In simpler terms, cheating is a\u00a0dishonest act performed in order to gain some advantage out of it.<\/li>\n<li>Section 420 IPC is a\u00a0serious form of cheating that includes inducement (to lead or move someone to happen) in terms of the delivery of property as well as valuable securities.<\/li>\n<li>This section is\u00a0also applicable to matters where the destruction of property\u00a0is caused\u00a0by cheating or inducement.\u00a0<\/li>\n<li>The person found guilty under this section shall\u00a0be punished with imprisonment of either description for a term\u00a0that may extend to seven years\u00a0and shall\u00a0also be liable to a fine.<\/li>\n<li>The offence is\u00a0cognizable and non-bailable.<\/li>\n<li>The essential ingredients that go into the making of an offence under Section 420, IPC are:\n<ul>\n<li>That the\u00a0representation made by the accused was false;<\/li>\n<li>That the\u00a0accused knew that the representation was false at the very time when he made it;<\/li>\n<li>That the accused\u00a0made the false representation with the dishonest intention\u00a0of deceiving the person to whom it was made; and<\/li>\n<li>That the accused\u00a0thereby induced that person to deliver any property or to do or to omit to do something\u00a0which he would otherwise not have done or omitted.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<hr \/>\n<h3>Q1) What is a cognizable offense?\u00a0<\/h3>\n<p>A Cognizable offense or case is defined as the one which an officer in-charge of a police station may investigate without the order of a magistrate and effect arrest without warrant.
