{"id":20368,"date":"2024-02-11T05:03:53","date_gmt":"2024-02-10T23:33:53","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=20368"},"modified":"2025-04-06T00:52:17","modified_gmt":"2025-04-05T19:22:17","slug":"adverse-possession","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/adverse-possession\/","title":{"rendered":"What is Adverse Possession?"},"content":{"rendered":"<h2>About Adverse Possession<\/h2>\n<ul>\n<li>It is a\u00a0legal concept that\u00a0allows a person who has\u00a0unlawfully occupied someone else\u2019s land\u00a0for a certain period of time\u00a0to claim legal ownership of that land.<\/li>\n<li>The claimant\u00a0must demonstrate that several criteria have been met before the court will allow their claim.<\/li>\n<li>If the adverse possession is successful after following certain requirements and conditions, there will be\u00a0no requirement to compensate the owner for that property\u00a0or receive their permission.<\/li>\n<li>Adverse possession is\u00a0also\u00a0known as squatter\u2019s rights.<\/li>\n<li>It is a\u00a0negative and consequential right that arises due to the negligence of the true owner.<\/li>\n<li>The rights and conditions for achieving adverse possession\u00a0vary depending on the country.<\/li>\n<li>In India, adverse possession has been a part of the legal framework for a long time and is rooted in the idea that land must not be left vacant and instead be put to judicious use.<\/li>\n<li>The\u00a0law of Adverse Possession in India is\u00a0governed by the principle of\u00a0The Limitation Law of 1963.\n<ul>\n<li>The law on adverse possession\u00a0provides that\u00a0any person who has been\u00a0in possession of\u00a0private land\u00a0for more than 12 years or\u00a0government land for over 30 years is\u00a0granted the ownership rights to the property.<\/li>\n<li>To claim adverse possession, the occupier\u00a0must prove\u00a0that\u00a0they have been in\u00a0continuous, uninterrupted possession of the land for at least 12 years (in the case of private land)\u00a0and that their possession was open, notorious, and hostile\u00a0to the\u00a0true owner.<\/li>\n<li>As per adverse possession under the limitation act, if, over a due course of time or period, an appeal is not made to revise any limitation, the current scenario of titles continues.\u00a0<\/li>\n<li>Thus,\u00a0if a property owner fails to make a claim on their property\u00a0for 12 years and the same tenant continues to occupy the property for 12 years, the\u00a0ownership rights\u00a0to the property are\u00a0transferred to the tenant.<\/li>\n<li>If one intends to establish adverse possession under the Limitation Act of 1963, the\u00a0burden of proof will rest on them.\u00a0<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<hr \/>\n<h3>Q1) What is a negative right?<\/h3>\n<p>Negative rights require the government to refrain from acting in certain ways; governments can respect individuals&#8217; negative rights simply by doing nothing at all.
