


{"id":17665,"date":"2023-12-02T09:42:51","date_gmt":"2023-12-02T04:12:51","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=17665"},"modified":"2025-04-05T05:49:13","modified_gmt":"2025-04-05T00:19:13","slug":"stay-order","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/stay-order\/","title":{"rendered":"What is a Stay Order?"},"content":{"rendered":"<h2>About Stay Order<\/h2>\n<ul>\n<li>A \u2018stay\u2019 or \u2018stay order\u2019 is defined as the\u00a0act of temporarily stopping\u00a0or postponing any judicial proceeding\u00a0through the court\u00a0or legal authorities in India in order\u00a0to secure the rights of a citizen.<\/li>\n<li>It could\u00a0lead to the suspension of a case,\u00a0or\u00a0even the suspension of any specific proceeding\u00a0within an ongoing case.<\/li>\n<li>So,\u00a0till a stay order is in action, the\u00a0operation of the\u00a0Court\u2019s proceedings is made standstill, and the party who seeks it can cause the operation of the other party (against whom the order is given) to cease.<\/li>\n<li>In the case of any key development that may require it,\u00a0a judge may decide to issue a\u00a0stay order\u00a0without even\u00a0formally prompting the other party or even a request being made to them in this regard.<\/li>\n<li>There are\u00a0two types of stay orders: \u2018stay of proceedings\u2019 and \u2018stay of execution\u2019.<\/li>\n<li>A\u00a0stay of proceedings is issued by the court\u00a0in case there are parallel proceedings that take place,\u00a0which may affect either one.\u00a0<\/li>\n<li>A\u00a0stay of execution refers to the\u00a0complete halting of the enforcement of a verdict or judgement\u00a0against someone, for example, when it is believed that a person is innocent and is given a pardon.\u00a0<\/li>\n<li>This means that\u00a0stay orders can persist conditionally or even absolutely.<\/li>\n<li>The Supreme Court on March 28, 2018,\u00a0passed several directions\u00a0with regard to stay orders, applicable to\u00a0both civil and criminal matters, which are as follows:\n<ul>\n<li>In all pending cases where a stay is granted and is operating, the stay will come to an end on expiry of 6 months\u00a0from the March 28, 2018,\u00a0unless, in exceptional cases, a speaking order extends the stay.<\/li>\n<li>In cases where stay is granted in the future, i.e, after March 28, 2018, the stay order will expire 6 months from the date of such order, unless an order of extension is granted by a speaking order.<\/li>\n<li>The\u00a0speaking order granting an extension must show that the case was of such exceptional nature\u00a0that continuing the stay was more important than having the trial finalized.<\/li>\n<li>The\u00a0trial court\u00a0may fix a date not later than 6 months\u00a0from the date of the stay order.<\/li>\n<li>On the expiration\u00a0of the period\u00a0of 6 months, the\u00a0trial court will resume the proceedings without waiting for any other intimation unless an express order extending the stay is produced.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<hr \/>\n<h3>Q1) What is a trial in court?\u00a0<\/h3>\n<p>A trial in court is a formal legal proceeding in which the facts of a case are examined, witnesses are heard, and a decision is reached by a judge or jury.
