


{"id":17706,"date":"2023-12-03T06:55:39","date_gmt":"2023-12-03T01:25:39","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=17706"},"modified":"2025-04-05T06:04:59","modified_gmt":"2025-04-05T00:34:59","slug":"nhrc","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/nhrc\/","title":{"rendered":"What is the National Human Rights Commission (NHRC)?"},"content":{"rendered":"<h2>About National Human Rights Commission (NHRC)<\/h2>\n<ul>\n<li>It is a\u00a0statutory body established on 12 October, 1993, under the\u00a0Protection of Human Rights Act, 1993.<\/li>\n<li>It is the\u00a0watchdog of human rights in the country.<\/li>\n<li>It is established\u00a0in conformity with the Paris Principles (1991), adopted at the first international workshop on national institutions\u00a0for the protection of human rights.\u00a0<\/li>\n<li>Objectives:\n<ul>\n<li>To\u00a0strengthen the institutional arrangements through which human rights issues could be addressed in their entirety in a more focused manner.<\/li>\n<li>To\u00a0look into allegations of excesses,\u00a0independently of the government, in a manner that would underline the government\u2019s commitment to protect human rights.<\/li>\n<\/ul>\n<\/li>\n<li>Composition:\n<ul>\n<li>It includes a\u00a0chairperson and eight other members.<\/li>\n<li>The\u00a0Chairperson of NHRC is\u00a0the retired Chief Justice of India.<\/li>\n<li>Out of the eight members,\u00a0four are full-time members, whereas the other\u00a0four are deemed members.<\/li>\n<li>Out of the 4\u00a0full time members of the NHRC:\u00a0<\/li>\n<\/ul>\n<\/li>\n<li>One member should be a\u00a0working or retired Judge of the Supreme Court.<\/li>\n<li>Other member should be\u00a0working or retired Chief Justice of a High Court.<\/li>\n<li>Two members\u00a0are selected\u00a0based on their experience and knowledge\u00a0of human rights.\n<ul>\n<li>The\u00a04 deemed members of NHRC\u00a0are the chairpersons of the National Commission for Minorities, the National Commission for Scheduled Castes, the National Commission for Scheduled Tribes and the National Commission for Women.<\/li>\n<li>The chairperson and members are\u00a0appointed by the President\u00a0on the\u00a0recommendations of a six-member committee consisting of \u2013<\/li>\n<\/ul>\n<\/li>\n<li>Prime Minister as its head<\/li>\n<li>Speaker of the Lok Sabha<\/li>\n<li>Deputy Chairman\u00a0of the\u00a0Rajya Sabha<\/li>\n<li>Leaders of the Opposition\u00a0in both the Houses of Parliament<\/li>\n<li>Union Home Minister\n<ul>\n<li>Term: The chairperson and members are appointed for a\u00a0term of 3 years\u00a0or till the\u00a0age of 70 years, whichever is earlier.<\/li>\n<li>The chairperson and members are\u00a0eligible for reappointment.<\/li>\n<\/ul>\n<\/li>\n<li>Functions of the NHRC:\n<ul>\n<li>Inquire, on its own initiative\u00a0or on a petition presented to it by a victim or any person on his behalf,\u00a0into a complaint of violation of human rights, or abetment or\u00a0negligence in the prevention\u00a0of such\u00a0violation, by a public servant;<\/li>\n<li>Intervene\u00a0in any proceeding involving any\u00a0allegation of violation of human rights pending before a court with the approval of such court;<\/li>\n<li>Visit any jail or\u00a0any\u00a0other institution under the control of the State Government,\u00a0where persons are detained or lodged for purposes of treatment, reformation or protection\u00a0to study the living condition of the inmates\u00a0and make recommendations thereon;<\/li>\n<li>Spread human rights literacy among various sections of society;<\/li>\n<li>Study treaties and other international instruments\u00a0on human rights and make recommendations for their effective implementation;<\/li>\n<\/ul>\n<\/li>\n<li>Powers:\u00a0\n<ul>\n<li>While inquiring into complaints under the Act, the Commission shall\u00a0have all the powers of a civil court trying a suit under the Code of Civil Procedure, 1908.<\/li>\n<li>It can\u00a0summon and enforce the attendance of witnesses and\u00a0examine them on oath.<\/li>\n<li>It can also grant compensation to the victims\u00a0of police brutality.<\/li>\n<li>If necessary, the NHRC\u00a0can approach the Supreme Court or the High Court for the\u00a0enforcement of human rights in order to protect the rights of individuals or groups.<\/li>\n<li>The NHRC has the authority to take &#8220;suo motu&#8221;
