li>\n<li>This is to\u00a0ensure the appearance of the accused if an appeal is filed before a higher court\u00a0against the acquittal.<\/li>\n<li>The provision states that\u00a0accused persons must execute bail bonds\u00a0with sureties to appear before the higher court\u00a0when an appeal or petition is filed against the judgment\u00a0of\u00a0the respective court.<\/li>\n<li>These bail bonds\u00a0are valid for six months, and\u00a0failure to appear leads to bond forfeiture\u00a0and the\u00a0application of Section 446\u00a0procedures.<\/li>\n<li>Section 446 CrPC :\n<ul>\n<li>It provides that once the court records its satisfaction about the forfeiture of the bond, it shall call upon the person bound by such bond to pay the penalty or to show cause why it should not be paid.<\/li>\n<li>If sufficient cause is not shown and the penalty is not paid, the\u00a0Court may proceed to recover the same\u00a0as if such penalty were a fine imposed by it under this Code.<\/li>\n<\/ul>\n<\/li>\n<li>Neither before the trial court nor before the\u00a0appellate court, there is any applicability of Section-437A\u00a0CrPC\u00a0in cases where\u00a0the accused is convicted.<\/li>\n<li>As such, the\u00a0only time\u00a0when the court is required to\u00a0ask\u00a0the accused to\u00a0execute bonds is\u00a0the time when the court acquits the accused.<\/li>\n<\/ul>\n<h2>What is Acquittal under CrPC?<\/h2>\n<ul>\n<li>The term &#8220;acquittal&#8221; refers to a\u00a0judge&#8217;s decision that legally confirms the innocence of the accused.<\/li>\n<li>As a result,\u00a0it is granted when the\u00a0court determines that the\u00a0accused did not commit the crime charged against him.\u00a0<\/li>\n<li>It\u00a0means the prosecutor was unable to persuade the judge that\u00a0the case was beyond a reasonable doubt.<\/li>\n<li>If the\u00a0judge concludes that there is no evidence that the accused committed the crime\u00a0after evaluating the prosecution&#8217;s evidence, the\u00a0judge acquits the accused person\u00a0under Section 232.<\/li>\n<li>If the offender is not acquitted under Section 232, however, he is allowed to present his case and evidence.
