


{"id":18054,"date":"2025-02-14T07:03:11","date_gmt":"2025-02-14T01:33:11","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=18054"},"modified":"2025-04-05T08:22:30","modified_gmt":"2025-04-05T02:52:30","slug":"article-356","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/article-356\/","title":{"rendered":"Article 356 of the Indian Constitution"},"content":{"rendered":"<h2>Article 356 of the Indian Constitution Latest News<\/h2>\n<p>Four days after the Manipur Chief Minister resigned, President\u2019s Rule was imposed in the northeastern State that has been affected by ethnic violence for the past two years.<\/p>\n<h2>About Article 356<\/h2>\n<ul>\n<li>Article 356 of the Indian Constitution pertains to the <strong>imposition of President\u2019s rule over<\/strong> a certain <strong>state or Union territory.<\/strong><\/li>\n<li>It is <strong>derived from the Government of India Act of 1935.<\/strong><\/li>\n<li>This is of <strong>two types:<\/strong>\n<ul>\n<li>If the <strong>President receives a report from the state&#8217;s Governor<\/strong> or is otherwise convinced or <strong>satisfied that the state&#8217;s situation<\/strong> is such that the <strong>state government cannot carry on the governance according to<\/strong> the provisions of the <strong>Constitution<\/strong>.<\/li>\n<li><strong>Article 365:<\/strong> As per this Article, President&#8217;s Rule can be imposed<strong> if any state fails to comply<\/strong> with all <strong>directions given by the Union<\/strong> on matters it is empowered to.<\/li>\n<\/ul>\n<\/li>\n<li>In simple words, the President&#8217;s Rule is when the <strong>state government is suspended <\/strong>and the <strong>central government directly administers the state through <\/strong>the office of the <strong>governor <\/strong>(centrally appointed).<\/li>\n<li>It is also called a <strong>State Emergency or Constitutional Emergency.<\/strong><\/li>\n<li><strong>Parliamentary approval is necessary<\/strong> for the imposition of President&#8217;s Rule in any state.\n<ul>\n<li>The proclamation of President&#8217;s Rule <strong>should be approved in both Houses<\/strong> of Parliament <strong>within two months of its issue.<\/strong> The approval is<strong> by a simple majority.<\/strong><\/li>\n<\/ul>\n<\/li>\n<li>The President&#8217;s Rule is <strong>initially valid for six months<\/strong>. It can be <strong>extended up to three years <\/strong>with <strong>parliamentary approval every six months<\/strong>.<\/li>\n<li>The <strong>44th Amendment <\/strong>to the Constitution (1978) brought in some constraints on the imposition of the President&#8217;s Rule beyond a period of one year. It says that P<strong>resident&#8217;s Rule cannot be extended beyond one year unless:<\/strong>\n<ul>\n<li>There is a <strong>national emergency in India.<\/strong><\/li>\n<li>The <strong>Election Commission o<\/strong>f India certifies that <strong>it is necessary to continue <\/strong>the President&#8217;s Rule in the state <strong>because of difficulties in conducting assembly elections<\/strong> in the state.<\/li>\n<\/ul>\n<\/li>\n<li><strong>What happens after the President&#8217;s Rule is imposed?<\/strong>\n<ul>\n<li>The <strong>President takes up the functions of the state government,<\/strong> the Governor and any other executive authority in the state.<\/li>\n<li>The <strong>state will be administered by the Governor <\/strong>on behalf of the President.\u00a0<\/li>\n<li>The <strong>Governor <\/strong>will also <strong>take the help of the chief secretary<\/strong> of the state or advisors appointed by the President.<\/li>\n<li>The powers of the <strong>state legislature<\/strong> are also assumed by the President by <strong>either suspending or dissolving it.\u00a0<\/strong><\/li>\n<li>The <strong>Parliament passes the state bills and budget <\/strong>when the legislative assembly is suspended or dissolved under the President&#8217;s rule.<\/li>\n<li>The <strong>Parliament delegates law-making powers to the Presidentor any other authority<\/strong> specified by he\/she in this regard.<\/li>\n<li>The President or a delegated authority makes laws and also imposes a duty upon the Centre, its officers and its authorities.<\/li>\n<li>The <strong>President can sanction funds <\/strong>for expenditure from the State Consolidated Fund and also <strong>pass ordinances, subject to Parliament&#8217;s approval.\u00a0<\/strong><\/li>\n<li>These powers can also be exercised when the Lok Sabha is not in session, subject to sanction by Parliament.<\/li>\n<li><strong>A law or rule made<\/strong> for the state <strong>during this time continues to remain in force <\/strong>even <strong>after the end of the President&#8217;s rule<\/strong>. It <strong>can be repealed, amended, or re-enacted by the new state legislature.<\/strong><\/li>\n<li>The imposition of the President&#8217;s rule d<strong>oes not affect the fundamental rights<\/strong> of citizens, unlike the National Emergency.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Revocation of the President&#8217;s Rule:<\/strong>\n<ul>\n<li>President&#8217;s Rule can be<strong> revoked anytime <\/strong>after such a proclamation has been made <strong>by a subsequent proclamation by the President.\u00a0<\/strong><\/li>\n<li>A proclamation of revocation <strong>does not require approval by Parliament.\u00a0<\/strong><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h2>Article 356 of the Indian Constitution FAQs<\/h2>\n<p><strong>Q1<\/strong>.
