The wife is entitled to maintenance if she is unable to support herself. The word &#8220;wife&#8221;\u00a0refers to a woman who has been divorced\u00a0or sought divorce from her spouse\u00a0and has not remarried.<\/li>\n<li>Children: Children, whether\u00a0legitimate or illegitimate, who are unable to maintain themselves and are\u00a0below a certain age\u00a0or mentally\/physically disabled can claim maintenance from their parents.<\/li>\n<li>arents: Under this, both father and mother are\u00a0entitled to be maintained\u00a0equally by son and daughter, but the court must be satisfied that the daughter has the means to support herself. Parents also\u00a0include \u201cAdoptive father\u201d and \u201cAdoptive mother.\u201d<\/li>\n<\/ul>\n<\/li>\n<li>To successfully claim maintenance under Section 125 CrPC,\u00a0certain conditions must be met:\n<ul>\n<li>Neglect or Refusal: The person seeking maintenance must demonstrate that the\u00a0respondent (the person from whom maintenance is sought)\u00a0has\u00a0neglected or refused to provide financial support.<\/li>\n<li>Dependency: The\u00a0claimant must establish their inability to maintain themselves and\u00a0their dependency on the respondent\u00a0for financial assistance.<\/li>\n<li>Sufficient Means: The person from whom maintenance is claimed\u00a0must have sufficient means to maintain the person claiming.<\/li>\n<\/ul>\n<\/li>\n<li>Quantum of Maintenance:\u00a0The\u00a0court will determine the amount of maintenance based on various\u00a0factors like the income and financial capacity of the person liable to pay, the\u00a0needs of the claimant, and other relevant circumstances. The objective is to ensure that the claimant gets a reasonable and fair amount for their maintenance.<\/li>\n<li>Duration: Maintenance\u00a0can be awarded on a monthly basis, and the court can specify a duration for which it should be paid.
