


{"id":19224,"date":"2024-01-12T12:21:42","date_gmt":"2024-01-12T06:51:42","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=19224"},"modified":"2025-04-05T16:05:08","modified_gmt":"2025-04-05T10:35:08","slug":"article-30","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/article-30\/","title":{"rendered":"What is Article 30 of the Indian Constitution?"},"content":{"rendered":"<h2>About Article 30<\/h2>\n<ul>\n<li>It is one of the many provisions that ensure the preservation of minority rights.\u00a0<\/li>\n<li>Article 30 of the Indian Constitution states the\u00a0right of minorities to establish and administer educational institutions.<\/li>\n<li>It says: \u201cAll minorities, whether\u00a0based on religion or language, shall\u00a0have the right to establish and administer educational institutions of their choice.\u201d<\/li>\n<li>It was adopted on December 8, 1948.<\/li>\n<li>Features:\n<ul>\n<li>It consists of provisions that safeguard various rights of the minority community in the country, keeping in mind the principle of equality as well.<\/li>\n<li>Article 30(1) says that\u00a0all minorities, whether based on religion or language, shall have the right to establish and administer educational institutions of their choice.<\/li>\n<li>The right is provided by this clause\u00a0on two types of minorities, namely, religious and linguistic minorities.\u00a0<\/li>\n<li>Article 30(1A)\u00a0deals with the\u00a0fixation of the amount for the acquisition of property\u00a0of any\u00a0educational institution established by minority groups.<\/li>\n<li>Article 30(2) states that the\u00a0government should not discriminate against any\u00a0educational institution on the ground that it is under the management of a minority, whether based on religion or language,\u00a0while giving aid.<\/li>\n<\/ul>\n<\/li>\n<li>Concept of Minorities:\n<ul>\n<li>The\u00a0Constitution of India uses the word minority but\u00a0does not define it.<\/li>\n<li>Article 29 of the Indian Constitution\u00a0uses the word \u2018minorities\u2019 in its marginal heading,\u00a0but it speaks about &#8220;any section of the citizens inhabiting the territory of India or any part of the country should\u00a0have the right to protect their language or script or culture,\u00a0which is different and varied.\u00a0\n<ul>\n<li>It also says that citizens should be allowed to take admission in any educational institution\u00a0which is\u00a0maintained by the State\u00a0or getting help from State funds\u00a0whether they vary in religion, race, caste, language, or any of them.<\/li>\n<\/ul>\n<\/li>\n<li>Article 30 of the Constitution of India\u00a0talks only about religious and linguistic minorities.<\/li>\n<li>Religious Minority: The\u00a0basic ground for a community to be nominated as a religious minority is the\u00a0numerical strength of the community.\u00a0<\/li>\n<li>Section 2, clause (c) of the National Commission of Minorities Act, declares six communities\u00a0as minority communities. They are:\n<ul>\n<li>Muslims<\/li>\n<li>Christians<\/li>\n<li>\u00a7 Buddhists<\/li>\n<li>Sikhs<\/li>\n<li>Jains and<\/li>\n<li>Zoroastrians (Parsis)<\/li>\n<\/ul>\n<\/li>\n<li>Linguistic Minorities:\n<ul>\n<li>Class or group of\u00a0people whose mother language or mother tongue is\u00a0different from that of the majority groups is known as the linguistic minorities.\u00a0<\/li>\n<li>Article 350-A of the Indian Constitution imposes an\u00a0obligation on the states to try to\u00a0provide\u00a0enough facilities for\u00a0instruction in the mother language at the primary level of education\u00a0to children belonging to the linguistic minority community.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<hr \/>\n<h3>Q1) What are Fundamental Rights under the Indian Constitution?<\/h3>\n<p>The Fundamental Rights, embodied in Part III of the Constitution, guarantee civil rights to all Indians, and prevent the State from encroaching an individual&#8217;s liberty while simultaneously placing upon it an obligation to protect the citizens&#8217; rights from encroachment by society.. Significantly, fundamental rights are enforceable by the courts, subject to certain conditions.
