


{"id":20335,"date":"2024-02-10T01:09:08","date_gmt":"2024-02-09T19:39:08","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=20335"},"modified":"2025-04-06T00:39:34","modified_gmt":"2025-04-05T19:09:34","slug":"preamble","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/preamble\/","title":{"rendered":"Preamble of the Indian Constitution"},"content":{"rendered":"<h2>About Preamble of the Indian Constitution<\/h2>\n<ul>\n<li>The preamble of the Indian Constitution\u00a0serves as a brief introductory statement of the Constitution that\u00a0sets out the guiding purpose, principles, and philosophy of the Indian Constitution.<\/li>\n<li>The Preamble is\u00a0based on the Objectives Resolution\u2019, drafted and moved\u00a0by Jawaharlal Nehru and\u00a0adopted by the Constituent Assembly on January 22, 1947.<\/li>\n<li>The Preamble\u00a0reveals four ingredients or components:\n<ul>\n<li>Source of authority of the Constitution: It is indicated by the Preamble that the source of authority of the Constitution\u00a0lies with the people of India.<\/li>\n<li>Nature of the Indian State: It declares India to be a\u00a0sovereign, socialist, secular, and democratic republic.<\/li>\n<li>Objectives of the Constitution: The objectives stated by the Preamble are to\u00a0secure justice, liberty, and equality to all citizens and\u00a0promote fraternity to maintain unity and integrity\u00a0of the nation.<\/li>\n<li>Date of adoption of the Constitution: It stipulates\u00a0November 26, 1949,\u00a0as the date.<\/li>\n<\/ul>\n<\/li>\n<li>Amendments:\u00a0By the\u00a042nd Amendment of 1976, the\u00a0words \u201cSocialist\u201d and \u201cSecular\u201d\u00a0were inserted; the Preamble now reads \u201cSovereign Socialist Secular Democratic Republic\u201d.<\/li>\n<li>Interpretation by the Supreme Court:\n<ul>\n<li>Berubari Union case: In this case, it was held by the Supreme Court that the\u00a0Preamble is part of the Constitution. However, it recognised that the Preamble\u00a0could be used as a guiding principle if a term in any article of the Constitution\u00a0is ambiguous or has more than one meaning.<\/li>\n<li>Keshvananda Bharti v. State of Kerala: In this case, the Supreme Court overturned its earlier decision and\u00a0held that the Preamble is a part of the Constitution and can be amended\u00a0under Article 368 of the Constitution.<\/li>\n<\/ul>\n<\/li>\n<li>Again, in the\u00a0LIC of India case, the Supreme Court held that the\u00a0Preamble is a part of the Constitution.<\/li>\n<\/ul>\n<hr \/>\n<h3>Q1) What is the Constituent Assembly of India?<\/h3>\n<p>The Indian Constitution was made by the Constituent Assembly, which came into existence as per the provisions of the Cabinet Mission of May 1946. Its task was to formulate a Constitution for facilitating the appropriate transfer of sovereign power from British authorities to Indian hands. It comprised members who were partly elected and partly nominated.
