text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">DMFs are <\/span><b>statutory bodies<\/b><span style=\"font-weight: 400;\"> in India <\/span><b>established by the state governments<\/b><span style=\"font-weight: 400;\"> by notification.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">They derive their <\/span><b>legal status from <\/b><span style=\"font-weight: 400;\">Section 9B of the Mines and Minerals (Development and Regulation) Act, 1957, as amended on 26 March 2015 as the <\/span><b>Mines and Minerals (Development and Regulation) Amendment Act, 2015.<\/b><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><b>In any district affected by mining-<\/b><span style=\"font-weight: 400;\">related operations, the <\/span><b>State Government<\/b><span style=\"font-weight: 400;\"> shall, <\/span><b>by notification, establish a trust, as a non-profit body,<\/b><span style=\"font-weight: 400;\"> to be called the <\/span><b>DMF<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><b>Purpose<\/b><span style=\"font-weight: 400;\">: To <\/span><b>work in the interest <\/b><span style=\"font-weight: 400;\">and benefit <\/span><b>of persons and areas affected by mining-related operations<\/b><span style=\"font-weight: 400;\"> in a manner as may be prescribed by the respective State Government.<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><b>Jurisdiction<\/b><span style=\"font-weight: 400;\">:<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">The <\/span><b>operation of DMFs <\/b><span style=\"font-weight: 400;\">falls under the <\/span><b>jurisdiction of the relevant State Government.\u00a0<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><b>Composition and functions <\/b><span style=\"font-weight: 400;\">of the DMF are <\/span><b>prescribed by the State Governments.<\/b><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><b>Funding<\/b><span style=\"font-weight: 400;\">: It is funded through the <\/span><b>contributions from the holders of major or minor mineral concessions in the district,<\/b><span style=\"font-weight: 400;\"> as may be prescribed by the Central or State Government.<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The <\/span><b>Central Government has notified the rates of contribution <\/b><span style=\"font-weight: 400;\">payable by miners <\/span><b>to the DMFs.<\/b>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><b>In the case of all mining leases executed before 12th January, 2015,<\/b><span style=\"font-weight: 400;\"> miners will have to <\/span><b>contribute an amount<\/b><span style=\"font-weight: 400;\"> equal to <\/span><b>30% of the royalty payable <\/b><span style=\"font-weight: 400;\">by them to the DMFs.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><b>If mining leases are granted after 12.01.2015<\/b><span style=\"font-weight: 400;\">, the rate of contribution would be <\/span><b>10% of the royalty payable.<\/b><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Fund available with the Trust shall be <\/span><b>used for:<\/b>\n<ul>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"2\"><span style=\"font-weight: 400;\">The overall d<\/span><b>evelopment of the area affected by mining-<\/b><span style=\"font-weight: 400;\">related operations in the District in accordance with the Annual Action Plan prepared by the Trustees of the Foundation for the purpose.<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"2\"><b>Creation of local infrastructure <\/b><span style=\"font-weight: 400;\">for socio-economic purposes.<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Providing, <\/span><b>maintaining, or upgrading community assets and services <\/b><span style=\"font-weight: 400;\">for the local population in the area affected by mining-related operations.<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Organising or<\/span><b> conducting training programmes<\/b><span style=\"font-weight: 400;\"> to skill development and capacity building for creating employment and self-employment capabilities.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h1><b>Pradhan Mantri Khanij Kshetra Kalyan Yojana (PMKKKY)<\/b><\/h1>\n<ul>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">The <\/span><b>Ministry of Mines<\/b><span style=\"font-weight: 400;\"> launched PMKKKY in <\/span><b>2015 <\/b><span style=\"font-weight: 400;\">for the <\/span><b>welfare of areas and people affected by mining-<\/b><span style=\"font-weight: 400;\">related operations, <\/span><b>using the funds generated by DMFs.<\/b><\/li>\n<li style=\"text-align: justify;\"><b>Objectives<\/b><span style=\"font-weight: 400;\">:<\/span>\n<ul>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">To implement various d<\/span><b>evelopmental and welfare projects in mining-affected areas<\/b><span style=\"font-weight: 400;\">, complementing the existing ongoing schemes of the State and Central Government.<\/span><\/li>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">To <\/span><b>minimize\/mitigate the adverse impacts, during and after mining, <\/b><span style=\"font-weight: 400;\">on the environment, health, and socio-economics of people in mining districts.<\/span><\/li>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">To ensure <\/span><b>long-term sustainable livelihoods<\/b><span style=\"font-weight: 400;\"> for the affected people in mining areas.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"text-align: justify;\"><b>Utilisation of Funds:<\/b>\n<ul>\n<li style=\"text-align: justify;\"><b>At least 60%<\/b><span style=\"font-weight: 400;\"> of PMKKKY funds to be utilized <\/span><b>for high-priority areas <\/b><span style=\"font-weight: 400;\">such as <\/span><b>Drinking water supply, Health care, Education,<\/b><span style=\"font-weight: 400;\"> Environment preservation, etc.<\/span><\/li>\n<li style=\"text-align: justify;\"><b>Up to 40%<\/b><span style=\"font-weight: 400;\"> of the PMKKKY to be utilized for other priority areas such as <\/span><b>Physical infrastructure, Irrigation, Energy, and Watershed Development, etc.<\/b><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><b>Source:<\/b> <strong><a href=\"https:\/\/www.livelaw.in\/high-court\/allahabad-high-court\/allahabad-high-court-ruling-district-mineral-foundation-section-9b-mmdr-act-516331\" target=\"_blank\" rel=\"nofollow noopener\">LL<\/a><\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>District Mineral Foundations are statutory bodies in India established by the state governments by notification.
