


{"id":17228,"date":"2023-11-21T07:46:00","date_gmt":"2023-11-21T02:16:00","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=17228"},"modified":"2025-04-05T02:58:20","modified_gmt":"2025-04-04T21:28:20","slug":"anticipatory-bail","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/anticipatory-bail\/","title":{"rendered":"What is Anticipatory Bail?"},"content":{"rendered":"<h2>What is a Bail?<\/h2>\n<ul>\n<li>Bail is a\u00a0judicial release of an accused person from custody\u00a0on the\u00a0condition that the\u00a0accused person will appear in court at a later date.<\/li>\n<li>Sections 436 to 439 of the\u00a0Criminal Procedure Code deal with the concept of Bail.<\/li>\n<li>Under the CrPC, bail\u00a0can be granted to an accused person either by a police officer or by a judicial magistrate.\u00a0<\/li>\n<\/ul>\n<h2>\u00a0What is an Anticipatory Bail?<\/h2>\n<ul>\n<li>It is the\u00a0bail granted to a person in anticipation and apprehending arrest.<\/li>\n<li>Under Section 438 of CrPC,\u00a0any individual who discerns that he may be tried for a non-bailable offense can apply for anticipatory bail.<\/li>\n<li>The\u00a0application shall be made to the High Court or Sessions Court, where the crime is alleged to be committed.<\/li>\n<li>Anticipatory Bail\u00a0is bail before the arrest, and\u00a0the police can&#8217;t arrest an individual if the Court has granted anticipatory Bail.<\/li>\n<li>It is meant to be a\u00a0safeguard for a person who has false accusation or charges made against him\/her, most commonly due to professional or personal enmity, as it ensures the release of the falsely accused person even before he\/she is arrested.<\/li>\n<\/ul>\n<h2>About Transit Anticipatory Bail<\/h2>\n<ul>\n<li>A transit anticipatory bail is\u00a0sought when a case against a person has been or is likely to be filed in a state different from the one\u00a0in which the person is likely to be arrested.<\/li>\n<li>The purpose of transit bail is to allow the person bail,\u00a0so they can approach the appropriate court in the state in which the case has been filed for anticipatory bail.<\/li>\n<li>In the absence of transit anticipatory bail, the result would be that another state\u2019s police could arrest a person from their home state without them having the opportunity to apply for anticipatory bail at all.<\/li>\n<li>The\u00a0procedure to be followed in transit anticipatory bail is exactly the\u00a0same as of any other anticipatory bail application.\u00a0<\/li>\n<li>The\u00a0concept of transit anticipatory bail is not codified in Indian law but has\u00a0found its identity through judicial practice and legal precedents.<\/li>\n<\/ul>\n<hr \/>\n<h3>Q1) What is a default bail?<\/h3>\n<p>Also known as statutory bail, this is a right to bail that accrues when the police fail to complete investigation within a specified period in respect of a person in judicial custody.
