


{"id":16808,"date":"2024-08-12T08:37:20","date_gmt":"2024-08-12T03:07:20","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=16808"},"modified":"2025-04-04T23:21:37","modified_gmt":"2025-04-04T17:51:37","slug":"section-27","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/section-27\/","title":{"rendered":"What is Section 27 of the Indian Evidence Act?"},"content":{"rendered":"<h2><strong>About Section 27 of the Indian Evidence Act:<\/strong><\/h2>\n<ul>\n<li>This section creates an <strong>exception to<\/strong> the <strong>admissibility of confession<\/strong> made <strong>by the accused <\/strong>to a police officer <strong>while in custody.<\/strong><\/li>\n<li><strong>Sections 25 and 26<\/strong> establish <strong>protection against self-incrimination<\/strong> and abuse of power by the police authority, <strong>deeming confessions made in police custody without<\/strong> the <strong>presence of a magistrate <\/strong>as <strong>inadmissiblebe forea court<\/strong> of law.<\/li>\n<li>However, <strong>Section 27<\/strong> provides an <strong>exception to this rule<\/strong>, <strong>allowing<\/strong> the <strong>admission of confessions that lead to <\/strong>the <strong>discovery of facts.<\/strong><\/li>\n<li>Section 27 states: &#8220;Provided that, when any fact is deposed to as discovered in consequence of information received from a person accused of any offence, in the custody of a police officer, so much of such information, whether it amounts to a confession or not, as relates distinctly to the fact thereby discovered, may be proved.&#8221;<\/li>\n<li>In simpler terms, any <strong>confession made<\/strong> by a person while <strong>in police custody that leads to<\/strong> the <strong>revelation of a fact<\/strong> is considered <strong>admissible in court.<\/strong>\n<ul>\n<li>The confession <strong>must provide information <\/strong>that was <strong>not previously known<\/strong> to the police <strong>and that led to the recovery of evidence<\/strong> or the identification of witnesses.<\/li>\n<li>The confession <strong>must be directly related to the fact discovered<\/strong>. This means that the information provided in the confession must be specific and relevant to the discovery.<\/li>\n<li>The confession <strong>must be made voluntarily<\/strong>. This means that the person must not have been coerced or threatened into making the confession.<\/li>\n<\/ul>\n<\/li>\n<li>The <strong>basic idea <\/strong>embedded in Section 27 of the Evidence Act <strong>is the doctrine of confirmation by subsequent events.<\/strong>\n<ul>\n<li>This doctrine is founded on the <strong>principle that every part ofthestatement <\/strong>made at the instance of the<strong> accused, ina<\/strong> po<strong>lice custody should <\/strong>necessarily<strong> be confirmed by the subsequent events of discovery<\/strong>, <strong>to make it<\/strong> admissible in court.\u00a0<\/li>\n<\/ul>\n<\/li>\n<li>In the case of Asar Mohd. v. State of U.P, the Supreme Court held that the concept of &#8220;<strong>fact<\/strong>&#8221; mentioned <strong>in Section 27 is not limited to physical objects<\/strong> alone but <strong>also includes<\/strong> essential <strong>psychological or mental facts<\/strong> that may be directly relevant to the case.<\/li>\n<\/ul>\n<p>The confession <strong>cannot be used to prove the guilt<\/strong> of the accused <strong>unless it is corroborated by other evidence.<\/strong><\/p>\n<hr \/>\n<h3><strong>Q1<\/strong>: What is meant by self-incrimination?<\/h3>\n<p>Self-incrimination is when someone provides information that suggests their involvement in a crime or exposes them to criminal prosecution.
